Board meeting to order for May 22nd, 2008.
Notice: The respondent may be limited to 20 minutes for case
presentation unless additional time is granted by the board.
Persons wishing to speak on any agenda item will receive up to
five minutes, unless the time is adjusted by the chairman.
All parties participating in the public hearing are asked to
observe Roberts Rules of Order and speak one at a time so that the
court reporter can record all statements being made.
Any person who decides to appeal a decision of this board will
need a record of the proceedings pertaining thereto and therefore may
need to ensure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the
appeal is to be based. Neither Collier County nor the Code
Enforcement Board shall be responsible for providing this record.

I'd just like to welcome Mr. L'Esperance; he's a regular member
now. He was appointed by the board at their last meeting.
CHAIRMAN LEFEBVRE: Congratulations.

CHAIRMAN LEFEBVRE: Do we have any changes to the
agenda?
MS. ARNOLD: Yes, we do. Item number 4-C-4, which is Board
of County Commissioners versus 6240 Collier Group, Incorporated, is
stipulating.
I believe they're also working on a stipulation for 4-C-5, Board
of County Commissioners versus Hamo Gutic. And I apologize if I
crucified his name.
Also, 4-C-7, Board of County Commissioners versus Angel and
N orberto Hernandez.
And 4-C-8, 9 and 10 are also being stipulated, Board of County
Commissioners versus Monterey Master Owners Association.

We're going to start with BCC versus 6240 Collier Group, Inc.

MS. O'FARRELL: This is Case No. 2007080153.
For the record, Susan O'Farrell, Collier County Code
Enforcement Investigator, Environmental Specialist.
6240 has come into an agreement with Collier County. And I
will read off the stipulation.

They have agreed that the violations noted in the referenced
Notice of Violation are accurate and stipulate to their existence. It is a
deficient buffer, landscape buffer with trees and shrubs.
The violations are that of Section 4.06.05(J) and are described as
landscape requirements.
It has been agreed between 6240 Collier Group and the county
that they will pay operational costs in the amount of $537.97 -- I'm
sorry, 93 cents -- incurred in the prosecution of this case.
And they will abate all violations by: Replacing dead and failing
plant material in Collier County required buffers with native trees
eight to 12 feet in height, and with a three-inch caliper or -- I'm going
to change that to a one and a half to a three-inch caliper, because that's
a kind of short tree with a large caliper. So we're going to go with the
one and a half inch to three inch caliper; we'll give them a little
flexibility -- placed every 30 feet and a double row hedge of native
plant material 24 inches in height at time of planting within 90 days of
this hearing or a daily penalty of$150 per day.
The respondent will notify code enforcement the violation has
been abated and request the investigator to come out and perform a
site visit.
The stipulation has been signed by Mr. Guillama, and he's a
partner of the Collier Group.

MS. ARNOLD: Can I just ask for -- make sure that it's eight to
10 feet. Because Susan -- the one that I actually had up on then

visualizer said eight to 12 feet in height and it really should be eight to
10.
MS. O'FARRELL: Or we can keep it eight to 12. Because Mr.
Guillama has said that he's going to make every effort to bring it -- to
get the biggest trees that he can. We were just trying to give him some
flexibility in size. So it's up to you if you want to change it or not.
CHAIRMAN LEFEBVRE: So for the record, it will be eight to
12 feet. Very good.
MS. O'FARRELL: We'll give him a good spread, okay?
MR. GUILLAMA: That will give me a little flexibility. Thank

have they come to an agreement?
MS. ARNOLD: Yes, we have a stipulation.

MR. SNOW: The respondent is here and we have agreed upon a
stipulation agreement today.
The agreement is as follows: Is pay operational costs in the
amount of 372 incurred in the prosecution of this case within 30 days
of the date of the hearing and abate all violations by: Obtaining

after-the-fact permits for all unpermitted construction remodeling
additions on property. Obtain all inspections through certificate of
completion within 120 days of the date of this hearing or a fine of
$200 a day will be imposed until such time as the unpermitted
construction remodeling has been permitted, inspected and C.O.'d.
Or obtain a demo permit and remove any unpermitted
construction remodeling additions within 120 days of to day's hearing
and restore the building to its original permitted state; to include all
inspections and a final certificate of completion or a fine of $200 a day
will be imposed until such time as the building is restored to its
permitted state and all unpermitted construction remodeling additions
have been removed, with all inspections to include the final CO for the
demo permit.
Remove all construction waste to the appropriate site for such
disposal.
B is to cease any activity that is not in compliance with and in
accordance to the Land Development Code of Unincorporated Collier
County.
And C, the respondent must notify the code enforcement
investigator when the violations have been abated in order to conduct
a final inspection to confirm abatement.

We're going to move on to BCC versus Angel and Norberto
Hernandez.
(Speakers were duly sworn.)
MS. WALDRON: For the record, Jen Waldron, Collier County
Investigator Supervisor.
We have reached a stipulation agreement on Case No.
2007010485. This was a violation of vegetation removed on
undeveloped property without obtaining the proper required Collier
County permits.
The respondents have agreed to pay operational costs in the
amount of $404.08 incurred in the prosecution of this case within 30
days of this hearing.
The respondent must prepare a mitigation plan which meets the
criteria stated in 04-41, as amended, Section 10.02.06(E)(3). The
mitigation plan shall be prepared by a person who meets or exceeds
the credentials specified in Section 10.02.02(A)(3).
The respondent is required to establish a monitoring program
that would determine the 80 percent survivability of species of the
plants used in the mitigation effort over a two-year period with
replacement required to maintain 80 percent minimum annually.
A minimum of two reports will be submitted by the respondent.
The mitigation plan must be submitted within 30 days of this hearing
or a daily fine of $200 will be imposed for each day until mitigation
plan is submitted.
All plant materials must be installed in accordance with
mitigation plan within 60 days of acceptance of mitigation plan, or a

daily fine of $200 will be imposed for each day until plant material is
installed.
CHAIRMAN LEFEBVRE: Is 30 days sufficient to get a
mitigation plan and submit it to the county?
MS. WALDRON: Yes.
MR. KELL Y: How big of an area is this spread we're talking
about? And how many trees, do you think?
MS. WALDRON: I would say it's probably going to be 20 to 30
trees.
CHAIRMAN LEFEBVRE: Any other discussion, questions
from the board?
(No response.)
CHAIRMAN LEFEBVRE: May I have a motion?
MR. LARSEN: Move to accept the county's stipulation as
proposed.
MR. KELL Y: Mr. Chair?
MR. KRAENBRING: Second.
MR. KELL Y: The respondent wanted to comment.
CHAIRMAN LEFEBVRE: Yes, sir.
MR. NORBERTO HERNANDEZ: He wants to know why do he
have to replace 20 or 30 trees.
MS. WALDRON: Well, the environmental consultant's going to
come up with that number. I can't tell you exactly what it's going to
be.
MR. NORBERTO HERNANDEZ: Because we cut melaleucas
and pepper trees we have to replace 20 or 30 trees in the -- that's why?
MS. WALDRON: Did you not want to do the stipulation
agreement? Because we did discuss this earlier.
MR. NORBERTO HERNANDEZ: We're going to do what we
according -- supposed to do.
CHAIRMAN LEFEBVRE: I'm going to ask you now before we
take a vote, do you agree to the stipulated agreement?

MR. NORBERTO HERNANDEZ: I guess he doesn't agree.
We're going to do what we're supposed to do, according by the
requirements. But, you know, he's --
CHAIRMAN LEFEBVRE: The question I have for you is you
were outside earlier and discussing the agreement. You came to this
agreement and now you're in front of us and we're about to vote on it.
There's a couple different ways we can go: You can either agree
to it or maybe possibly send you back outside.
But what -- it's saying that you are going to abide by the
mitigation. When they come out and tell you how many trees have to
put in, you're going to have to abide by that.
So the question I have for you now is do you want to agree to the
stipulated agreement or not?
MR. NORBERTO HERNANDEZ: He would like to talk to her,
if it's possible.
CHAIRMAN LEFEBVRE: Okay. We're going to have you
come back.
And do I have to pull the -- at this --
MS. RAWSON: You're just going to have a short continuance, a
break in the public hearing and then just recall a case after you hear a
couple of others.
CHAIRMAN LEFEBVRE: Okay. All right, I'm going to
continue this and hopefully you can go out there and come up to an
agreement or maybe have it explained to you a little bit better, and
then you can come back and we'll rehear your case.
MR. NORBERTO HERNANDEZ: Thanks.
CHAIRMAN LEFEBVRE: Thank you very much.
MR. L'ESPERANCE: Mr. Chairman, I've got a question for
Michelle.
Michelle, when we have these stipulated agreements, are they
retyped with the changes that we've seen on the board?
MS. ARNOLD: No, ifthere's any changes that are made, they

should be stricken out and initialed by the individuals. If the changes
are being agreed to between the county and -- but we don't retype
them.
MR. L'ESPERANCE: Thank you.
MS. ARNOLD: With regards to your monitoring problems, if
you want to take a short break, they said that they can fix it for us.
CHAIRMAN LEFEBVRE: Okay. I'll take a --
MS. ARNOLD: Five minutes?
CHAIRMAN LEFEBVRE: Till 9:30?
MS. ARNOLD: Okay.
CHAIRMAN LEFEBVRE: We're going to recess until 9:30.

CHAIRMAN LEFEBVRE: I'll call the meeting back to order.
And the respondents for Hernandez's, I don't see them back in
here, so we're going to move on to BCC versus Monterey Master
Owners Association.
And are we able to combine all these?
MS. RAWSON: Yes, I think so. We have to have three different
orders, so you need to vote on your findings and your conclusions of
law and order, you know, three different times. But you can hear all
the evidence at the same time.
CHAIRMAN LEFEBVRE: Okay, very good.
(Speakers were duly sworn.)
MS. WALDRON: This is in reference to Case No. 2007010111,
violation of prohibited exotics present throughout the designated
preserve area.
We have come to a stipulation agreement with Monterey Master
Homeowners Association. They have agreed to pay the operational
costs in the amount of329.35 incurred in the prosecution of this case
within 30 days of this hearing.
The respondent must remove all Category 1 exotics from all
preserve areas, following the standards set forth in 3.05.07(H)(1)(g)(2)

within 180 days of this hearing or a daily penalty of $100 will be
imposed as long as the violation persists -- per day, as long as the
violation persists.
All exotics within the first 75 feet of the outer edge of every
preserve shall be physically removed or the tree cut down to grade and
the stump treated.
Exotics within the interior of the preserve may be approved to be
treated and placed if it is determined that physical removal might
cause more damage to native vegetation in the preserve.
When prohibited exotic vegetation is removed, but the base of
the vegetation remains, the base shall be treated with a u.s.
Environmental Protection Agency approved herbicide, and a visual
tracer dye shall be applied.
All preserves are to be free of prohibited exotic vegetation in
perpetuity.
Preserve maintenance plan must be submitted in accordance
with 3.05.07(H)(1)(g)(i-v).
Control of exotics will be conducted on a yearly basis or more
frequently, when required.
They must obtain any necessary Collier County or state permits
for the removal of vegetation.
CHAIRMAN LEFEBVRE: And then number three?
MS. WALDRON: Oh, I'm sorry. Respondent must notify code
enforcement that the violation has been abated and request the
investigator to come out and perform a site inspection.
CHAIRMAN LEFEBVRE: And just if I could have -- before the
respondent leaves, if you could add in there per day, a fine of $100
will be imposed per day, so that's clear.
MR. L'ESPERANCE: Mr. Chairman, it does state daily penalty.
MR. KRAENBRING: Daily penalty.
CHAIRMAN LEFEBVRE: Okay, daily. Okay, thank you. Very
good.

Are there any questions?
MR. PONTE: Yes, I have one.
The period of 180 days is a half a year. Why are we giving the
respondent a half a year to correct the violation?
MS. WALDRON: Well, they have three preserve areas in their
community, which is a pretty large area that they have to remove. So
I'm giving them 180 days for each area, to take care of the all the
cases. They do have budget constraint issues also, being as it is an
association that needs to pay for all the costs for removing these
exotics.
MR. PONTE: I understand that. However, I'm not particularly
comfortable with it. This has been going on since 2006. That was a
year and a half ago when we started this.
MS. WALDRON: Sandra did explain to me that they had been
in contract with someone and the person they were they were in
contract with was not doing what they told that they were going to do.
So they have tried to do it but have hired people that just haven't
followed through.
MR. PONTE: And my other feeling that I'd like to discuss, I just
don't think $100 a day penalty quite fits the violation. I think it ought
to be more like $200 a day. This has gone on for a year and a half. I
understand it's a large area, but it's a large association.
MS. WALDRON: $100 is standard what we use for our
department. So that's up to you if you --
MR. PONTE: Well, we just had one for $200, so that's not true.
MS. WALDRON: That was a different violation.
MR. PONTE: Yes, I understand.
MR. KRAENBRING: Is this stipulation agreement going to be
for all three cases?
MS. WALDRON: Yes, it's the same thing for each three.
MR. KRAENBRING: So we're not going to be rereading this.
MS. WALDRON: I would like to not do that.

MR. KRAENBRING: Good.
CHAIRMAN LEFEBVRE: Mr. Ponte --
MR. KRAENBRING: I'll just make a comment that I agree with
what the county is proposing here. I understand George's concerns, but
I don't think we're dealing with a health and safety issue here, per se,
it's just cleaning up these exotics. And we've got these three cases, and
I would -- you know, when a motion comes before, I'll make a motion.
CHAIRMAN LEFEBVRE: Any more comments from the
board?
MR. L'ESPERANCE: I would concur with your opinion to keep
it $100 and not change it to 200.
CHAIRMAN LEFEBVRE: Mr. Kelly?
MR. KELLY: My comment on the time would be if the
association would have to assess for the monies to pay for these plans,
it could be 30 days for the notice, another 30 days to file the
assessment, another 30 days to collect. So there's 90 days into it right
there before they can even get started. So I think the time frame is
probably okay.
MR. PONTE: But the association must have a budget for
plantings and landscaping and that sort of thing. So I would think it
would come out of the reserve. There shouldn't be a problem to have
to necessarily wait 90 days to get it started.
MS. WALDRON: In could make a comment on that. This is a
community that has not had their preserves taken care of in a very
long time, so there are a lot of exotics in their preserve areas, and it's
going to cost a lot of money to them to fix this problem.
CHAIRMAN LEFEBVRE: How much land are we talking
about? Just a rough estimate.
MS. WALDRON: Ten --
MS. HAGEDORN: About 10, 12 acres.

question, the permit had just expired. They did the remodeling without
the permit. He pulled the permit. It expired. And I've talked to him
how to reapply.
He's done all the inspections except for fire. So the county feels
in this case he's got fire.
I went and talked to the business owner yesterday, she assures
me work is going to start on Monday. I followed through with Mr.
Costello to make sure he's aware and understands, and they assure me
that it can be done in 45 days.
They could always come back and request for more time if it's
needed, but this is -- there's no business tax receipt there, and that's --
and there are children involved and that's why the time frame.

Description of violation: Failure to obtain permits for
improvements and alterations to the garage.

Date violation first observed: January 3rd, 2008.

Results of reinspection: Inspection revealed that owner did not
apply for a permit and violation remained.
At this time I would like to turn the case over to Code
Enforcement Investigator Renald Paul.
MR. PAUL: This case began on 1/4 of'08. I went to the property
with Investigator Morad, and we met with both property owners at the
site. And they allowed us inside of the garage, which was observed to
have been converted into a living space. And at that time they had
someone living in the inside of the garage.
As you see the pictures, they show the garage has been
converted. They've put in wood floors, added ceiling fans. They have
a bathroom inside of the home. It's just like a regular residence.
They have a main structure on the property, they have a
guesthouse and then they have this detached garage, which has also
been -- which has been converted into another dwelling.
I advised both owners that I would return after pulling the
information for the prior permits and showing them the permits for the
garage.
On 1/5, returned back to the property, met with both owners,

gave them a copy of the C.O. for the detached garage. And I explained
the NOV to them at that time, and Mr. Meszaros signed the NOV.
On 1/11 we had set up a meeting with the permitting department,
and they were explained that they could not keep the garage as is and
they had to convert it back to a detached garage.
On 2120, after research, found there was no permits pulled. I
called the folks at the two numbers that I had listed for them, left them
messages, but there were no call backs.
On 3/5, went to the property, knocked on the door, nobody was
home.
On 3/18, called the number that we had again, left a message but
no answer.
On 3/27, I spoke with Mr. Meszaros over the phone, explained
to him that his time almost up, and at that time he requested an
extension, even though he hadn't done any work or tried to obtain a
permit. He requested the extension. I spoke with my supervisor and he
said if he didn't have the permit by the due date, to take him before the
board.
I explained this to Mr. Meszaros, and he said that he understood
and he'd take care of it, but he didn't.
Prepped the case for the board and I posted the property on 4/21
of'08 and completed all affidavits. And there's the pictures there of the
posting.
And we're here today.
MR. L'ESPERANCE: Is this property still occupied by the
owners?
MR. PAUL: Well, the property itself is occupied by the owners.
I don't know if the tenants are still in there. I've been unable to get
ahold of the owners. They're never home when I go there.

MR. PAUL: That's just the policy that we have.

changing the policy. That seems long for this violation.

MR. KRAENBRING: George, I think what -- I don't know.
MR. PONTE: What we seem to be doing, Richard, is that we're
getting to let things kind of drift and drift and get very long in the
tooth. What we want to do is to get a correction as quickly as possible.
MR. KRAENBRING: But I think what we're finding is that just
the permitting process is taking that amount of time. That is really
beyond our control. But that just seems to be the facts these days.
CHAIRMAN LEFEBVRE: Am I correct that getting a
demolition permit is pretty -- relatively easy?
MR. PAUL: It is relatively easy. It's just going in and getting it
and then doing the work and getting the inspections.
CHAIRMAN LEFEBVRE: And this wouldn't be a stipulated
agreement, either, so --
MR. PAUL: No, this is not a stipulated -- this just happens to be
where I have it written up.
MR. PONTE: Is that an official position of the county that we
should be cognizant of, that issuing of permits is now taking an
extremely long period of time?
MS. ARNOLD: The 120 days is just a guideline that we've used
for a lot of building permit related cases, just because of the -- you
know, we're giving folks time, depending on if they submit something
that needs revisions, to do that, and then time to do the work.
In this particular case, if you feel that -- because a demo permit

is not one of those that should take that long. You're telling them
you're going to be removing things. If you want to shorten the time,
that's the board's prerogative to do that and we wouldn't have any
objections to doing that.
MR. PONTE: I'd recommend that we cut it to two months, 60
days.

MR. KRAENBRING: My sense of it is that the 120 days does
allow for obtaining the permits, you know, having these people get the
funds together.
We're not looking at this being permitted. My understanding is
there's no way that they're going to be able to get this thing permitted.
It's really just a demolition issue.
So I would recommend that we stay with the recommendation of
the county.
MR. PONTE: Well, if it's just a demolition issue, there's no
problem with making the time shorter.
MR. KRAENBRING: Well, but it's a matter of completing the
work. And again, if these folks haven't been responding, it's possibly
because of financial issues. So we're going to just wind up putting this
at 60 days and rehearing it in 60 days and then having to give them an
extension. So just from a housekeeping standpoint I think the 120 days

MR. KEEGAN: Good morning. For the record, Thomas Keegan,
Collier County Code Enforcement Investigator.
This case opened up as a complaint. On November 2nd I
observed a failed seawall on property. I called the owner on a number
that we had listed. There was no answer, no answering machine. I took
my photos, and I sent the Notice of Violation by certified mail.
On November 14th, 2007 the NOV -- I checked the NOV. It was
delivered. It was confirmed by the United States Postal Service
website. I called the owner again. No answering machine, no answer
on the phone.
On November 20th, 2007 I received a call from Randy Luedtke

to set up a meeting. We had a meeting at the code enforcement
department.
Mr. Luedtke had an estimate from Naples Marine about the dock
for $93,000 to do the work. So right off the bat the department knew
and Mr. Luedtke knew that this would be a time case where we
weren't pressing on time.
On January 2nd, 2008 I was on-site. The safety fence was
installed. Mr. Luedtke did promise me that he was going to install a
safety fence around so no one could access it. That was installed.
On the 16th I checked, there was no permits on file.
On the 17th I received a call from Randy. He was still getting
quotes from contractors that the -- some didn't call him back, some
did. Some of the prices were just outrageous, that he couldn't afford
them.
On March 21 st I checked CD Plus; there were no permits
applied for.
And on April 25th I received contact from Mr. Luedtke. He
agreed with Dock Savers to do the work. He signed -- he got an
estimate, he signed an agreement with them. He could explain that
more.
It just so happened the day before I received contact from him is
when I prepared this case for Code Enforcement Board.
And we're here to -- I checked today, there were still no permits
in the system. And the violation does still remain.

MR. KEEGAN: It collapsed, pretty much. There you go.
MR. PONTE: And they wanted $96,000 to replace this?
MR. LUEDTKE: Yes, 47 feet of seawall. And that's why I got
my first estimate prior to -- it was on October 8th. So I was already
working on it. I was aware of it.
And I made several calls to different contractors and they all
promised me they had it. In fact, some of them said didn't you get it?
And I didn't have an e-mail address and they said they sent me the
contract on e-mail. So it's like -- or the proposal.
So I've had a hard time to get it, but we finally agreed with Dock
Savers that they're going to do it. And we just signed a proposal. And I
give them money down so we're on top of it. Just like he said, that it
was just the day before.

But I've been working as fast as I could. Nobody would -- you
know, the 96,000 for 47 feet is a little bit much when the going rates I
was told was $300 a foot, somewhere in that area, depending on -- so
anyhow, we do have a signed proposal and I have money down on it.
And they're in the process of pulling the permits now.

the amount of291.14 incurred in the prosecution of this case within 30
days of this hearing and abate all violations by: Applying for all
required Collier County permits; obtain all required inspections,
through to issuance of certificate of completion within 120 days of this
hearing or a fine of $200 per day will be imposed until the violation is
abated.
The respondent must notify the code enforcement investigator
when the violation has been abated in order to conduct a final

MR. KRAENBRING: Just as a -- to reiterate what Mr. Kelly had

any idea how long it would take from now till when it's completed?

idea how long it will take to get permits? I mean, if that's what they do
for business, they should know how long it takes in a relative amount
of time.
MR. LUEDTKE: Well, he's expecting they'll get them in a
relatively short period here, as far as I'm aware.
MR. PONTE: I'd like to ask the county a question.
Given the testimony we've heard in other cases about the length
of time to obtain permits, why would these permits come through so
quickly?
MS. ARNOLD: They're different types of permits. Building

permits that require plans and those types of things may require
additional reviews.
I didn't hear what the time --
MR. KEEGAN: 120.
MS. ARNOLD: 120 days?
MR. PONTE: Well, 120 is fine. But we're just hearing testimony
that the contractor didn't know how long it was going to take to get the
permits. What we're trying to -- what I'm trying to determine in my
mind is how long it will really take. 120 days seems realistic to me,
but given the testimony that we had in other cases about the slowdown
and the issuing of permits of whatever kind -- it wasn't defined as to
what permits were getting a slow treatment and which were going
through fast except for a demolition permit.
But in any event, I just need a feel as to what is happening in
terms of the issuance of permits so that I can make a judgment as to
how long a proper time is. 120 seems fine, if the permits are coming
out fast.
MS. ARNOLD: Well, I think that's what we're recommending,
120 days, because we don't really know. Ifhe's having difficulty going
through that permit process, he has the ability to come back to this
board and say this is what's happening and this is why it's happening,
and it's taking me that much longer, can I have additional time.
I think we've been using 120 days as kind of a standard, because
it may be less, it may take a little bit longer. I can't tell you, you know,
why things are taking longer and why things sometimes are going
quicker.
MR. KRAENBRING: It seems to me that there's three
applications that have to be approved here. One would be for the
permit, the second one would be for this grant process. And then I
don't know if we're dealing with Army Corps of Engineers,
considering it's a waterfront property. So that could muddy the waters
some.

MR. PONTE: It could take it much longer.
MR. KRAENBRING: Mr. Kelly, have you ever thought about
the time?
MR. KELLY: I have two points that I'd like to make that would
leave me to be comfortable with extending the time period -- three
points, actually.
One, the respondent's been proactive and diligent. Two, there is
a security safety barrier fence installed. And three, the fact that we are
running into -- or could run into a lot of these obstacles. I would prefer
grant the time to somebody who's willing to work with us now
up- front and not have to come back in front of us or worry about
reducing or abating fines later.
MR. KRAENBRING: 180?
MR. KELL Y: At least, yeah, 180's a good start.
MR. KRAENBRING: That was my thought, that maybe that
extra 60 days would just prevent him from coming back in front of us
and affording the opportunity to get it done.

be taken down, the dock and the seawall and the lift.

potentially explain why you went over. And then we could reconsider

the price of the first one.
And I did have it -- October 8th is from Naples Dock is -- it was
in September. So I was already on top of it before --

Weare at this time requesting fines in the amount of $64,000 for
the time period between April 25th, 2007 and February 29th, 2008,
330 days at a rate of $200 per day, be imposed. And that was for
failure to obtain a wetland determination.
They do have that wetland determination now.

And we are also requesting an additional $3,800 be imposed for
the period between March 30th, 2008 through April 18th, 2008 at a
rate of $200 per day for failure to obtain a vegetation removal permit.
And an additional $600 between the time period of April 15th, 2008

fence permit.
There's additional operational costs in the amount of $428.56
which already has been paid. So the total amount that we're requesting
at this time is $68,400.

MS. RAWSON: There's not a time limit. And if you grant them
a reduction, the reduced fine must be paid within 30 days.

heard on February 23rd, 2007. The order is attached for your review.
In this case we are asking for fines in the amount of 77,800 for the
time period between March 26th, 2007 and April 18th, 2008 at a rate
of $200 per day for failure to submit a mitigation plan. The fines
continue to accrue on that violation.
And the operational costs in the amount of $442.22 has been
paid. So the amount we're requesting imposing today is $77,800.
And I need to kind of point something out here. In this particular
case the violation is on another property not owned by Mr. Brecher.
It's owned by the cemetery. And however, I believe that the order may
have put it on the cemetery's property. So we need to correct that and
impose this fine against Mr. Brecher, as opposed to the cemetery.
Because what occurred, and I don't know if you all recall, Mr.
Brecher encroached on that property and removed all the vegetation
on the cemetery's property. And he admitted to doing that. And he is
charged with mitigating on that particular property for the cemetery.
So the cemetery is not being held for this particular violation. I don't
know how we go about doing that.
MS. RAWSON: So this fine is not on this land?
MS. ARNOLD: No, it shouldn't be against the cemetery, it

should be against Mr. Brecher.
MS. RAWSON: Is the legal description that's attached here the
cemetery's legal description?
MS. ARNOLD: Yes. In the order it is.
MS. RAWSON: Okay. Well, you and I will talk about how to
fix this order so that it specifies that he's not the owner of the property.
MS. ARNOLD: Right.
MS. RAWSON: And it's only on this case, not the previous
case?
MS. ARNOLD: Yeah, just this case wall.

on someone else's property, but was committed by an individual
which we knew, so we filed it against the violator.
But I don't want to file this fine against the cemetery, so I just
want to make sure that we put that on the record that it's not -- it
shouldn't be, you know, something -- a cloud on that particular title.
MS. RAWSON: It's not a lien against that legal description--
MS. ARNOLD: Right.
MS. RAWSON: -- only as to Mr. Brecher.

land because it wasn't the owner's fault. We've done that before.

site development plan and everything has been completed -- or site
improvement plan has been completed?
MR. MORAD: Yes.
CHAIRMAN LEFEBVRE: So they're just -- they have all the
permits and everything.
MR. MORAD: Correct. It's just a matter of finalizing some
inspections.
CHAIRMAN LEFEBVRE: Okay. What is your time frame, do
you think, before you're finished with getting all the inspections?
MRS. HALL: I hope Mr. Ponte goes through with his concerns

on the slowness of permits and things. Because we do things and then
it has to be redrawn and -- it's just a nightmare. So I have no idea.
CHAIRMAN LEFEBVRE: Where are you -- the site
improvement plan or site development plan has been approved.
MRS. HALL: It took three years for it to be done, yes. And been
it's approved and we're in the process. We've torn down the building
that we were supposed to tear down. We created a new office trailer
like we were supposed to do. We put up ramps, handicapped ramps for
handicapped people that come to auto salvage. And we've done
everything we are supposed to be doing.
We still have things to do. We have run out of money. I took out
a $250,000 line of credit. It is gone. I have a $50,000 line of credit on
another piece of property. The bank informed me that I lost that
because the price has gone down of the property. So I'm now trying to
refinance something else.
So I have no idea how long it's going to take.
CHAIRMAN LEFEBVRE: Okay. Any questions from the

MR. KELLY: Not as much a question as a comment. Ifwe go
ahead and impose these liens against the property, they won't be able
to seek further financing.
CHAIRMAN LEFEBVRE: That's correct.
MR. KELL Y: And the original was a -- the original order was
really a stipulated agreement which we as the board changed from 90
days to 60, and then doubled the fines from 200 to 400. It's just a
sticky situation from here on out.
I'd prefer to see it tabled and brought back, but I don't think that's
going to work.

MR. PONTE: Well, let's discuss that. Why wouldn't it work? I
mean, I agree with you, I think that if we put a block and then prevent

department or talking with the health department on some
disagreements.
CHAIRMAN LEFEBVRE: Do you feel that they have been
diligent from the time that it was brought to their attention to now in
trying to correct the problem, with the circumstances that they're
facing?
MR. MORAD: Yes. It's been a major ongoing for them with site
development plan revisions and also the amount of permitting, the
types of permits that were needed.
Yes, they have been. And of course it's -- the contractor too,
staying on top of the contractor sometimes to get them motivated to do
some things.
CHAIRMAN LEFEBVRE: Maybe with the testimony just heard
it may be better to extend it out maybe to 120 days in considering Mr.
Hall will be going into the hospital and everything for major surgery.
And being that they have been as diligent as they have. I feel
personally that 120 days may be more fair for them to try to get some
of the work done. I'd just like to hear a motion.

CHAIRMAN LEFEBVRE: The next imposition of fines is BCC
versus Alfredo and Miradis Miralles. I'm not sure if I'm saying it right.
Probably not.
MS. ARNOLD: It's Miralles. And this was heard on October
25th, 2007. The order has been provided per your review.
Compliance has been -- they are in compliance?
MR. SANT AFEMIA: Yes.
MS. ARNOLD: Yeah, they have met compliance. However,
fines accrued between the time period of February 23rd, 2008 and
May 7th, 2008 at a rate of $200 per day for a total of$14,800.
Additionally, operational costs in the amount of $587.55 have
not been paid. So we are at this time requesting fines in the amount of
$15,387.55 be imposed.

CHAIRMAN LEFEBVRE: Go ahead.
MR. SANT AFEMIA: Good morning, gentlemen.
As stated at this time, the respondent is in compliance.
Reinspection was done of the property on May 7th of this year. He did

get the necessary permits and get the necessary inspections and
certificate of occupancies or completions that were required with those
permits. And any alterations or conversions that were done were put
back to their original permitted state. So at this time he is compliant.
CHAIRMAN LEFEBVRE: When did he comply?
MR. SANTAFEMIA: His permit was C.O.'d on the 6th of May.
My reinspection was on the 7th.
CHAIRMAN LEFEBVRE: But then it says the respondent has
complied with CEB orders as of the 25th of October, 2007.
MR. SANTAFEMIA: No, October 25th was when the hearing
was. That's the hearing date.
MS. ARNOLD: Yeah, that's not correct. They complied May
7th.
CHAIRMAN LEFEBVRE: Okay, that's what was -- if they did
comply on the 25th of October, then there wouldn't be any fine.
MR. KRAENBRING: So they complied May --
MR. SANT AFEMIA: Well, May 7th was my reinspection. The
affidavit of compliance I completed is dated for that date.
CHAIRMAN LEFEBVRE: Any other questions from the board?
MR. KELLY: I do.
CHAIRMAN LEFEBVRE: Go ahead.
MR. KELLY: Investigator, do you know of any holdups that
might have been related to permit issues or anything like that?
MR. SANTAFEMIA: No, not to my knowledge.
Mr. Miralles -- there's a language barrier and also some health
issues that he was dealing with, and some bad advice that he had
gotten from different people along the way.
He actually did manage to find somebody who was very
knowledgeable with the permits in county on how these things work,
and she was able to guide him through very quickly, actually, through
the process.

been before the board a couple oftimes now. And each time we've
been sort of predisposed to work with him.
So is the county looking to impose this fine or are we looking at
a reduction of this fine or do we have a --
MS. ARNOLD: We're looking to impose the fine.
MR. KRAENBRING: Looking to impose the fine.
CHAIRMAN LEFEBVRE: Make a motion?
MR. LARSEN: I move that we impose the fine as recommended
by the county.

respondent?
MR. KRAENBRING: Yeah, let's -- is he looking for a reduction
in fine here?
MR. L'ESPERANCE: Does the respondent wish to say

MR. VALDES: He said yes. About reduction of the fines, he is
looking for.

MR. VALDES: Because he has bad time at this moment.
MR. KRAENBRING: But he is in full compliance now, there's
no health or safety issues --
MR. SANT AFEMIA: Correct. Everything is in compliance at
this time.
MR. KRAENBRING: You know, without rehearing the case, it
just seems that I think that this gentleman has been before us a couple
of times. We've been working with him. I think he now corrected
these issues. So I'd like to maybe hear some thoughts from the board
about, you know, reducing the fine or abating it.
MR. PONTE: I would favor that. I think that the purpose of this
board is to obtain compliance and not to act as a collection agent for

the county. So I feel that they are in compliance and that the fines
should be substantially reduced or abated.
CHAIRMAN LEFEBVRE: Mr. Ponte, do you have an amount?
MR. PONTE: I'm sorry?
CHAIRMAN LEFEBVRE: Do you have an amount, Mr. Ponte?
MR. PONTE: I'd just like to hear from the board. What's the
thought of -- what are other members thinking of in terms of this idea?
MR. LARSEN: It's just a procedural question. It seems that it's
before us for the imposition of fines, not on the agenda for --
CHAIRMAN LEFEBVRE: Reduction.
MR. LARSEN: -- reduction or abatement of fines. Is there a
procedural problem with going forward this way?
CHAIRMAN LEFEBVRE: Jean?
MS. RAWSON: Not really. It's not uncommon for people--
respondents to come before you on the day they are going to get fined,
if they are in compliance, and say to you please reduce the fine. So
you can really do them both at the same time.
MR. KRAENBRING: I think -- again, just from, you know, my
recollection of the time that this gentleman's been before us and the
language barrier and the bad advice that he -- or the misguided advice,
whatever, that he's gotten, the fact that he is in compliance, and I think
he's been working with you pretty well? I mean, he's not been
belligerent or --
MR. SANTAFEMIA: Not as oflate. Mr. Miralles is a very
unique person. He's -- I think he's kind of gone through the school of
hard knocks way. I think he realizes now that he needs to start
following some correct direction from the county when it comes to
stuff like this.
He originally was not very cooperative at all. And I just -- I
know like he had 30 days to pay his op. costs from October, and I
don't believe those have been paid either.
As I said, he's gotten some bad advice from people along the

way. And I've tried to kind of put him back on track several times. But
he kind of gets off track a lot.
And he owns a lot of property in Immokalee, so a lot of the cases
you're referring to as having dealt with him before are on different
properties.
MR. KRAENBRING: Are there any other cases out there
pending?
MR. SANT AFEMIA: I'm not certain. I do not have any more
cases pending with Mr. Miralles, but I know other investigators have
had them in the past and may have them now, I don't know.
MR. KRAENBRING: The reason I asked that is again, I don't
want to mix cases because that would be improper.
Rather than maybe abating this completely, I think there maybe
should be some penalty to it, just to reinforce that the county is serious
and that ifhe does violate that, he's just not going to be able to come
in here and, you know, get a free ride. But I think that a reduction in
fine could possibly be proper.
MR. SANT AFEMIA: I don't know if this helps at all in your
thinking, but he was before this board in March, March 27th,
requesting more time, which you denied him at that point because he
hadn't done anything. So in that -- at that point in time I guess he
figured that you guys were serious and finally got things going.
MS. ARNOLD: I just want to note that he does have -- he had a
prior case before this board and the amount of 1,500 was imposed, and
it's been now forwarded to the county attorney's office for their
handling.
I think that this board has -- if you are inclined to reduce the
amount of the fine, put a time period on there for payment.
It has been suggested also by the county attorney's office that,
you know, if you do reduce it and it's not paid within that time, that
maybe you ought to put additional language in there that the fine goes
back, reverts back to the amount that it was before. You haven't done

that yet, but you've been kind enough to make modifications to your
fines and then no payments whatsoever. So maybe that's something
you ought to consider.
CHAIRMAN LEFEBVRE: Do I hear a motion?
MR. L'ESPERANCE: Mr. Chairman, I think we should inquire
as to the respondent as to what he thinks it should be reduced by, if
that's his frame of mind.
CHAIRMAN LEFEBVRE: What do you feel that it should be
reduced to?
MR. VALDES: Can you repeat the question?
CHAIRMAN LEFEBVRE: What do you feel that the fine
should be reduced to?
MR. VALDES: Let me ask him.
He said that he comply. Maybe a little bit late because health
condition, economical condition. But he comply with everything. And
the time is hard for him and his family.
He has too many health problem. Like for example, one month
ago --
CHAIRMAN LEFEBVRE: What does he want the fines reduced
to? Give us a dollar amount that he feels.
MR. VALDES: How much is the fine?
MS. ARNOLD: It's 15,387.55.
MR. VALDES: He asks for to be reduced to the 10 percent.
Because he cannot afford it.
MR. KRAENBRING: So he's looking at a fine of$1,480 plus
the operational costs.
MR. VALDES: Yes.
MR. KELLY: I'll make a motion. If you want me to give a stab

Okay, this case was heard by the board on February 28th, 2008,
and the order has been provided for your review. Due to
noncompliance, we are requesting fines at -- in the amount of $6,800
for the period between March 15th, 2008 through April 18th, 2008 at a
rate of $200 a day be imposed.
Additionally, $3,600 between the time period of March 31st,
2008 and April 18th, 2008 at a rate of $200 per day, and operational
costs in the amount of$398.10 for a total of$1O,798.10.
MR. KRAENBRING: Are we reading R.P.K. or are we reading
Jose?
MS. ARNOLD: Jose.
MR. KRAENBRING: Okay, thank you. My fault. Thank you.
MS. ARNOLD: We withdrew that one.

morning. That is the first contact that he has had with me about this

everything that he needs to do to get his property into compliance.

for this?
MS. WALDRON: There was no reason for him to stay. He was
not arguing the point that he was opposing the fines, because he didn't
-- he hasn't complied. He does want to comply now, but he does know
that it is a serious issue now.

On Saturday, March 29 from 8:00-11:00 a.m. in the Town Center,
UPCOMING Veronawalk ran a pancake breakfast fundraiser for Angel Flight Southeast.
For those of you who do not already know, Angel Flight Southeast
EV 1:N T S coordinates free air transportation for children and adults with medical
MAY or compelling humanitarian needs. The ticket sales for this event were
above and beyond what we had imagined! Around 300 tickets were sold

to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies under Sec. 163.356 or
163.357, F.S., and officers of independent special tax districts elected on a one-acre, one-vote basis are not prohibited from voting in that
capacity.
For purposes of this law, a "relative" includes only the officer's father, mother, son, daughter, husband, wife, brother, sister,father-in-law,
mother-in-law, son-in-law, and daughter-in-law. A "business associate" means any person or entity engaged in or carrying on a business
enterprise with the officer as a partner,joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation
are not listed on any national or regional stock exchange).
ELECTED OFFICERS:
