WHEREAS, the Legislature ot the State ot Florida in Chapter 125,
Florida Statutes, ha. conferred on all counties in Florida the power to
establish, coordinate and enforce zoning and such business regulations as
are necessary for th~ protection of the publiCI and
WHEREAS, th~ County pursuant thereto has adopted a Land Development
Code (Ordinance !lo, 91-102) which establishes regulations for the zoning
of particular geographic divisions ot the County, among which is the
qranting of variances; and
WHEREAS. the Beard of Zoning Appeal., being the duly elected
constituted Board of the area hereby affected, has held a public hearing
after notice as in said r~qulation. made and provided, and has considered
the ad'li.ability of a 46.5-foot after-the-tact variance from the required
rear setback of 15 feet to 28.5 feet e. shown on the atteched plot plan,
Exhibit "A", in an "EN Estate. Zone for t~e property hereinaf~er

described, and has found as e matter of fact that satisfectory provision
and arrange~ent have been made concerning all appli~able mat,ters required
by said regulacio~s and in accordance with Section 2,1.5 of the Zoning
Regulations of said Land ~velopment Code tor the unincorporated area of
Collier County; and
WHEREAS. all Interested parties have been given opportunity to be
heard by this Board in public meeting aseembled, and the Board having
