RESOLUTION FOR PETITION VAC 99-008 TO VACATE THE 20' WIDE LAKE
MAINTENANCE EASEMENT ON LOTS I06. 130. 131, 133, 134 AND 135 AND
TO ACCEPT A 20' WIDE LAKE MAINTENANCE EASEMENT AS A
REPLACEMENT EASEMENT AND TO VACATE THE 15' WIDE DRAINAGE
EASEMENT ON LOTS 124, 125, 141 AND 142 AND TO ACCEPT A 15' WIDE
DRAINAGE EASEMENT AS A REPLACEMENT EASEMENT. ALL
ACCORDING TO THE PLAT OF "GLEN EDEN, PHASE ONE", AS RECORDED
IN PLAT BOOK 29, PAGES 86 AND 87. PUBLIC RECORDS OF COLLIER
COUNTY, FLORIDA, LOCATED IN SECTION 9, TOWNSHIP 48 SOUTH,
RANGE 25 EAST.
WHEREAS. pursuant to Section 177.101~ Florida Statutes? Mark W Minor, PE., of Q Grady
Minor & Associates, PA., as agent fcr the petitioner. Rcvco/GE Joint Venture, does hereby request the
vacation of the 20' v. idc Lake Maintenance Easement on lots 106, 130, 131, 133. 134 and 135 and to accept a
20' wide Lake Maintenance Easement as a replacement casement and to vacate the 15' wide Drainage
Easement on lots 124, 125, 141 and 142 and to accept a 15' wide Drainage Easement as a replacement
casement, all according to the plat of "Glen Eden. Phase One", as recorded in Plat Book 29, Pages 86 and 87,
Public Records of Collier County, Florida. located in Section 9, Township 48 South, Range 25 East:and
WHEREAS, the Board has this dav held a public hearing to consider vacating said 20' wide Lake
Maintenance Easements and 15' wide Drainage Easements, as more full~ described below. and notice of said
public hearing to vacate was given as required by laxv; and
WHEREAS, the granting of the vacation will not adversely affect the oxxncrship or right of convenient
access of other property. o~=crs.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that the following bc and is hereby vacated:
See Exhibit "A" attached hereto and incorporated herein.
BE IT FURTHER RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, that the 20' wide Lake Maintenance Easements and 15' wide Drainage
Easements, more particularly described in Exhibit "B" attached hereto and incorporated herein, is hereby
accepted as the replacement casements for the Lake Maintenance and Drainage Easements vacated herein.
BE IT FURTHER RESOLVED, that the Clerk to the Board is hereby directed to record a certified
copy of this Resolution in the Official Records of Collier County, Florida, and to make proper notation of this
vacation on the recorded plat as referenced above
This Resolution adopted after motion, second and majorit)' vote favoring same.
