Executive Summary
Recommendation to approve increases to the existing exemptions from the competitive process for regulated utility
services provided by the City of Naples, the Immokalee Water and Sewer District, Collier County Water and Sewer
District, Florida Power and Light, and Lee County Electric Cooperative in a combined not -to -exceed amount of
$27,400,000 per fiscal year through the currently approved term ending September 30, 2029; and approve the Fiscal Year
2026 Purchase Orders issued for Lee County Electric Cooperative, Immokalee Water and Sewer District, and Florida
Power and Light that exceeded the previously authorized exemption limits.
OBJECTIVE: To ensure the continued provision of electric, water, and sewer utility services to County facilities and
operational locations necessary to support ongoing County operations.
CONSIDERATIONS: Procurement Ordinance No. 2025-34 requires Board approval of expenditures for Exemptions of
Competition with a value more than the Formal Competition Threshold of $250,000. The Ordinance also provides an
exemption from the competitive process for regulated utility services, including telecommunications, water, sewer, electric,
gas, or other regulated utility, communications, and data transmission services subject to government rate control.
On October 24, 2023 (Agenda Item 16.E.2), the Board approved exemptions from the competitive process for regulated
utility services provided by the City of Naples, the Immokalee Water and Sewer District, Collier County Water and Sewer
District, Florida Power and Light, and Lee County Electric Cooperative through September 30, 2029.
Since approval, utility rate adjustments, increased service demands, and additional County facilities and infrastructure have
resulted in higher projected annual expenditures. To maintain adequate funding authority through the remainder of the
approved term, the annual not -to -exceed amounts require adjustment as reflected below.
These services are essential to sustain Countywide operations and cannot be replaced by other providers. The cost of such
utilities is beyond the control of the County and staff s payment authorization is essential— without electric, water, and sewer
utility services, County facilities and infrastructure would be unable to function, resulting in operational disruption and
potential health and safety impacts.
Additionally, several Purchase Orders issued for Lee County Electric Cooperative, Immokalee Water and Sewer District, and
Florida Power and Light were approved with encumbrances exceeding the previously authorized exemption limits. Although
year-to-date expenditures have not exceeded the approved exemption amounts, staff is seeking Board approval of those
Purchase Orders to ensure continued utility services necessary to support County facilities and operations.
This item is consistent with the Collier County strategic plan objective to optimize the useful life of all public infrastructure
and resources through proper planning and preventative maintenance.
FISCAL IMPACT: Funds are available within the operating budgets and cost centers of the utilizing Divisions. Approval of
this item increases the annual not -to -exceed expenditure authority for the identified utility exemptions but does not create
additional budgetary appropriations.

Detailed Description of Purchase.
The City of Naples is the only provider of utility services in many locations throughout the City of Naples Service area
of the County. There are no other alternative vendors that can provide these utility services. The utility services are
critical for County -wide operations.
In FY 2023 there were twenty (20) purchase orders opened for over 70 different accounts throughout the County for
water, irrigation, sewer and solid waste services (note - this exemption request does not include interlocal
agreements for various governmental services). The total FY 2023 actual expenditures were approximately $240,000.
Based on the increasing CPI, costs for utility services (rate increases for utilities), and additional locations (as needed),
the requested amount of maximum spend has been increased.

Detailed Public Purpose. Include why this purchase is essential to County operations. I
The services are essential to County operations to ensure that County locations throughout the County have utilities,
such as, water and sewer. Without the services provided County operations would come to a halt and County
operations would not be able to be completed at multiple County locations (for example East Naples Community
Park, Growth Management Community Development Main Building, Transportation Department Building amongst
others) in FY 2024 due to life and health safety issues.
As locations and facilities are added for operations, the total number of purchase orders will increase, which is
anticipated as the County grows / develops additional locations.

SECTION FOUR
Detailed Description of Purchase.
Florida Power and Light is the only provider of utility services in many locations throughout the County. There are no
other alternative vendors that can provide these utility services. The electric utility services are critical for the
continuation of County operations.
In FY 2023 there were purchase orders opened for 379 different accounts at multiple locations throughout the
County, such as, wellfields, wastewater collections plants, wells, water meters, pump stations, timers at many
locations, roundabouts, buildings, parks facilities, concession stands, etc. The total FY 2023 actual expenditures were
approximately $12,440,000. Based on the increasing CPI, costs for electric (at a minimum 10% increase per year), and
additional locations (as needed), the requested amount of maximum spend has been increased.

Detailed Public Purpose. Include why this purchase is essential to County operations.
The service is essential to Countywide operations to ensure that County locations throughout the County have
utilities, such as, electric. Without the services provided County operations would come to a halt and County
operations would not be able to be completed for the majority of the County locations in FY 2024. For example, if the
water and/or wastewater locations were to not have electricity, it could cause life and health safety issues.
As locations and facilities are added for operations, the total number of purchase orders will increase, which is
anticipated as the County grows / develops additional locations.

Detailed Explanation/Reason for the Increase/Decrease Request:
The exemption expenditure limit is being increased to account for utility rate adjustments that have occurred since the original Board
approval on October 24, 2023 (Agenda Item 16.E.2), as well as increased service demands associated with additional County
facilities and infrastructure. As County operations continue to expand, projected annual expenditures for regulated utility services have
increased. The revised not -to -exceed amount is necessary to maintain adequate expenditure authority through the remainder of the
currently approved term ending September 30, 2029.

of Immokalee area of the County. There are no other alternative vendors that can provide these utility services. The
utility services are critical for the continuation of County operations.
In FY 2023 there were nine (9) purchase orders opened for 23 different accounts at multiple locations throughout the
County for water and sewer services. The total FY 2023 actual expenditures were approximately $131,000.00. Based
on the increasing CPI, costs for utility services (rate increases for utilities), and additional locations (as needed), the
requested amount of maximum spend has been increased.

utility services are critical for the continuation of County operations.

County, such as, Marco Island Historical Museum, Marco Island Library, Marco Island Recycling center, Immokalee
Airport and other locations, pumps, etc. The total FY 2023 actual expenditures were approximately $500,000. Based
on the increasing CPI, costs for utility services (rate increases for electric of approximately 10%), and additional
locations (as needed), the requested amount of maximum spend has been increased.
