A RESOLUTION PROVIDING FOR THE ESTABI.ISHMENT
OF A DRIVING RANGE CONDITIONAL USE nr THE A
ZONING DISTRICT PURSUANT TO SECTION rl.2.2.3.17
OF THE COLLIER COUNTY LAND DEVELOPMElIT CODE
FOR PROPERTY LOCATED IN SECTION 20, TOWNSHIP
51 SOUTH, RANGE 27 EAST, COLLIER COUIITY,
FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter
67-1246, Laws of Florida, and Chapter 125, Florida Statutes, has
,conferred on Collier County the power to establish, coordinate and
enforce zoning and such business regulations as are necessary for the
protection of the public; and

WHEREAS, the County pursuant thereto has adopted a Land
DQVelopment Code (Ordinance No. 91-102) which includes a Comprehensive
Zoning Ordinance establishing regulations for the zoning of particular
geographic diVisions of the County, emong which is the granting of
Conditional Uses; and
WHEREAS, the Collier County Planning Commissic,", being the dull

has held a public hearing after notice as in said regulations made an1

NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING APPEALS of
Collier County, Florida that:

be and the same is hereby approved for Conditional Use "17" of Section
2.2.2.3 of the "A" zoning district for a driving rimge in accordance
with the Conceptual Master Plan (Exhibit "B") and subject to the
'following conditions:
1) Prior to approval of any additional develo;pment orders,
the developer shall fully demonstrate tha'c the offsite
conveyance system has the capacity to acc~;pt the design
discharge and that the project has legal authorization to
connect to the conveyance.
2) The petitioner shall submit copies of any necessary state
or federal permits prior to Final site Dey,elopment Plan
approval.
3) Prior to issuance of a Certificate of OCC'llpancy, the
petitioner shall provide a fire hydrant within 250 feet
of the pro shop.

Prior to issuance of a Certificate of OCC'llpancy, the
petitioner shall provide a safety net along the U.s. 41
right-of-way if required by the Florida DeJ?artment of
Transportation.
Prior to site Development Plan approval, acces, and
egress for traffic on to Royal Palm Boulevard rom the
driving range shall be designed to prevent confJictn with
through traffic.
Prior to issuance of a Certificate of Occupancy, arterial
level street lighting is required.
Pursuant to Section 2.2.25.8.1 of the Land Development
Code, if, during the course of site clearing, excavation
or other construction activity an historic or
archaeological artifact is found, all development within
the minimum area necessary to protect the discovery shall
be immediately stopped and the Collier County Compliance
Servicec Department contacted.
