RELATING TO PETITION NUMBER V-99-09,
FOR A VARIANCE ON PROPERTY
IIEREINAFTER DESCRIBED IN COI.LIER
COUNTY, FLORIDA.
WHEREAS. the Legislature of the State of Florida in Chapter 125, Florida Statutes,
has conferred on all counties in Florida the poxvet to establish. coordinate and enforce zoning
and such business regulations as arc necessary for the protection of the public: and
WHEREAS, the County pursuant thcrelo has adopted a Land Developmeal Code
(Ordinance No. 91-1021 which establishes regulations for the zoning of particular geographic
divisions of the County. among which is Ihc granting of variances: and
WHEREAS, the Board of Zoning Appeals. being the duly elected consliluted Board of'
the area hereby affected, has held a public heating after riolice as in said rcgrdalions made and
provided. and has considered Ihe advisability of a 6-foot variance from the required I¥ont yard
sclback of St) fcct to ,44 feet for the pr/ncipal structure, an aftcr-thc-facl variance of 13 fccl
from the required 50-foot front yard setback to 37 fcct for an existing gt,cst house. anti an
aftet-the-fact variance of 6.2 feet from the required 30. foot side yard setback to 23.8 feet for
an existing gucst house. as shown on the attached plot plan, Exhibit "A". in an RSF-I Zone
for the property hereinafter described, and has found as a matter of fact that satisfactory
provision and an'angcmcnt have been made concerning all applicable matters required by said
regulations and in accordance with Section 2.7.5 of the Zoning Regulations of said l.and
Development Code for the unincorporated area of Collier County; anti
WHEREAS, all interested parties have been given opportunity Io be heard by this
Board in public meeting assembled, and Ihe Board having considered all maltcrs presenled;
NOW THEREFORE BE IT RESOLVED BY TIlE BOARD OF ZONING APPEALS
of Collier County. Florida, that:
The Petition V-99~09 filed by Jim Titsch, representing Bernard and Ashley Freeland,
with respect to Ihc property hereinafter described as:
Lot 8. Block M. Pinc Ridge Extension, as recorded in Plat Book 3,
Page S I of the Public Records of Collier County, Florida.
be and the same hereby is approved for a &.foot variance from the required front yard setback
of 50 feet to 44 feet for tile principal structure, an after-the-fact variance of 13 feet from the
required SO-foot front yard setback to 37 feet for an existing guest house, and an after-the-fact
variance of 6.2 feet from Ihe required 30-foot side yard setback to 23.8 feet for an exisling

guest house, as shown on the attached plot plan, Exhibit "A", or the RSF-I Zoning District
wherein s.~id property is located, subject to the following conditions:
This variance is for the encroachments depicted in I!xhibit "A".
Other encroachments shall require separate variances.
