RESOLUTION NO. 91-~
RESOLUTION REPEALING ALL PRIOR COUNTY
COMMISSION DISTRICT BOUNDARIES AND
ESTABLISHING NEW COUNTY COMMISSION
DISTRICT BOUNDARIES IN ACCORDANCE
WITH CHAPTER 124, FLORIDA STATUTES AND
THE FLORIDA CONSTITUTION.
WHEREAS, Article VIII, Section l(e), Florida Constitution,
provides that after each decennial census the Board of
Commissioners shall divide the county into districts of contiguous
territory as nearly equal in population as practicable; and
WHEREAS, Chapter 124, Florida Statutes, authorizes the Board
of Co"nty Commissioners to realign the boundaries of the County
Commission Districts to provide districts as nearly equal in
population as practicable; and
WHEREAS, the County Staff was directed by the Board of County
Commissioners on August 20, 1991 to use certain criteria in
establishing ths County Commission district boundaries; and
WHEREAS, the County Staff has held advertised pUblic meetings
at Pine Ridge Middle School, Big Corkscrew Island Fire Control
District Fire Station, Lely High School and Immokalee High School
to receive comments from the public and encourage public
participation in the redistricting process; and
WHEREAS, advertised public notice has been provided regarding
the redistricting of the County Commission district boundaries.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1) Pursuant to the authority of Chapter 124, Florida
Statutes, and Article VIII, Section l(e), Florida Constitution,
all prior County Commission District boundaries in Collier County
as adopted by Resolution No. 85-205 are hereby repealed and the
new boundaries are hereby established to encompass the areas
described below:

Begin at the intersection of the easterly shoreline of the Gulf of

the Lee County-collier County boundary line) easterly to the
northeast corner of said Section 5; thence along the east line of
said Section 5, southerly to the northwest corner of Section 9 of
said Township and Range; thence along the northerly boundary of
Collier County, easterly to the center of the Florida Power and
Light (FPL) transmission line; thence along said center of the FPL
transmission line, southerly 10,000 feet more or less to a

Legal notice having been published in the Naples Daily News on
October 6, 1991, as evidenced by Affidavit of Publication filed with
the Clerk, public hearing was opened to consider adoption of a resolu-
tion redistricting County Commission District Boundaries and
eatablishing new County Commies ion Dietrict Boundaries pursuant to
Chapter 124, Florida Statutes and the Florida Constitution,
Michelle Edwards, Planning Services, reported that in 1967,
Statute 2 ot the United States Supreme Court form~11y established the
rule requiring single-member districts tor the election of
Congressmen, which was the implementatlon of ~n ~arlier ruling
requiring the principle at one man, one vote.
She added the Voting
Rights Act of 1965 was originally designated to prc)t~ct and facilitate
the voting rights of racially mlnorlty groups arid subsequent amend-
ments to that Act has expanded it to include m~mbers of the language
minority group. as well as other matters regarding voting qualltica-
tion. and procedures.
She advised Section 2 of the Voting Rights Act
ot 1965 prohibits the use ot discriminatory rediRtrlcting plans or
electoral districts that dilute the minority voting strength.
Additionally, she eaid, Article 8 of the ConRtltutlon of the State of
Florida requires that after each decennial census, the Board of County
Coamissioners shall divide the County into districts of contiguous
territories a8 nearly equal in population as practicable, with one
commissioner residing 1n each district elected as provided by law.
She noted Florida law further requires the Board at COllnty
Co.missioners to, trom time to time, fix the boundaries of the com-
mlssJon districts so aR to keep them as nearly ~qual in proportion tel
population as possible, prov1ded that changes mad~ in the boundaries
ot the County Commission districts are made only in odd-numbered
years.
She reported with the new census, information received by the
County's Elections Office was utilized to complete the redistricting

proce... She reaarked the following criteria for redrawing the new
co..lssion district boundaries was approved by the Board of County
Commissioners 1n August: 1) the population of ~ach district should be
as s1.llar as possible; 2) the districts should be as compact and
regularly shaped as feasible; and 3) the incumbent Commissionerls
residence must be In his or her current digtrict
She mentioned cri-
terla used by the Justice Department in reviewing the validity of
redistricting efforts look at whether or not th~ efforts diluted the
minority voting strength; whether or not isolat~d ~r~as are being
created; ensuring identifiable neighborhoods or communities are not
split by district boundaries whenever possible; and whether all effort
was aade to receive public input in the redistricting process. She
noted Statt has held B~veral meetings in the community In conjunction
with the School Board. She explained fInal criteria is the range of
population between each district which should not e~ceed 5% and the
average deviation of the five districts should not exceed 1%. Sll~
remarked Staff I s proposal is 2.5% at the r~nge i-lnlJ .5% of the average
deviation.
Planner Edwards continued, stating the current district pop\ll~-
tions are very unbalanced with a low of 22, lOR in District 4
increasing to 37,279 in District 2. Shp. gaid St~ffls proposal balan-
c~s the population within the districts. She ~tated District 1 has
been revised to include the area north of Rattlesnake Hammock Road
to Davis Boulevard, while the area south of U.S. 41 and ea~t of C.R.
951 has been added to District 5. She noted Djstrlct 4 has been
expanded to include the neighborhoods in the area of Bayshore and
Thomasson Drives, the Park Shore area recently annexed by the City of
Haplee and the area south of Pine Ridgp Road and east of U.S. 41. She
advised that DistrJct 2 has been reduced somewh~t because that i5 the
area where most ot the growth has occurred since the iast
redistricting process. She stated its present boundaries expand along
X..okalee Road to C.R. 951 and to the south of pjne RIdge Road. She
said the area east of Airport-Pulling Road has now been includen into

District 3. She mentioned the only change thdt h~s occurred to
District 5 wae the addition of the area south of U.S, 41 and east of
C.R. 951 along with a small portion encompassing Willoughby Acres and
Turnbury subdivisions.
Planner Edwards indicated Staff's proposal minimizes the amount of
changes and people being shifted from one district to another. She
said the proposal meets all the criteria, Is well within the average
deviation and strengthens the minority representation In District 5.
She mentioned the community meetings held with regard to this issue
brought forward three proposals from the School Board whirh followed
similar criteria. She said of thoee. Option 3 is the plan most sImi-
lar to Staff's presentation. She mentioned comments made at the
public .eetlngs indicated a consensus that the boundarjes of the
School Board and Board at County Commissioners ~hOIJlrl b~ as simil~rly
aligned as possible. She added the majority of citizen comments
favored Staff's proposal as opposed to thosp. of the School Board, with
the exception at the meeting held at Lely High School. She stated the
East Naples Civic Association presented their uwn pl~n which was
favored by the audience. She recalled comments from representatives
ot the Turnbury subdivision in opposition to their inclusion In
District 5. indicating their preference to remain in District 2, She
said Statt investigated that issue, however, it would require
adjusting the population by 1.500 which would necessitate changing the
boundaries of other districts accordingly.
Planner Edwards communicated the NAACP was present at a number of
meetings and suggested including Naples Manor irl District 5 and
limiting the amount of coastal urban area wjthirl District 5. She ~aid
their feeling was tllat District 5 is mostly rural and minimizing the
urban area would be more consistent. She said the East Naples Civic
Association presented a proposal that did not meet the Board's iden-
titied criteria, however, the revised option to be presented this date
does meet the established requirements. stle noted their proposal
addresses the concern expressed by citizens by allowing Turnbury and

Willoughby Acre. .ubdivisions to remain in DistrIct 2 and the inclu-
slon of Naple. Manor In District 5. She stated Staff is concerned
with soae aspects ot their proposal because it creates districts in
which a commissioner may no longer be representing those who elected
hi. or her, a8 well as creating districts in which Q large number of
the populstion is being shifted, She added their option looks as
though the Naples Manor area Is int~ntlonally being cut out irl order
to be included 1n District 5.
Planner Edwards concluded by explainJng th~t Section 5 of the
Voting Rights Act requires certain states and political subdivisions
to sub.it all their changes relating to elections and redistricting
plans to the U.S. Attorney General for pre-clearance. She advised
Collier County Is one of five counties selected for this process and
will be required to submit its pre-clearance to the Justice Department
no later than October 31st. therefore, a decision must be made this
date.
In response to Commissioner Shanahan, MR. P.dwards affirmed that
the 1985 redistricting process was approved by th~ Justice Department.
She said not only doe~ Staff's proposal meet that crjteria, it alHo
accomplishes a better balance of racial populat ions in the districts,
in particular Dlstrict 5.
The people listed below spoke in oppositi9n to Staff's plan and in
tavor of the East Naples Civic Association proposal for the following
reasons: Staft's proposal sp11ts East Naples into three districts
while the East Naples Civic Association proposes the majority of East
Naples as one unified district; Staff's proposal will totally dilute
the voting power of the East Naples community; the East Napl~s propo-
sal combines the coastal region of Marco Island and the City of Naples
into one district of similar interests; the East Naples plan detin~s
Collier County communities as they actually exifJt, North Naples,
Golden Gate, East Naples. the coastal region and the rural area; the
East Naples proposal meets all the criteria spt by State Statute arId
the u.s. Justice Department; the East Naples plnn ha~ the endorsement
of the East Naples Civic Association and the NAAr.P.

t1tlcatjon ot the lawful authority under whir.h the change was made;
description of the procedures required to be followed in deciding to
make the change; reasons for the change; stat~mpnt of ttle antlcipatpd
effective change on language minority groups. st~t~ments as to any
pre-clearance history directed to the ctlange and for redistricting;
demographic information; total in voting age profile; populatioTI
before and atter the change; race and language groups; and maps of the
prior and the new boundaries.
He indicated th.r\t it 18 crucial that

He stated that he endorses the notion of
alternate year review, 1n the odd numbered years, of the matters
before the Co..lssion today and that consideration be given to impa-
neling a non-partisan group of well known citizens who will exercise
their best judgement in meetings held in the sunshine, reviF!wing popu-
lation estimates and reporting the1r conclu~lnrls tl) the Bo~rd.
Mrs. Charlotte Westman, representing the [,e~gue of Women Voters of
Collier County. concurred with the suggestion relative to a special
co..ittee to review the subject of district lines every other odd
year. She called attention to a letter to the Commission trom the
League, dated October 16, 1991, recommending that the new 1991 Board
ot County Commissioners and School Board District lines be the same,
with one small deviation: Wyndemere, one square mile and 700 people
reaain in Co..ission District 2 and that the School Board District 3
line deviate to include Wyndemere. She noted that all other new
district lines would be the same. She announced that the Leagu~ Sllp-
ports the position ot Supervieor ot Elections Morg;;tln concerning
district lines that mesh which would provjd~ sjmpljfic~tion, elimlnate
contusion, allow more efficient vote t~bul~tion arid stre~mljnirlg
registration cards and ballots.

Mr. George Keller endorsed the recommendations of Statf with
regard to the proposed redistricting boundaries. He reminded the
Commission that Federal laws do not specifically make it necessary to
ensure that anyone has power due to race, color, or national origin.
He cited opposition to the East Naples Civic Association's proposal,
noting that many of these residents do not desire to be segregated
out of the district that they are in. He indicated that many of the
people in this district are illegal aliens.
Mr. Dan Head, resident of Marco Island, st~ted that the people of
Marco Island believe that they are 4 part of Collier County and well
represented by five County Commissioners. He advised that the
Commission is doing the best for the County and the majority of the

Co..issloner Hasse explained that he fp-els that staff's proposal
provides equalization ot the population and due consideration of the
ethnic groups. He stated that he respects the East Naples Civic
Association and has a real feeling tor what they are representing. He
indicated that statf has devoted a great deal elf time relating to thls
issue and concurs with their recommendation.

CommIssioner Volpe entered Into the record d letter he received
from the Second District Association, which is an associatIon con-
Sisting at most at the property owners associations/homeowners asso-
ciations 1n District Two. He read from the letter as follows: "It
was moved and seconded that: It is the sense of the Association that
the co..unity of interest found within the 2nd District will be best
sustained by keeping the 2nd District geographical area intact by
establishing 1-75 as the eastern most boundary. Further any popula-
tion adjustment should take away existing 2nd DIstrict property east
of 1-75 and only go tar enough south to meet the population criteria.
Further, the Association recommends that the School Board Districts
should be aligned with the commIssion districl~ with the school board
members elected as the commissioners are, i.e.. on a one-per-district
basis."
Co_fss1oner Volpe remarked that comments were made at the public
hearings at Pine Ridge Middle School and the Big Corkscrew Fire
Station with regard to the inclusion of Willoughby Acres and the
Turnbury Subdivision within District 5. He suggested that those two
subdivisions be consistent with the recommendations at the District
Two Association, and that they remain within Oistrict 2.

With respect to Commissioner Volpe's remarks regarding Willuughby
Acres and Turnbury remaining In District 2. Ms. ~dwards indicated that
this would affect the district boundaries of three areas since 1,~OO
people would be removed from District 5, reducing the population to
28,000 and adding same to District 2 which already has a substantial
a.ount of population,
Coamissioner Volpe explained that the issue of population is
i.portant but views this as mare than just numbers. He noted that he
sees hie responsibilities as being representative of not only those
who have elected him, but the community at large as well. He
disclosed that there should be compact dlRtrlr.ts and some community of
interests. He remarked that there are issue~ relating to rur~l
Collier County that do not impact upon the City of Nit[Jles. He
observed that these are last year's numbers and if th~re is an empha-
sls on development at Orange tree next year, they will be locked into
his district,
Commissioner Shanahan advised that there has been a great deal of
time, effort and expense 1n going through the 5election process. He
remarked that the logic ot the East Naples proposal 1s a sound one,
and one that he could live with, however, staff's recommendation is
the best balanced approach that will provide the type of leadership
and representation that the entJre community demands.
