PUBLIC SAFETY COORDINATING COUNCIL
MEETING
Naples, Florida, March 6, 2008
LET IT BE REMEMBERED, that the Collier County Public Safety
Coordinating Council, in and for the County of Collier, having conducted
business herein, met on this date at 12:00 Noon., at the Collier County
Museum Conference Room, 3301 East Tamiami Trail, in Naples, Florida,
with the following members present:

I. Introduction
A. Call to Order
Commissioner Fred Coyle called the meeting to order at 12:06 PM.
B. Moment of Silence
Commissioner Coyle requested a moment of silence in memory of Public Defender
Robert Jacobs.
C. Approval of Minutes
Commissioner Coyle noted he would accept a blanket motion to approve
or accept following Minutes:
. Minutes of the October I, 2007 Meeting of the Public Safety Coordinating
Council,
. Minutes of the December 3, 2007 PSCC Symposium Summary,
. Minutes of the January 17,2008 Work-Restitution Release Subcommittee
Meeting (accepted),
. Minutes of the February 21, 2008 Work Restitution Release Subcommittee
Meeting (accepted)
David Schimmel moved to approve or accept the above-stated Meeting Minutes.
Second by Chief Greg Smith. Carried unanimously, 9-0.
II. Old Business
A. Update from Work-Restitution Release Subcommittee - Judge Maiialich
Mike Sheffield stated Judge Mailalich could not attend but had asked him to
announce that the subcommittee had met and that Scott Salley was researching
data from the national criminal justice hearing for the next meeting.
B. Inmate "Snap-Shot" Report - Chief Scott Salley
Chief Salley stated the period covered was from March, 2007 through February,
2008. He reported the following:
. Average daily jail population was 1,216
. October 2007 through February 2008, reflected a decrease in jail population
. The 287-0 Program began in October 2007
. Since October 2007, the number of documented gang members has
increased - the daily average is 48
. Under the category "Awaiting Trial," the number offelon female inmates
paralleled the national trend with a significant increase locally in the number
of incarcerated females
. Under "% of Self-Admitted Illegal," the figures have remained consistent
. Since June 2007, approximately 370 identified criminal illegal aliens have
been removed from Collier County
In response to Chairman Coyle's question, Chief Salley stated criminal illegal
aliens were transported to the federal facility on Krome Avenue in Miami for

processing. He stated there is a new facility at Lake Okeechobee and another
will open in the Panhandle. He mentioned Lee, Lake, and Manatee Counties were
interested in 287-G and have contacted him regarding the training school.
A question was asked concerning the disposition of the aliens.
Chief Salley responded the aliens are either incarcerated to finish out their
sentences or they are deported.
A question was asked concerning the location where the criminal illegal aliens
would serve out their sentences.
Chief Salley stated the aliens were returned to the county in which they were
initially arrested. After the sentence was completed, then they were transitioned
to the federal facility for deportation.
III. New Business
A. Action Plan from the Circuit-wide Public Safety Coordinating Council
Symposium held on 12/03/07 (Formation of a Regional Task Force)
Chairman Coyle stated he would report on both the Symposium as well as
the recent Regional Task Force meeting held on February 29, 2007.
At the Symposium, there was unanimous agreement to work together on a
regional basis and to create the Task Force which met in last week at the
North Collier Regional Park in the Exhibit Hall. Representatives of Lee,
Charlotte, Hendry and Glades Counties attended.
He stated the Task Force meeting was very successful according to reports
received from the counties that participated.
Chairman Coyle noted it was interesting to learn the counties did not all share
the same problems, or did not perceive the problems to be as critical. He noted
all of the counties experienced a shortage of jail beds. He was surprised that
other counties did not have a problem with the illegal alien population.
At the Task Force Meeting, various ideas were discussed:
. How to obtain money to fund regional diversion programs,
. Legislative changes were suggested that might be appropriate to
reduce the jail population,
. Working together on grant applications - regional participation might
improve the likelihood of being awarded a grant,
. Building regional jails rather than building individual jails, and
. Building regional facilities for diversion programs.
Chairman Coyle stated that, while no conclusions were reached, it was decided
these ideas should be researched and evaluated. Information will be collected to
accurately identify the types of problems being faced by the different counties.
The members ofthe Task Force agreed to hold additional joint meetings.

Chairman Coyle asked the County Attorney's Office for an opinion concerning
any potential legal complications concerning future joint meetings.
Robert Zachery stated a general rule of Statutory construction was if a Statute
defined terms or gave specific instruction, you were to adhere to the defined
terms or the instruction must be followed.
951.25, F.S., states:
"(1) Each Board of County Commissioners shall establish a county Public
Safety Coordinating Council jor the county or shall join with a consortium
of one or more other counties to establish a Public Safety Coordinating
Council for the geographic area represented by the member counties. "
Chairman Coyle asked ifan Attorney General's Opinion could be obtained.
Mr. Zachery stated since there was no controversy, he could not request an Attorney
General's Opinion but he could obtain an advisory from the Attorney General's
Office.
Chairman Coyle asked Mr. Zachery to obtain the Advisory Opinion and stated the
matter should be pursued because it did not make sense that the intent of the
legislation was to discourage Counties from working together while keeping the
same interests within each county. He cited the example of Metropolitan Planning
Organization ("MPO") which has been established in both Lee and Collier
Counties. He noted the State had been encouraging regional participation for years.
Chairman Coyle asked to obtain at least a preliminary indication of why having
joint meetings would be prohibited.
It was suggested to hold joint meetings rather than to hold an independent meeting
in each county every quarter with the same participants attending duplicate
meetings. The regional meetings would not replace an individual county's meeting.
An alternative would be to create subcommittees that could work together in a
coordinated manner.
Chairman Coyle asked if there were any objections. None were stated.
B. Recognize Pamela Donelson, newly appointed State Probation Circuit
Administrator, as a statutory member of the PSCc.
Chairman Coyle noted that Pamela Donelson, who was not present, was duly
recognized.
C. Recognize Kathy A. Smith, newly appointed Public Defender, as a
Statutory member of the PSCC.

Mike Sheffield, Assistant to the County Manager, added that Juan Ramos, who was
present, is the new Designee for Charles Rice.
Chairman Coyle asked if anyone had any new business to bring to the Council's
attention.
Jim Mudd, Collier County Manager, stated the reason why the judges were not in
attendance was because they were in a special conference trying to work around the 4%
budget cut. One suggestion was to close the judges' offices during the last two weeks
in June in order to meet the budgetary restrictions. He stated the cuts will have a direct
impact upon inmates in the jail and the July budget may have an additional reduction of
$2.2 Billion.
Juan Ramos stated he completed a report on electronic monitoring which he would
present at the next meeting.
Chairman Coyle asked Mr. Ramos to send a copy of his report to Mike Sheffield.
He asked about the use of electronic monitoring and the advantages vs. disadvantages.
Currently, the County's Probation Department is investigating the use ofGPS monitoring
and other electronic monitoring options and will present its report at the June meeting.
The County charges an inmate $90.00 per week to participate in the electronic
monitoring program. The inmate is able to keep his/her job and remain at home instead
of being in jail. A Judge's order is required and the defendant must agree to participate.
The cost may be reduced if another system is used or ifthere is a higher volume of
participation.
Chairman Coyle requested personal opinions concerning the significant illegal alien
population in Collier County.
Mike Orlando stated there is a different jail population in Lee County than in Collier
County. He pointed out there is a large agricultural area in Collier County that does
not exist in Lee County.
Chief Salley stated Lee County is applying for the 287-G Program.

Mary Andrews introduced herself as a member of the Mental Health Association of
Palm Beach County.

The next meeting of the Collier County Public Safety Coordinating Council will be held on
June 12, 2008 at 2:00 PM in the Museum's large Conference Room.
There being no further business for the good of the County, the meeting was adjourned by
order of the Chair at 1:55 PM.
