RESOLUTION 97-I'J
A RES0LUTION PROVIDING FOR THE ESTABLISHMENT
OF A RESIDENTIAL UNIT, CONDITIONAL USE "7"
IN THE C-3 ZONING DISTRICT PURSUANT TO
SECTION 2.2.14.3 OF THE COLLIER COUNTY LAND
DEVELOPMENT CODE FOR PROPERTY LOCATED IN
SECTION 28, TOWNSHIP 48 SOUTH, RANGE 25
EAST, COLLIER COUNTY, FLORIDA.
iI.'HEREAS, the Legislature of the State of Florida in Chapter
67-12~ 6, La.....s of Florida, and Chapter 125, Florida Statutes, has
confeJ"red on Collier County the power to establish, coordinate and
enforce zoning and such business regulations as are necessary for the
proter:tion of the public: and
ImEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which includes a
Compr.!hensive Zoning Ordinance establishing regulations for the
zonin'J of particular geographic divisions of the County, among which
is th= granting of Conditional Uses; and
#HEREAS, the Collier County Planning Commission, being the duly
appointed and constituted planning board for the area hereby
affected, has held a public hearing after notice as in said
regulations made and provided, and has considered the advisability of
Conditional Use "7H of Section 2.2.14.3 in a C-3 zone for a
residential unit on the property heLeinafter described, and has found
as a matter of fact (Exhibit HA") that satisfactory provision and
arrangement have been made concerning all applicable matters required
by said regulations and in accordance with Subsection 2.7.4.4 of the
Land Development Code for the Collier County Planning Commission: and
WHEREAS, all interested parties have been given opportunity to
be heard by this Board in a public meeting assembled and the Board
havi~g considered all matters presented.
NOW, THEREFOrE BE IT RESOLVED, BY THE BOARD OF ZONING APPEALS of
Collier County, Florida that:

The petition filed by Mark Lamoureux, P.E. representing Hike
Podolski with respect to the property hereinafter described as:
Lots 1 thru 5, and 47 thru 50, Block 6~ of Naples Park,
Unit No. S, as recorded in Plat Book 3, Page 14, of the
Public Records of Collier County, Florida.
be 3nd the same is hereby approved for Conditional Use "7" of Section
2.2.14.3 of the (-3 zoning district for a residential unit in
acc)rdance with the Conceptual Master Plan (Exhibit "8") and subject
to the following conditions:
a. The Planning and Technical Services Manager may approve
minor changes in the location, siting, or height of
buildings, structures, and improvements authorized by
the conditional use. Expansion of the uses identified
and approved within this conditional use application,
or major changes to the site plan submitted as part of
this application, shall require the submittal of a new
conditional use application, and shall comply with all
applicable County ordinances in effect at the time of
submittal, including Division 3.], Site Development
Plan Review and approval, of the Collier County Land
Development Code (Ordinance No. 91-102).
b. Road Impact Fees for each use, shall be paid in
accordar.ce with Ordinance 92-22, as amended, and shall
be paid at the time building permits are issued unless
otherw~se approved by the Board of County Commissioners.
BE IT FlJRTHER RESOLVED that this Re.solution be recorded in
the mintltes of this Board.
