RELATING TO PETITION NO. CU-95-4 FOR
EXTENSION OF CONDITIONAL USE OF PROPERTY
HEREINAFTER DESCF:IBED IN COLLIER COUNTY,
FLORIDA
WHEREAS, the Legislature of the State of Florida in Chapter 125,
Florida Statutes, has conferred on all Counties in Florida the power to
establish, coordinate and enforce zoning and such business regulations
as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which establishes comprehensive
zoning regulations for the zoning of particular divisions of the
County, among which is the granting and extending the time period of
Cond.i tional Uses; and
WHEREAS, on September 19, 1995, the Board of Zoning Appeals
enacted Resolution No. 95-537, which granted a conditional use pursuant

to Ordinance No. 91-102, for a church and related church facilities, on
the below described property; and
WHEREAS, Subsection 2.7.4.5 of the Land Development Code provides
that the Board of Zoning Appeals may extend the one (1) year time
period for a conditional use which has not been commenced;
NOW, THEREFORE BE IT RESOLVED, by the Board of Zoning Appeals of
Collier County, Florida that:
The written request of Dr. Neno J. Spagna of Florida Urban
Institute, Inc. representing Ml:. Richard D. Craig for the Naples Bible
Church for the first of three <:3) permitted one (1) year extensions, in
interest of the following descl:ibed property:
South one-half (S 1/2) of the South one-half (S 1/2) of the
Northeast one-quarter (NE 1/4) of the Southeast one-quarter
(SE 1/4) of Section 34, Township 48 South, Range 26 East,
Collier County Florida, as recorded in Official Record Book
1571, Page 1734, less 100 foot right-of-way.

is hereby approved pursuant to Subsection 2.7.4.5 of the Land
Development Code (Ordinance No. 91-102), and the expiration date for
Resolution No. 95-537, attached hereto and incorporated herein as
E~hibit "A", and all conditions applicable thereto, is extended hereby
for one year until September 19, 1997.
BE IT FURTHER RESOLVED that this Resolution be recorded in the
minutes of this Board and in the records of the Petition for which the
extension is granted.

WHEREAS, the Legislature of the State of Florida in Chapter

and 111011 of section 2.2.2.3 in an "All zone for a church and related
church facilities on the property hereinafter described, and has fo~nd
as a matter of fact (Exhibit "!'.") that satisfactory provision c;'''
arrangement have been made concErning all applicable matters required
by said regulations and in accordance with Subsection 2.7.4.4 of the
Land Development Code for the Collier County Planning Commission; cnd

church facilities in accordance with the Conceptual Master Plan
(Exhibit "B") and subject to the following conditions:
a. The Planning and Technical Services Manager may approve
minor changes in the location, siting, or height of
buildings, structures, and improvements authorized by
the conditional use. Expansion of the uses identified
and approved within this conditional use application, or
major changes to the site plan submitted as part of this
application, shall require the submittal of a new
conditional use application, and shall comply with all
applicable County ordinances in, effect at ~e time of
submittal, including Division 3.3, Site Development Plan
Review and approval, of the Collier County Land
Development Code (Ordinance No. 91-102).

b.
As a precondition of any development, connection shall
be made to the County's Water system in place on C.R.
951.
c. Arterial level street lighting shall be provided at the
project entrance at the time said entrances is
constructed.
d. Both a northbound left turn lane and a southbound right
turn lane will be required under two-lene CR 951
conditions in accordance with Ordinance 93-64. Under
four-lane conditions, access will be constrained to
right-injright-out. Turn lanes will be constructed at
the time the project entrance is constructed.
e. Additionally, right-of-way may be required to facilitate
the eventual widening of CR 951. In the event
additional right-of-way is deemed necessary, said action
to acquire the right-of-way shall be as prescribed by
the provisions of the LDC at Section 2.7.4.5.4.
f. -- "An exotic vegetation r'~moYal, monitoring, and
maintenance (exotic-fr,.e) plan for the site, shall be
submitted to Planning and TeChnical Services
Environmental Review staff for review and approval prior
to final site planjcon:;truction plan approval.
BE IT FURTHER RESOLVED that this Resolution be recorded in the
minutes of this Board.
