A RESOLUTION PROVIDING FOR THE EARLY
SUSPENSION OF THE COLLECTION OF A ONE-HALF OF
ONE PERCENT SALES SURTAX PURSUANT TO COLLIER
COUNTY ORDINANCE NO. 96-31 AND COLLIER COUNTY
RESOLUTION NO. 96-300, AT SUCH TIME AS FUNDING
GOALS HAVE BEEN MET, AND PROVIDING FOR
DESIGN, PERMITI'ING AND CONSTRUCTION FROM
FUNDS GENERATED BY SURTAX COLLECTION.
WHEREAS, on June 25, 1996, the Board of County Commissioners of Collier County,
Florida adopted Collier County Ordinance No. 96-31 which provided for an additional one-half
of one percent sales surtax to be collected for three years to fund capital improvements of
constmcting an expansion to the Collier County Jail and constructing a Work Release &
Restitutio!: Center; and
WHEREAS, on June 25, 1996, the Board of County Commissioners of Collier County,
Florida adopted Resolution No. 96-300 ordering and calling a referendum election to be held on
November 5, 1996 for the purpose of obtaining approval of the said sales surtax from the
electors of Collier County; and
WHEREAS, on November 5, 1996 the said referendum election will be held requesting
the electors of Collier County to vote on the following proposition:
Shall an additional one-half of one percent surtax (sales tax) pursuant to Ordinance
No. 96-31 be levied in Collier County for a period of 3 years, commencing
February I, 1997 and ending January 31, 2000, to fund the capital improvements
of constructing an expansion to the Collier County Jail and constructing a Work
Release & Restitution Center?
and
WHEREAS, it is anticipated that the said one-half of one percent sales surtax, if
collected for a full three years, may generate funds in excess of those needed to fmance the
design, permitting and construction of the Work Release & Restitution Center and the expansion
of the Collier County Jail facility; and
WHEREAS, the fmal design, permitting and construction of the said Work Release &
Restitution Center and the expansion of the Collier County Jail facility will occur during the
period of time that the one-half of one percent sales surtax will be collected; and
WHEREAS, the Board wishes to provide for the suspension of collection of the one-half

of one percent ~'.Jes surtax at such time as the total cost for design, permitting and construction
of the Work Release & Restitution Center and Collier County Jail expansion have been
collected; and
WHEREAS, the Board wishes to adopt a policy that the cost of the design, permitting
and construction of the Work Release & Restitution Center and Collier County Jail expansion
facility be paid from funds generated by sales surtax collection.
NOW, TIIEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. Should the referendum to levy an additional one-half of one perc;ent
sales surtax commencing February 1, 1997 to fund capital improvements for the" design,
permitting and construction of an expansion to the Collier County Jail and the design, permitting
and construction of a Work Release & Restitution Center be approved by a majority of the
electors of Collier County voting in such referendum election, notwithstanding the provision
contained therein allowing for the collection of said ono-half of one percent sales surtax for a
three year period, should the total cost for the design, permitting and construction of the
expansion to the Collier County Jail and the design, permitting and construction of the Work
Release & Restitution Center be collected prior to the ending of the three year period, the
collection of said one-half of one percent sales surtax will be suspended.
SECTION TWO. It is the policy of this Board that the design, permitting and
construction of the Collier County Jail expansion and the Work Release & Restitution Center
shall be performed from the funds generated by the one-half of one percent sales surtax
collection.
This Resolution adopted this /. l' day of August, 1996, after motion, second and
majority vote.
