immediate delivery to the respective property owners of the full compensation (as established by Ihe
appraisal or starreompensalion eslirnates in accordance with the proyisions of Chapter 125.355.
Florida Statutes). in return for Ihe immediate and proper execution of the respective easements, and

and any subsequent Chairman/ChnirwomDn, for the life of the Project. to execute any instruments
which have been approved by the Omce oflhe County Attorney which may include. agreements,
documents to remove the licn of any encumbrance, and for any such other purpose as may be required
for the acquired road right~or.way. sidewalk. slope, utility, drainage, maintenance and temporary
driveway restoration interests by casement and/or fee simple title interests.

or "Easement Agreement'! mechanism, the Director oflhe Public Works Engineering Department, or
his designee, is charged with Ihe responsibilily for completion of various capital improvemenl projects.
and is hereby deleg:lled the DUlhority to approve the purchase of land interests Dbove the starr
compensation estimate or appraised value and pay normally related costs when it is in the best interesl
of the Project. within the pro.mta share of Ihe land righls acquisition budget for Ihe parcel being
acquired, only when the difference between the purchase price and compensation estimate or appraised
yalue is less than Fifteen Thollsnnd and 001100 Oollars ($15,000.00) or the current purchasing limits
established by the Collier County Purchasing Department; provided. Project funding is available.
10. That the settlemenl npprov.lnllthority is delclaled by Ihe Board to the exlenllhal such
approyals do not conflict with the provisions ofSeclion 125.~55. Florida Statules.
11. The Chairwoman oflhe Board is hereby :lUthorized to execute Easement Agreements and
Purchase Agreements where the I.nd oWller has agreed to sell the required land rights to the County al
its appraised value or at that amount considered the" Administrative SeUlement Amount" as such tenn
is intemally used by the administmlive agencies of Collier County.
12. 'Nhere the property owner .,yrees. by "Purchase Agreement" or "Easement Agreement", to
convey a necessary inlerest in real property to the County. and upon the proper execution by the
property owner of those easements or fee simple lille, and such other lelal documents as the omce of
the County Attorney may require. the Board hereby authorizes the Finance Department to issue

closina statement and which shaH he based upon the nppraisal or staff compensation estimate in

13. All title to propcrties or intcrests in propcrtics which have been oblaincd in the manner
described above sh,,1l be dccmed ""ecepled" by the Board of County Commissioners. as the governing
body of Collier Coullly, Florida. a polilical subdiyision of the Slate of Florida. and as such. starr is
hereby authorized to record in Ihc Public Records or Collier Counly, Florida. said easemcnls or fee
simple title and such other instruments as may be required to remove the ticn ofaoy encumbrance from
the acquired properties.
