Resolution 1996-483 OCT 22 1996 RESOLUTION NO. 96- 483 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COL~TY DETERMINING THAT REVISIONS TO THE REGENCY VILLAGE OF NAPLES DEVELOPMENT ORDER 90-1 AS AMENDED DO NOT CONSTITUTE A SUBSTANTIAL DEVIATION REQUIRING FURTHER DEVELOPMENT OF REGIONAL IMPACT REVIEW. WHEREAS, the Board of County Commissioners of Collier County, Florida, approved Development Order 90-1 (the Development Order) on February 13, 1990, which approved a Development of Regional Impact (DRI) known as Regency Village of Naples; and WHEREAS, Section 380.06(19) (f)2, Florida statutes. requires that proposed changes to a previously approved Development of Regional Impact (DRI) be submitted by the developer to the local government, the regional planning council, and the state land planning agency; and WHEREAS, submittal of the proposed changes was made to the appropriate public authorities; and WHEREAS, section 380.06(19) (f)5, Florida St.atutes, requires that the local government shall determine whether or not the proposed change to the previously approved DRI development order constitutes a substantial deviation requiring further Development-of-Regional-Impact review; and WHEREAS, by separate action the Board of County Commissioners will cause Regency Village of Naples PUD Development Order to be amended to reflect the proposed revisions which do not constitute a substantial deviation requiring further Development-of-Regional-Impact review; NOW, THEREFORE, be it resolved by the Board of County commissioners of Collier County, Florida that: The proposed revisions to Regency Village of Naples Development Order 90-1, as amended, as described in Petition DOA-96-2, noted as Exhibit IIA'I and hereto made a part of this Resolution do not constitute a substantial deviation requiring further Development of Regional Impact review. -1- " , " '. , OCT 2 2 199" BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this Board. commissioner Hancock offered the foregoing Resolution and moved for its adoption, seconded by Commissioner Constantine and upon roll call, the vote was: AYES: Commissioner Hancock, Commissioner Constantine, Commissioner Mac'Kie, Commissioner Matthews, and Commissioner Norris NAYS: ABSENT AND NOT VOTING: ABSTENTION: Done this 22nd , 1996.
