RESOLUTION NO. 96-~
A RESOLUTION INITIATING A PROGRAM FOR THE
PURPOSE OF PROVIDING STORMWATER DRAINAGE
IMPROVEMENTS WITHIN THE NAPLES PARK AREA
DRAINAGE IMPROVEMENTS MUNICIPAL SERVICE BENEFIT
UNIT; DESIGNATING THE NAME OF THE SPECIAL
ASSESSMENT DISTRICT; DESCRIBING THE AREA TO BE
IMPROVED AND PROVIDING THAT THE COST OF SUCH
IMPROVEMENTS SHALL BE PAID FROM ASSESSMENTS
AGAINST BENEFITED PROPERTIF.S; INSTRUCTING THE
COUNTY'S CONSULTING ENGIlIEI:RS FOR THE PROJECT TO
PREPARE THE PLANS AND SPECIFICATIONS, ESTIMATE
OF THE COSTS OF THE PROJECT AND A TENTATIVE
ASSESSMENT ROLL AND SUPERSl:DING AND REPEALING
RESOLUTION NO. 95-517.
WHEREAS, the Board of County Commissioners on July 18, 1995
adopted Collier County Ordinance No. 95-44 which amends Ordinance
No. 86-37 by providing the procedurE' for the levy and collection
of the Bpe~ial assessments; nnd
WnE~EAS, the Board of County Commissioners on August 22, 1995
after a dilly noticed public hearing adopted Resolution No. 95-476
creating the Naples Park Area Drainage Improvements Municipal
service ecnefit Unit; and
WHEREAS, the Board of County Commissioners on July 16, 1996
adopted Resolution No. 96-311 repealing and superseding Resolution
No. 95-475 to reflect the revised description of the project; and
WHEREAS, the aforementioned resolution, did set forth that
the cost of the stormwater drainage improvements within the Unit
shall De paid by the levy and collection of special assessments
against the benefited properties within the Unit.
NOW, THEREFORE, BE IT RESOLVED 8Y THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Sectio~. This Resolution is adopted pursuant to the
provisions of Section 125.01, Florida Statutes, Collier County
Ordinance No. 86-37, as amended by Ordinance No. 95-44, and other
applicable provisions of law.
Section TwQ. It is hereby found and determined as follows:
A. The special assessment district create.d shall be
Officially known as "Naples Park Area Drainage Improvementn
Special Assessment District".

B. The special assessment district shall comprise all
those lands within the Naples Park Area Drainage Improvements
Municipal service Benefit Unit as described in Resolution No.
96- 311 and more particularly described as:
All those certain lands lying within portions of
Sections 28 and 33, Township 40 South, Range 25 East,
Collier County, Florida, and being further described as
follows, all of;
unit No. 1, Naples Park as recorded in Plat Book 1, Page
106 and;
Subdivision of Block 1, Unl.t No. 1, Naples Park, as
recorded in Plat Book 4, Page 5 and;
Replat of Blocks 4 , 5, unit No. 1, Naples Park, as
recorded in Plat Book 4, Page 6 and;
unit i/o. 2, Naples Park as recorded in Plat Book 2, Page
107 and;
Unit No. 3, Nal>les Park as recorded in Plat Book 3, Page

Section 33, Township 48 South, Range 25 East, being
hounded on the;
North by the South right-of-"ay line of 91st Avenue;
South by ths North right-of-way line of Vanderbilt Beach
Road;
East by the West right-of-way line of U.S. 41, N.
Tamiami Trail ;
West by the East right-of-way line of Vanderbilt Drive;
c. It is necessary for the continued preservation of the
health, welfare, convenience and safety of the citizens and
inhabitants of the Naples Park Area to provide for the
construction of the stormwater drainage improvements in the
vicinity of 91st/92nd Avenue North and 8th Street,
rehabilitating the culverts under Vanderbilt Drive (the
"Project") described in Exhibit "A" attachsd hereto and

incorporated herein.
The Project provides an improved
stormwater drainage outfall system into which runoff is
discharged from all the lots or parcels of property located
within the Naples Park Area Orainage Improvenent Benefit
Unit.
D. The cost of construction shall be payable by the le'~
and collection of special aasesements against the properties
benefiting from the construction of the Project. Such cost,
in addition to the specific items contained in such plans and

specifications may be deemed to include legal servicGs,
e.ngineering costs, acquisition costs, administrative
fu..poP.nses, financing costs, etc.
~(tl!)n Three. Construction ot such assessable improvements
constituUn'J the Project is hereby ordered pursuant to the
provisions of Collier County Ordinance No. 86-37, as amended,
Ordinance No. 68-23 and other applicable provisions of law.
~ion Four. The Board does h.!reby direct the County's
Consulting Engineer for the Project to prepare in triplicate the
prelh1inary plan3, speclf ications and cost estimates for the
improvements constituting the projec':. The Board also hereby
directs the County's Cons'llting Engineer for the Project to
prepare in triplicate the Tentative Assessment Roll, which roll
shall contain:
A. The description of the lots and parcels of real
property within the Unit which ..ill benefit from such
assessable improvements and the estimated amount of benefits
to each such lot or parcel of px'operty, provided such lots
and parcels shall include the property of the County, and any
school district, special district, or political subdivisiol1.
B. The name and address of the owner of record of each lot
and parcel as shown on the current County Tax Rolls.
C. The total estimated cost of the project to each
benefited lot or parcel.

D. The method of assessment utilized in determining the
cost of the project to be Bssessed to property owners,
including any formulas for dealing with specially benefited
lots or parcels of property.

One set of the triplicates of el1ch of the preliminary plans,
specifications, cost estimate of the project and Tentative
Assessment Roll shall be filed with the Clerk and be open to the
inspect~o~ of the public.
~~~. After completion of the Project and within
thirty {30) jays after confirmation of the assessments, any
assessment may be paid at the office of the Clerk, without
interest. Thereafter all assessments shall be payable in equal
annual installments, with an interest rate and installment period
to be est.,blished upon completion of the construction of the
improvement~, on the unpaid balances trom the expiration of auld
thirty (30) days; provided, however, any assessment may be paid at
any time before due, together with interest accrued thereon to the
date of payment. S~ch assessments shall be levied based on
stormwa~:er runoff factors and square footage of each lot or parcel
of property or per unit for condominiums within the Naples Park
Area Drainage Improvement. !olunicipal ~:ervice Benefit unit, or lots
or parcels of property otherwise specially benefited thereby and
deslgnnted on the assessment roll. The assessments shall be
levied against such properties in direct proportion to the
benefits received from the construction of the project and the
stormwater runoff burden such properties impose bn the overall
stormwater drainage system within the Naples Park Area Drainage
Improvements Municipal Service Benefit unit.
section si~. After the thirty (3'J) day period referenced in
section 5, the assessments as finally determined and confirmed
shall be payablo at the office of the Tax Collector of Collier
County at the same time as the ad valorem taxes of such County are
collected, and all assessments shall ccmstitute a lien upon the

properties so assessed, of the same nature and to the same extent
as the lien thereon for County ad valorem taxes falling due in the
same year or years in which such asse~smentB or installments
thereof fall due. As an alternative to the foregoing, the County
may contrac:t with the Property Appraiser and Tax Collector to
include the special assessments on the ad valorem ta:.: bills
pursuant to Section 197.3632, Florida statutes.
~~i2r Seven. This Resolution Bupersedes and repeals
Resolution No. 95-517.
~tion Eiaht. The Clerk is hereby ordered and directed to
spread this Resolution in full among the minutes of this meeting
for p~rmanent record in his office.
