FOR OFF-SITE PARKING ON PROPERTY
HEREINAFTER DESCRIlJED IN COLLIER
COUNTY, FLORIDA
WHEREAS, the Leg;,lature ot"the Stale of Florida in Chapter 125, Florida Statute" ha,
ctmCcrrcd on all counties in Florida the power to establish, coordinale and enforce zoning and
such business regulations as arc necessary for the protection ufthe public. and
WHEREAS, the County pursuant thereto ha, adopted a Land De,elopment ('ode
(Ordinance !\in, 91-10:2) which establishes regulations for the zoning ofpanicular geographic
divisions oflhe County, among which is Ihe allowance of ofT. site parking. and
WHEREAS, the Iloard of Zoning Appeal" being the duly eleeled constituted hoard for
Collier County which includes the area hereby afTeeted, has held a public hearing al1er notice and
ha< considered the advi..bility of OfT-Sile Parking at Shores Avenue on Lot 70, Palm River
Shores, to serve the existing business,located at 11980 North Tamiami Trail and OO':..SilC Parking
as shov.'n on the attached plot plan, Exhibit """. in an RSF.4 zone for rhe property hcrcinancr
described, and has found as a matter of fact that satisfactory provision and arrangement have been
made concerning all applicable mallers required by said regulations and in accordance wilh
Subsection 2 4 II 4, Section 2 7.5 and Divi,ion 13 of the Collier County Land Developmcnl
Code, for thc unincorporated area of Collier County, and
WHEREAS, all intereMed parties have becn given opportunity to be heard hy Ihi, Board
in a public meeting and the Board having considered all matters presented,
NOW THEREFORE DE IT RESOLVED IlY THE BOARD OF ZONING APPEAl.S of
Collier County, Florida, that the pelition filed by William L Iloover, AICP, of lloover Planning,
representing Craig D Timmins, Trustee, with respect to the property hereinal1er described as
Lot 70, Palm River Shores, B< recorded in Plat Book 3, Page 27, Official Record, or

This approval is conditioned updn the following stipulations requested by tho
Coliier County Planning Commission in their public hearing on October 7, 1999,
a, The applicant shall bear the cost of recording the restrictive covenant in
the public records of Collier County, and shall provide a copy of the
recorded document to Planning Services prior to the final SOP approval.
b, Lighting shall be designed to shield streets and all adjacent properties
from direct glare. excessive light. and hazardous interference with
automotive and pedestrian traffic,
c. The proposed parking shall be surfaced with asphalt or concrete and
striped accordingly,
d, A 15-foot landscape buffer shall be provided along the resldentialiy
zoned property, This shall include a six-foot high opaque masonry wall.
e, The wall stipulated in condition "dO above shall be continued along the
northern property line between the northeast property corner and the
access point to the parking lot.
