RESOLUTION NO. 96- 363
A RESOLUTION REQUESTING FLORIDA DEPARTMENT OF
TRANSPORTATION AUTHORIZATION FOR LAND-SCAPE
IMPROVEMENTS ON S.R. 951 AT THE MARCO RIVER
BRIDGE (JUDGE JOLLY BRIDGE), CONFIRMING COLLIER
COUNTY COMMITMENTS FOR LANDSCAPE

Cr.NSTRUCTION, AND AUTHORIZING THE COUNTY
ADMINISTRATOR AND HIS STAFF TO ENTER INTO
LANDSCAPE PERMITS/AGREEMENTS.
WHEREAS, the Florida Department of Transportation (FDOT) is the
operaling/maintenance/permitting authority for S.R. 951 to include that portion of roadway
on the south side of the Marco River Bridge (Judge Jolly Bridge); and
WHEREAS, the FDOT has issued a permit to Collier County for the landscaping,
both installation and maintenance, for S.R. 951 between the Marco River Bridge (Judge
Jolly Bridge) and C.R. 92 (Reference FDOT Permit No. S61-81 dated November 13,
1981); and
WHEREAS, the FDOT and Collier County are desirous of beautifying State
roadways through the proper application and maintenance of landscape materials; and
WHEREAS, Collier County has received a State Grant for the expansion of
landscaping within the permiUed segment of S.R. 951 (Reference State Department of
Agriculture Grant Contract #3232 in the amount of $8,930.00) and the Grant requires the
work to be performed by September 30, 1996; and
WHEREAS, Collier County is desirous of taking advantage of the State Grant and
performing the landscape improvements as soon as possible in consideration of available
unit prices for landscape materials and favorable site conditions,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the FDOT accept the following
conditions in performance of immediate landscape improvements by Collier County:
1. As the existing Permittee, Collier County, assumes the responsibility and cost for
landscape installation, maintenance, relocation, and removal as so directed by the
FDOT for road construction and maintenance purposes.
2. Acceptance of the landscape plans as prepared by McGee and Associates, Inc, and as
reviewed and approved by FDOT staff (Reference McGee & Associates S.R. 951
Landscape Plan Sheet Nos. L-1, L-2 and T-3).

3. The existing Permittee, Collier County, shall be responsible for the notification of all
applicable utilities and to coordinate utility relocation as necessary.
4. Tha Collier County Metropolitan Planning Organization (MPO) In approving the FDOT
5-Year Work rl"~ (FY 1995-96 - FY 1999-00), and the Board of County Commissioners
in approving the Marco Island Master Plan have identified no major construction or
reconstruction in the areas for landscaping during the above-referenced FDOT 5-Year
Adopted Road Plan period with the exception of planning and road design activities
associated with State Project Nos, : 030301514 and 030301520.
5. To implement the landscape Improvements, the Board of County Commissioners
hereby authorizes the County Administrator and his staff to enter into applicable
amendments of existing landscape permits/agreements and/or memoranda of
permiUagreement with the FDOT to Include any necessary after-the-fact
permits/agreements,
6, To coordinate the landscape improvements, a copy of this Resolution shall be provided
to the FDOT District One Secretary, the FDOT District One Landscape Manager, and
other persons as directed by the County Administrator.
