Resolution 1996-318 J U L 1 6 199F, RESOLUTION NO. %-~ RELATING TO PETITION NUMBER V-96-10, FOR A VARIANCE ON PROPERTY HEREIllAFTER DESCRIBED IN COLLIER COUNTY, n.oRIDA. WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statlltes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such husin(~ss regulations as are neces!;ary for the protection of the public; and WHEREAS, the County pursuant ttlereto has adopted a Land Development Code (Crdinance r~o. 91-102) ~hich estal)lishl~s regulation~; for the zoni'lg of pilrticular geographic divisions of thl3 County, amOJlg which is the granting of variances; and WHEREAS, the B0ard of Zoning Appeals, being tIle duly elected constituted Board of the area hereby affected, has held a public hearing after notice as in said regulations made and provided, and hdS considered tIle advisability of an 11.J-fclot after-the-fact variaIlce frem the required 30 foot front yard setback to 18.7 feet as shown on the attached plot plan, Exhibit "A", in an RSF-) zone for the property hereinafter <lescribed, and has found as a matter of fact that satisfactory provision and arrangement have been made concerning all applicable matters required by said regu~ations and in accordance with Section 2.7.5 of the Zoning Regulations of said Land Development Code for the unincorporated area of Collier CC)UIlty; and WHEREAS, all ir,:.erested parties haVf! be(~n given opportunity to be heard by this Board in public meeting as~;ernbled, and ttle Board havir:g considered all matters presented; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF 20NING APPEALS of Collier County, Florida, that: The Petition V-96-10 filed by Steven Magner, representing Crea1:ive Homes of SW Fla., Inc., with respect to the property hereinafter described as: Lot 21, Block 182, Golden Gate, unit 6 Part I, as recorded in Plat Boo}: 9, Pages 1-7 inclusive, of the Public Records of Collier County, Florida. -1- nnn ')~ ') JUL 1 6 '996 be and the same hereby is approved for an 11.J-foot after-the-fact variance from the required 30 foot front yard setback to 18.7 feet a~; shown on tho attachel1 plot plan, Exhibit l'AII, of the RSF-) zoning district wherein sai,j property is located.
