A RESOLUTION PROVIDING FOR THE ESTABLISHMENT
OF A CHILD CARE CENTER CONDITIONAL USE NUMBER
"4" IN THE C-5 ZONING DISTRICT PURSUANT TO
SECTION 2.2.15 1/2.3 OF THE COLLIER COUNTY
LAND DEVELOPMENT CODE FOR PROPERTY LOCATED IN
SECTION 1 TOWNSHIP 50 SOUTH, RANGE 25 EAST,
COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter
'}-1246, Laws ot Florida, and Chapter 125, Florida Statutes, has
()nterred on Collier County the power to establish, coordinate and

(:)force zoning and such business regulations as are necessary for the
rrotection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
[ ,velopment Code (Ordinance No. 91-102) which includes a Comprehensive
:0ning Ordinance establishing regulations for the zoning of particular
( ,ographic divisions of the County, among which is the granting of
Conditional Uses; and

WHEREAS, the Collier County Planning Commission, being the duly
,,,,pointed and constituted planning board for the area hereby atfectt J,
leas held a public hearing after notice as in said regul<<tions made ,~:d
I ,.ovided, and has considered the advisability of Condi. '~mal Use ~4" of
Section 2.2.15 1/2.3 in an C-5 zone for a Child Care C~~ter on the
rroperty hereinafter described, and has found as a matter of fact
(Exhibit "A") that satisfactory provision and arrangement have been
~ade concerning all applicable matters required by said regulations and
in accordance with SUbsection 2.7.4.4 of the Land Development Code tor
the Collier County Planning Comlllission; and
WHEREAS, all interested parties have been given opportunity to be
heard by this Board in a public meeting assembled and the Board having
considered all matters presentedl.
NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING APPEALS ot
Collier County, Florida that:
The petition filed by Rober't L. Duane, of Hole, Montes &
Associates, Inc., representing 1utor Time Child Care Center with
respect to the property hereinafter described as:

Exhibit "B" which is attached hereto and incorporated by
reference herein
be and the same is hereby approved for Conditional Use "4" of Section
2.2.15 1/2.3 of the C-5 zoning district for a child Ca~e Center in
accordance with the Conceptual Master Plan (Exhibit "C") and subject to
the tollowing conditions:
1) Prior to Final Site DeVelopment Plan approval, provide a tire
hydrant within 250 teet ot the center of the lot along the
right-or-way.
2) Prior to Final Site Development Plan approval, provide
accurate water management calculations.
3) CU-95-23 shall be consistent with the Environmental Sections
ot the Collier County Growth Management Plan, Conservation and
Coastal Management Element and the collier county Land
Development Code in effect at the time of final development
order approval.
4) Pursuant to Section 2.2.25.8.1 of the Land Develop~ent Code,
if, during the course of site clearing, excavation or other
construction activity an historic or archaeological artitact
is found, all development within the minimu~ area necessary to
protect the discovery shall be immediately ntopped and ths
Collier County Code Enforcement Department contacted.
BE IT FURTHER RESOLVED that this Resolution be recorded in th.,
minutes of this Board.
