Resolution 2025-142 RESOLUTION NO. 2025- 14 2 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, APPROVING THE USE OF A PORTION OF COUNTY PROPERTY LOCATED AT THE COLLIER MUSEUM AT GOVERNMENT CENTER BY AMERICA'S MILITARY AND FIRST RESPONDER MUSEUM INC., A FLORIDA NOT-FOR-PROFIT ORGANIZATION FOR PURPOSES OF OPERATING A MILITARY MUSEUM PURSUANT TO SECTION 125.38, FLORIDA STATUTES. WHEREAS, Collier County is the owner of real property located at the Collier Museum at Government Center, 3331 Tamiami Trail East, Naples, Florida 34112, hereinafter referred to as the "Premises"; and WHEREAS, America's Military and First Responder Museum Inc., a not-for-profit organization, has requested permission to utilize a portion of the premises for the purpose of operating a military museum, including public exhibits and related educational and commemorative activities; and WHEREAS, Section 125.38, Florida Statutes, authorizes the Board of County Commissioners to allow the use of County-owned property by a not-for-profit organization when such use is determined to be in the best interest of the County and promotes community welfare; and WHEREAS, the LICENSEE, currently known as America's Military and First Responder Museum Inc., is in the process of legally changing its name to Veterans History Museum Inc., a Florida not-for-profit corporation, and the Board acknowledges that all rights, obligations, and responsibilities under the associated license agreement shall remain binding upon the LICENSEE both before and after completion of the name change, provided that the new entity is substantially the same in ownership and control as the original LICENSEE; WHEREAS, the Board finds that the proposed use by America's Military and First Responder Museum Inc., will provide cultural and educational value to the residents and visitors of Collier County, honor the service of military personnel,and further the public interest; NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA,that: 1. The Board hereby determines that the use of a designated portion of the Collier Museum at Government Center by the America's Military and First Responder Museum Inc., a not- for-profit organization, for a military museum including public exhibits and related activities, is in the best interest of the County and serves a public purpose, in accordance with Section 125.38, Florida Statutes. 2. The terms of the non-exclusive facility use license agreement are as follows: a. Price: The monthly rent is $10.00 Gin b. Term: Five years, with renewals to be negotiated at a later date. c. Reporting Requirements: Licensee shall provide a written report to the Board of County Commissioners on or before the first anniversary of the Effective Date, and annually thereafter. The report shall include information on hours of operation, visitor statistics, community outreach, fundraising activities, and programmatic developments.
