A RESOLUTION REQUESTING FLORIDA DEPARTMENT OF
TRANSPORTATION AUTHORIZATION FOR LAND-SCAPE
IMPROVEMENTS ON S.R. 951 AT THE MARCO RIVER
BRIDGE (JUDGE JOLLY BRIDGE), CONFIRMING COLLIER
COUNTY COMMITMENTS FOR LANDSCAPE MAINTENANCE!
RELOCATION FOR FUTURE ROAD CONSTRUCTION,
AUTHORIZING THE CHAIRMAN OF THE BOARD OF
COUNTY COMMISSIONERS TO EXECUTE A LANDSCAPING
INSTALLATION AND MAINTENANCE AGREEMENT WITH
THE FLORIDA DEPARTMENT OF TRANSPORTATION, AND
AUTHORIZING THE COUNTY ADMINISTRATOR AND HIS
STAFF TO EXECUTE LANDSCAPE PERMITS.
WHEREAS, lI1e Floride Department of Transportation (FOOT) Is the
operating/malnlenanca/permllting eull10rity for S.R. 951 to Include lI1at portion of roadway on the
soull1 side of lI1e Maroc River Bridge (Judge Jolly Bridge); and
WHEREAS. the FOOT has Issued a permit 10 Collier County for the landscaping, both
Installalion and maintenance, for S.R. 951 between lI1e Marco River Bridge (Judge Jolly Bridge)
Bnd C.R. 92 (Reference FOOT Permit No. S61-61 dated November 13,1961); and
WHEREAS, the FOOT and Col11er County are desirous of beautifying State roadways
through the proper application and maintenance of landscape materials; and
WHEREAS, Collier County has recaived B State Grant for the expansion of landscaping

within the permitted segment of S.R. 951 (Reference State Department of Agriculture Grant
Contract #3232 in lI1e amount of $6,930.00) Bnd lI1e Gnant requires lI1e work to be performed by
September 30, 1996; Bnd
WHEREAS, Collier, County Is desirous of taking advantage of lI1e State Grant and
performing the landscape improvements as soon as possible In consideration of available unit
prices for landscape materials and favorable site conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, lI1at the FOOT accept lI1e following
conditions In performance of immediate landscape improvements by Comer County:
1. As the existing Permittee, Collier County, assumes the responsIbility and cost for landscape
Installation, maintenance, relocation, and removal as so directed by the FOOT for road
construction and maintenance purposes.
2. Acceptance of the landscape plans as prepared by McGee and Associates, Inc. and as
reviewed and approved by FOOT staff (Reference McGee & Associates S.R. 951 Landscape
Plan Sheet Nos. L-1, L-2 and T-3).
3. The existing Permittee, Collier County, shall be responsible for the notification of all applicable
utilities and to coordinate utility relocation as necessary.

4. The Co111er County Metropolitan PlannIng Organization (MPO) In approving the FDOT 5-Year
Work Plan (FY 1995-96 - FY 1999-00), and the Board of County Commissioners in approving
the Marco Island Master Plan have identified no major construction or reconstruction in the
areas for landscaping during the above-referencad FOOT 5-Year Adopted Road Plan period
will1 the excaptlon of planninQ and road design activities associated with State Project Nos.

5. To Implement the landscape Improvements, the Board of County Commissioners hereby
authorizes the Chairman of the Board of County Commissioners to execute the State of
Florida Department of Transportalion Highway Landscaping Installation and Malntenancs
Agreement. The Board of County CommissIoners hereby further authorizes the County
Administrator and h!s staff to execute necessary Landscape Permits and After-the-Fact
Permits.
6. To coordinate lI1e landscape Improvements, a copy of II1ls Resolution shall be provided to lI1e
FOOT District One Secretary, lI1e FOOT District One Landscape Manager, and oll1er persons
as directed by lI1e County Administrator.
