V.99.13, FOR A VARIANCE ON PROPERTY

COUNTY. FLORIDA.
\\'IIEREAS, the Legislature of the State of Florida in Chapter 125. Florida Statutes,
has conferred on all counties in florida the power to establish. coordinate and cnli)fcc "'ning
and such business regulations as arc necessary for the protection of the public. and
WIIEREAS, the County pursuant thereto has adopted a Land Development ('ode
(Ordinance ~o 91-1(2) which estahlishes regulations for the zoning of particular geographic
di\'isions of the County, among which is the granting of variances; and
WIIERb\S, the Board ofZoninl! Appeals. being the duly elected constituted Board of
the area hereby alTeeted, has held a public hearing aOer Ilotice as in said regulations made and
provided, and has cOllsidered the advisability of a I a-loot variance from the required Ihlflt )'nrd
setback of 25 feet to 15 feet as shown on the attached plot plan. Exhibit "A", in an RSF.4

The approved variance shall be limited to a one time increase in size of the garage as
depicted Oil the attached 1'101 plan (exhibit "A" attached). and shall measure no greater
than 10 feet into the front.yard setbacks.

I. The property owner shall maintain a dumpster on site to properly dispose of solid waste.
The only waste products permitted to be slored on site sball be horticultural waste waiting
10 be ground into mulch or otherwise used off site, There shall be no penllallent storage
of solid waste on site,
2, The tub grinder shall not be operated within 150 feet of any property line.
3, The maximum height of piles for muleh and horticultural waste waiting 10 be processed
or removed from site shall be ten (10) feet.
4_ During maintenance or cleaning. the tub grillder shall only be operated with llluh covel'
in place.
5, There shall be a maximum of twenty (20) dumr tnlcks and forty-five (45) roll-off
containers stored on site,
6. The tub grinder shall only be operated, maintained or cleaned between the hours of 8:00
a.m, to 5:00 p.m., Monday through Friday and shall not operate on days classified as
holidays for Collier County employees as well as Columbus Day.
7. On-site diesel fuel storage shall not exceed 500 gallons. On-site gasoline storagc tanks
arc not pemlitted, Gasoline storage containers up to five (5) gallons in size arc permitted
for yard work. elc,
8, Maintennnee and repair services to dump trucks. roll-off containers and the end loader
shall be limited as follows,
(a) Dispensing of dicsel fuel and oils.
(b) Servicing of spark plugs, batteries, distributors and distributor parts.
(c) Removing, remounting, balancing, repair and installation of tires,
Recappinglregrooving of tires and wheel alignments are not pennitted.
(d) Replacement of water hoses, fan belts, brake fluid, light bulbs, fuses. wiper blades
grease retainers. wheel bearings, shock absorbers. mirrors. exhaust systems and similar
items,
