RESOLllTION NO. 96-~
RELATING TO PETI'rION NUMBER V-96-16, FOR
THREE VARIANCES ON PROPERTY HEREINAFTER
DESCRIBED IN COL.LIER COUNTY, FLORIDA.
WHEREAS, the Legislature oJ the State of Florida in Chapter 125,
Florida statutes, has conferred on all counties in Florida the power to
establish, coordinate and enforce zoning and Buch business regulationa
as are necessary for the protec1:ion of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (ordinance No. 91-102) which establishes regulations
for the zoning of particUlar gec,graphic divisions of the County I among
......hich is the granting of variances; and
WHEREAS, the Board of Zoning Appeals, being the duly elected
constituted Board of the area hereby affected, has held a public

hearing after notice as in said regulations made and provided, ~d has

considered the advisability of an after-the-fact O.2-foot variance from
the required 25 foot front setback to 24.8 feet; a 0.71 foot variance
from the required 25 foot rear setback to 24.29 feet; and a 1.7 foot
variance from the required 7.5 flJot side yard setback of to 5.8 feet,
as shown on the attached plot pli!n, Exhibit 'IA'I, in an RSF-4 zone for
the property hereinafter described, and has found as a matter of fact
that satisfactory provision and i\rrangement have been made concerning
all applicable matters required by said regulations and in accordance
with Section 2.7.5 of the Zoning Regulations of said Land Development
Code for the unincorporated area of Collier CountYi and
WHEREAS, all interested parties have been given opportunity to be
heard by this Board in public meeting assembled, and the Board having
considered all matters presented;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS of
Collier County, Florida, that:
The Petition V-96-16 filed by Peter L. Rosenberg of Monopoly
Builders, Inc., representing Thom.:l.S Valesky, ....ith respect to the
propel~ty hereinafter described as:

in Plat Book 3, Page 6, of the Public Records of Collier
County, Florida.
be and the same hereby is approved for a O.2-foot after-the-fact
