Resolution 1996-505 NOV 1 2 1996 RESOLUTION NO. 96-505 A RESOLUTION AMENDING EXHIBIT "0" OF RESOLUTION 96-27, A COlmTTIONAL USE FOR PROPERTY PROPERTY DESCRIBED AS TRACT 97, UNIT 4, GOLDEN GATE ESTATES IN COLLIER COUNTY, FLORIDA, TO CORRECT A SCRIVENER'S ERROR IN STIPULATION b. OF THE AGREEMENT SHEET. WHEREAS, the Collier County Board of County Commissioners adopted Resolution 96-27, pertaining to conditional uses for the establishment of a church and child care facility on January 23, 1996, and WHEREAS, following said action adopting Resolution 96-27, staff was advised that a condition of approval added to Stipulation b. had been omitted from ~Xhibit constitutes a scri~ener's 110" of said Resolution by mistake and error. NOW, THEREFORE BE IT RESOLVED, by the Board of County commissioners of Collier County, Florida, that Stipulation b. of Exhibit "0" of Resolution 96-27, is hereby amended by adding the corrected stipulation to read as follows: b. That the ch~rch facility be made available for use as a poll site by the Supervisor of Elections. The church shall also be in ooeration Drier to or concurrent with the day care facility. Hoover, as owner or authorized CU-95-16, agree to the following stipulations Collier county Planning commission in their public 4, 1996. The Planning & Technical Services Manager may approve minor changes in the location, siting, or height of buildings, structures, and improvements authorized by the conditional use. Expansion of the uses identified and approved within this conditional use application, or minor changes to the site plan submitted as part of this application, shall require the submittal of a new conditional use application, and shall comply with all applicable County ordinances in effect at the time of submittal, including Division 3.3, site Development Plan Review and approval, of the Collier County Land Development Code (Ordinance No. 91-102). b. That the church facility be made available for use as a poll site by the Supervisor of Elections. The church shall also be operational Drior to or concurrent with the day care facility. In addition. the church and day care shall be under the same ownership. c. An exotic vegetation removal, monitoring, and maintenance (exotic-free) plan for the site shall be submitted to Planning & Technical Services Environmental Review Staff for review and approval prior to final site plan/construction plan approval. d. An eastbound right-turn lane shall be required as a condition of issuance of a Certificate of occupancy or Compliance for Phase I. e. A westbound left turn lane shall be required under the two-lane condition should the County, in its sole opinion, determine that operational or safety requirements require it. Such turn lane, if required, shall be in place prior to the issuance of any permit for Phase II. f. Under the four-lane condition, the County reserves the right to determine the need for and the desirability of a median opening to serve this development. If such median opening is deemed necessary or desirable, the entire cost of providing the median opening shall be borne by the benefiting property owner(s). There shall be no right to any such turn lane vested in this development under any development order arising out of EXHIBIT "0" J V' NOV 1 2 1996 any conditional use, rezone or building permit granted to the property owner. 9- The project shall be developed in two phases. The first phase limits the church to 6,250 square feet and the day care facility to 2,600 square feet. The second phase or buildout limits the church to 10,000 square feet and the child care to 3,700 square feet. The second phase can not be initiated until Golden Gate Boulevard is 4 laned fronting the project.
