RELATING TO PETITION HUMBER V-96-3, FOR A
VARIANCE ON PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY, FLORIDA.

WHEREAS, the LegiSlature of the State of Florida in Chapter 125,
Florida statute., has conferred on all counties in Florida the paver to
establish, coordinate and enforce zoning and such business regulations
as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Development Code (Ordinance No. 91-102) which establishes regulations
for the zoning of particular geographic divisions of the County, among
which Is the granting ot variances; and
WHEREAS, the Board of Zoning Appeals, being the duly elected
constituted Board ot the area hereby affected, has held a pUblic
hearing after notice as in said regulations made and provided, and has
considered the advisability of a variance of 30 feet and 45 feet
respectively to the frontage requirements of 60 feet for two lots to 30
feet and 15 feet respectively as shown on the attached plot plan,
Exhibit "An, in a "VR" zone for the property hereinafter described, and
has found as a matter of fact that satiSfactory provision and
arrangement have been made concerning all applicable matters required
by said regulations and in accordance with Section 2.7.5 of the Zoning
Regulations of said Land Development Code for the unincorporated area
of Collier County; and
WHEREAS, all interested parties have been given opportunity to be
heard by this Board in pUblic meeting assembled, and the Board having
considered all matters presented;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS of
Collier County, Florida, that:
The Petition filed by Guadalupe Gonzalez, with respect to the
property hereinafter described as:
Lot 6, Block 4, Carson's SUbdivision, as recorded in Plat
Book 2, Page 40, of the Public Records ot Collier County,
Florida.

be and the same hereby is approved tor a variance of 30 feet and 45
feet respectively to the frontage requirements of 60 feet for two lots
to 30 feet and 15 feet respectively as shown on the attached plot plan,
Exhibit "A", of the "YR" zoning district wherein said property is
located, subject to the following conditions:
1. That the petitioner immediately make application for a lot
line adjustment pursuant to Section 3.2.4.8 of the Land
Development Code.
2. That the two residential/mobile home structures be positioned
to comply with all setback requirements for the two lots.
BE IT RESOLVED that this Resolution relating to Petition Number
V-96-3 be recorded in the minutes of this Board.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS APR - 21996
PROVIDING FOR ASSESSMENT OF LIEN, FOR THE COST OF
THE ABATEMENT OF PUBLIC NUISANCE, IN ACCORDANCE
WITH ORDINANCE 91-47.
WHEREAS, as provided in Ordinance 91-47, tr.c direct costs of
abatement of certain nuisances, including prescrl~'ad administrative
cost incurred by the County, shall be assessed against such property;
and
WHEREAS, the cost thereof to the County as to each parcel shall be
calculated and reported to the Board of County Commissioners, together
with a description of said parcel; and
WHEREAS, such assessment shall be a legal, valid and binding
obligation upon the property against which made until paid; and
WHEREAS, the assessment shall become due and payable thirty (30)
days after the mailing of Notice of Assessment after which interest
shall accrue at a rate of twelve percent (12.0%) per annum on any
unpaid portion thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the property described
as follows, and having been abated of a public nuisance after due and
proper notice thereof to the owner of said property, is hereby assessed
the following costs of such abatement, to wit:

The Clerk of the Board shall mail a notice of assessment of lien
to the owner or owners of the above described property, and if such
owner fails to pay such assessment within thirty (30) days hereof, a
certified copy of this Resolution shall be recorded in the official
records of Collier County, to constitute a lien against such property
according to law, unless such direction is stayed by this Board upon
appeal..of' the assessment of the owner.

You, as the owner of the property above described, as
recorded in the records maintained by the office of the
Property Appraiser, are hereby advised that the Compliance
Services Manager, did on 3/29/95. order the abatement of a
certain nuisance existing on the above property prohibited b~
Ordinance 91~47, serving notice thereof upon you, such
nuisance being:
Prohibited dumping, accumulation, storage or burial of
litter, waste or abandoned property.
You failed to abate such nuisance; whereupon, it was abated
by the expenditure of public funds at a direct cost of
$340.00 and administrative cost of $100.00 for a total of
$440.00. Such costs, by Resolution of the Board of County
Commissioners of Collier County, Florida, have been assessed
against the above property on April 2~ 1996
and shall
become a lien on the property thirty (30) days after such
assessment.
You may request a hearing before the Board of County
Commissioners to show cause, if any, why the expenses and
charges incurred by the County under this Ordinance are
unwarranted or excessive or why such expenses should not
constitute a lien against the property. Such request for
hearing must be made to the Clerk of the Board of County
Commissioners, Government Center, Naples, Florida 33962 in
writing within thirty (30) days from the date of this
assessment to be valid.
