A RESOLUTION BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AUTHORIZING THE ACQUISITION BY GIFT, PURCHASE
OR CONDEMNATION OF TEMPORARY EASEMENTS ON
THREE PROPOSED SITES AND THE INGRESS/EGRESS
TEMPORARY EASEMENT TO ONE SITE TO PERFORM
WALK-THROUGH SURVEYS, FIELD SURVEY ELEVATIONS,
SOIL BORINGS AND GROUND PENETRATING RADAR
TRANSECTS AND OTHER ON-SITE INVESTIGATIVE DATA
ON THE THREE PROPOSED LANDFILL AND MATERIALS
RECOVERY FACILITY SITES.
WHEREAS, the Board of County Commissioners adopted Ordinance
No. 89-5, and on May 25, 1993, and adopted Collier County
Ordinance No. 93-24, amending Ordinance No. 89-5 by amending the
Public Facilities Element, Solid Waste Subelement of the Collier
County Growth Management Plan which sets forth the investigation
of new expansion locations and the policy for the design of the
new solid waste landfill; and
WHEREAS, the Board of County Commissioners on May 16, 1995,
adopted ReSOlution No. 95-333 creating the Collier County Landfill
Citizens Advisory Committee to develop criteria to review various
locations within Collier County and make recommendations to the
Board of County Commissioners as to the recommended locations/
sites for the proposed new landfill and materials recovery
facility site; and
WHEREAS, the Board of County Commissioners on June 20, 1995
entered into a Professional Services Agreement with Dufresne-
Henry, Inc. for professional engineering services concerning
certain design services for Site Assessments for a Landfill
Disposal and Materials Recovery Facility, as the County's
Engineering Consultants; and
WHEREAS, the County's Engineering Consultants and the Collier
County Landfill Citizens Advisory Committee have reviewed various
locations in Collier County and have recommended three (3)
proposed locations/sites for the new landfill and materials
recovery facility site as being preferable among the many sites
studied and evaluated; and

WHEREAS, it is necessary for the County Staff and the
County's Engineering Consultants to obtain an on-site assessment
of ecological resources, observations of existing surface water
management systems, survey data and other information to document
adjacent land uses, survey data for permitted on-site water wells,
field survey elevations of water control structures, soil boring
data, ground penetrating radar transects, and other related
on-site investigative information in order to make final
professional recommendations as to the best suitable location(s)
for the ne~ landfill and materials recovery facility site.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Board
determines that the three (3) temporary easements identified
herein as sites A, Land U, and the ingress/egress temporary
easement to site U are necessary for the public purpose of
protecting the health, safety and welfare of the citizens of
Collier County.
BE IT FURTHER RESOLVED that the Board herein determines that
temporary easements for duration of 30 day periods respectively on
each of the three (3) proposed locations are reasonably necessary
and required to obtain data and information required for it to
make a final determination and properly informed decision as to
the most suitable location for the new landfill and materials
recovery facility site.
AND IT IS FURTHER RESOLVED that the Board has considered
alternative sites' availability factors, long range planning
factors, aesthetic factors, environmental factors, safety factors
and cost factors relating to a new landfill and materials recovery
facility site and the three (3) presently recommended proposed
locations. Having considered these factors, the Board has
determined the interests that need 'to be acquired are temporary
easements for a 30 day period on each of the three (3) proposed
locations identified as Site A, Site L and site U, as described

herein, plus the ingress/egress temporary easement to Site U, also
described herein, and said easements are reasonably necessary and
in the best interest of Collier County.
AND IT IS FURTHER RESOLVED that the selection process for a
new landfill and materials recovery facility 10cationCs) is in
accordance with the County's long range planning goals and
objectives of the Growth Management Plan for Collier County. The
Board has reviewed Sites A, Land U for safety considerations,
cost factors relating to the economic feasibility, alternative
locations, environmental factors affecting the surrounding areas
and the permitability as a landfill for these locations. Based
upon these reviews the Board has determined that Sites A, Land U
are the best proposed locations to further do investigative work
for the possible siteCs) of the new landfill and materials
recovery facility.
AND IT IS FURTHER RESOLVED that the acquisition of these
three (3) temporary easements on sites A, Land U to obtain data
and information for the selection of the best suitable location of
the new landfill and materials recovery facility site is
consistent with the County Growth Management Plan.
AND IT IS FURTHER RESOLVED that the County Staff and
the County's contracted professionals are hereby authorized and
directed to acquire by gift, purchase or condemnation in
accordance with the provisions of Chapters 73, 74 and 127, Florida
Statutes, said temporary easements plus the ingress/egress
temporary easement for a 30 day period respectively, over the
following described parcels:
Temporary Easement for Site A described as the Eastern half
of Section 1, Township 46 South, Range 28 East; all land
lying north Of S.R. 82 in the northeast quarter of Section
12, Township 46 South, Range 28 East; all of Section 6,
Township 46 South, Range 29 East; and all land lying north of
S.R. 82 right-of-way in Section 7, Township 46 South, Range
29 East, Collier County, Florida, and
Temporary Easement for Site L described as the Eastern half
Of Section 18, TownShip 48 South, Range 29 East; all of
Section 17, Township 48 South, Range 29 East; and the western
1/4 of Section 16, Township 48 South, R~nge 29 East, Collier

Temporary Easement for Site U described as all of Sections 10
and 15, Township 51 South, Range 27 East, Collier County,
Florida, and
The ingress/egress temporary easement to site U described in
Exhibit "A" attached hereto and incorporated here.
AND IT IS FURTHER RESOLVED that the Temporary Easements over
and across sites A, Land U are to be for the limited purposes of:
a) obtaining an on-site assessment of ecological resources;
b) observing existing surface water management systems;
c) collecting field survey data and other information to
document adjacent land uses;
d) collecting field survey data on permitted on-site water
wells;
e) collecting field survey elevation data of water control
structures;
f) performing soil borings; and
g) performing ground penetrating radar transacts.
BE IT FURTHER RESOLVED that no mobile homes are located on
the property interests sought to be acquired and therefore it will
not be necessary to remove any mobile homes from the property or
relocate any mobile homes from the property where the temporary
easements are to be acquired.
