A RESOLUTION REIOkTING TO THE ~[EDITEP. RA SOUTH CO~4MI/NITY
DEVELOP~fENT DISTRICT BY CONSENTING TO THE DISTRICT'S
EXERCISE OF SPECIAL POWERS RELATING TO PARKS AND
RECREATION AND SECURITY.
WHEP. EAS, the I-hzditerra South Community Develo[:ment_ District
was established on September 14, 1999, by Ordinance I.~o. 90-67 which
became ef~= ~i';e September 16, 1999; and
WHEREAS, the Board of Supervisors of the ~editerra South
Co.7%~u n i t y Development District ("District") has requested the
consent of Collier County to exercise certain additional special
powers pursuant to Section ]90.012(2), Florida Statutes; and
WHEREAS, the District's Board of [;uper'visors har~ r,~quested
that Collier County consent to l. ho exercir~ o~ s[~eci.]l pow~rs
relating to parks and recreation ~nrt s~3curit:y; and
~E~AS, Collier County has reviewed the District Boz~rd of
Supervisors' re{luest.
NOW, THE~FO~, BE IT ~SOL~D BY THE BO~ OF CO~TY
CO~ISSIONERS OF COLLIER CO~TY, FLORIDA, that:
SECTION ONE: The ~.~editerra South Co~r~rnunlty Devel<>pmont fOi:~t: iCL is
governed by the provisions of Chapter 190, ~']orJda St.~t%~tes.
Additional] iV, the Bo;~rd of County Commissior~ers ~,f C~:11ier
County, Florida, hereby consents to the Board of Supervisors of the
Mediterra South Community Deve]opment District exercising the
following special powers in accordance with Section 190.0i2(2),
Florida Statutes, to plan, establish, acq~ire, construct or
reconstruct, enlarge or extend, e,quip, ~>pe r.]te ~3~nd maintain
additional syst~ms ar:d ~ar:ilitien for:
[~arks and facilities for indoor ~r:d outdoor
recreational, cultural and educational uses.
Security, including, but not limited to,
guardhouses, fences and gates, electronic intrusion detection
.systems, ,]nd patrol cars, when authorized ~y proper
governmental agencies; ezcept t~at the District may not
ezercise any 7ol ic,~ ['~owe:, but may <:ontract with the
increased level of such services wit bin the District
boundaries.
Consent to exercise the above powers by the ~oard of County
Commissioners in no way implies that Collier County has any
obligation or responsibility to ensure that these special powers
are exercised by the District nor any li~]bility in regalds to the
District's exercise of these special powers.
SECTION TWO: EFFECTIVE DATE
This Resolution shall become effective upon affirmative vote
of a majority of the County Commission at a duly r~oticed public
hearing.
