Staff recommendation: Based on the documentation provided, it is staff's opinion that Mr. Johnson does not meet the minimum experience and time requirements as set forth in Collier County Code of Laws and Ordinances Section 22183A.1 and 22183B.1 as related to the experience requirements under Section 22162, Carpentry Contractor. Accordingly, pursuant to Section 22184B, the application is being referred to the Contractor's Licensing Board for review and determination. Mr. Benjamin Johnson was sworn in and stated his name for the record. Staff representative Michael Bogert presented the application for licensure as a carpentry contractor requiring 48 months of qualifying experience. Verifications included three forms from 2000-2008 for skate park renovations and maintenance, plus a self-verification for 24 years in framing, trim carpentry, cabinetry, millwork, deck and fence construction, project supervision, customer service, and contracting. Staff opined he does not meet requirements due to limited experience beyond restricted skate park work; prior license was restricted to skate parks since 2008, relinquished in 2025, with a personal bankruptcy discharged in 2025. Mr. Juan Cervantes was sworn in and stated his name for the record. Staff representative Michael Bogert presented the application for journeyman electrician requiring 48 months as apprentice. Verifications included from Errol Santos (Kingdom Electric, Jan 2021-present: residential/commercial rough/trim, service troubleshooting/repair, project leadership, blueprint interpretation, new construction wiring) and educational certifications (year 1 apprenticeship completed May 28, 2025). Staff opined he does not meet requirements (lacks full 4-year approved apprenticeship; rule of thumb 6 years hands-on if not). Water treatment that does not require such equipment does not require a license. In addition, a license shall not be required for the cleaning of the pool or spa in any way that does not affect the structural integrity of the pool or spa or its associated equipment. The application submitted is for a license as a Swimming Pool/Spa Servicing/Repair Contractor. Rafael Aguilar, dlbla RL lnstallers, lnc. (hereinafter "Applicant") is before the Board for review of his credit score and a determination of whether the Applicant's credit should prevent the license from being issued to the Applicant. Page 296 of 385 1 Findings of Fact, Conclusions of Law and Decision of the Board Collier County Contractor Licensing Board For Applications Submitted to the Board for Review Type of Application: X Credit Report Review Waiver of Testing Requirements Reinstatement of License Request to Qualify Second Entity Other (specify) THIS CAUSE came on for public hearing before the Contractor Licensing Board (hereafter Board) on March 19, 2025, for review of RAFAEL AGUILAR”, dba RL lnstallers, lnc. (hereinafter “Applicant”) probationary status. The probationary status was imposed by the Board on August 16, 2023, due to the Applicant’s credit issues regarding his license as a Swimming Pool/Spa Maintenance and Repair Contractor. The Applicant is before the Board for review of his credit score and a determination of whether the Applicant’s credit will allow the lifting of the probationary status. The Board, having heard testimony under oath, received other evidence, and heard arguments relative to all appropriate matters thereupon, issues its Findings of Fact, Conclusions of Law and Order of the Board as follows: FINDINGS OF FACT 1. The Applicant applied to the Collier County Contractor Licensing Supervisor, for review of the probationary status on the Applicant’s certificate of competency. 2. Based on the credit report supplied by the Applicant to the Licensing Supervisor, a review of the creditworthiness of the Applicant by the Board is necessary. 3. The Applicant was present at the public hearing and was not represented by counsel. Page 297 of 385 2 4. The Applicant has demonstrated to the Board’s satisfaction that the Applicant has improved his creditworthiness to be issued the subject license subject to certain restrictions. CONCLUSIONS OF LAW 1. All notices required by the Code of Laws and Ordinances of Collier County, as amended, have been properly issued and the Board has jurisdiction over the matter. 2. Pursuant to the Board’s action on August 16, 2023, the Applicant was required to appear before the Board for review of his credit worthiness if his credit score was not above 660 at the end of the prior probationary period. 3. The Applicant has sufficiently demonstrated to the Board that he meets the credit worthiness standard(s) as set out in Code of Laws and Ordinances of Collier County, as amended, to retain his license as a Swimming Pool/Spa Maintenance and Repair Contractor subject to a continued probationary period. ORDER OF THE BOARD 1. Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted as applicable in Chapter 489, Florida Statutes, and Code of Laws and Ordinances of Collier County, as amended, by a vote of 6 in favor and 0 opposed, a unanimous vote of the Board present, subject license will remain on a probationary basis for an additional term of up to six (6) months. Within six (6) months the Applicant shall provide an updated credit report to the Contractor Licensing Supervisor, or his designee, evidencing an improved credit score with no new delinquencies or non-payments. If the credit score is 660 or greater the probationary term shall be automatically lifted. The contracted amount was for $285,000.00. An initial deposit of $25,000.00 was made by personal check 1139 on January 10, 2024. A second payment of $25,000.00 was paid by personal check 1144 on March 8, 2024. A third payment of $45,000.00 was paid by personal check 1160 on March 30, 2024. 7. On February 24, 2026, a review of County records revealed no building permits had been applied for or were issued for a barndominium at 2738 22nd Ave NE or 2742 22nd Ave NE. 8.On March 19, 2026, an in-person meeting was held with MR. MCNABB. He confirmed APEX SITE AND CONSTRUCTION CORP. had contracted with DAWN ANDERSON for $285,000.00 to build a barndominium and received 3 payments totaling $95,000.00. He also confirmed he holds only a demolition-wrecking contractor license and fence erection contractor license. 9.Dawn Anderson asserts damages totaling $95,000, representing funds paid under a contract deemed unenforceable due to unlicensed contracting, for which the contracted services were not performed. 10. Page 381 of 385 Sec. 22-201. -Misconduct-Collier County/city certificate of competency. The following actions by a holder of a Collier County/City Certificate of Competency shall constitute misconduct and grounds for discipline pursuant to section 22-202: (1) Knowingly combining or conspiring with an unlicensed contractor by allowing one's Certificate of Competency to be used by an unlicensed contractor with intent to evade the provisions of this Ordinance. When a licensed contractor acts as the qualifying agent for any firm without first making application under this Ordinance to represent said firm, such act shall constitute prima facie evidence of intent to evade the provisions of this Ordinance. When a certificate holder allows his certificate to be used by one or more companies without having any active participation in the operations, management, and control of such companies, such act constitutes prima facie evidence of an intent to evade the provisions of this Ordinance. Active participation requires job site supervision, knowledge of and participation in the business operations of the company(s), including all contractual matters. a. If any individual qualifying any business organization ceases to be affiliated with such business organization, he shall so inform the Board. In addition if such individual is the only certified individual affiliated with the business organization, the business organization shall notify the Board of the individual's termination and shall have no more than sixty (60) days from the date of termination of the individual's affiliation with the business organization in which to affiliate with another person certified under the provisions of this article. In any event, the business organization shall not enter into any new contracts and may not engage in any new contracting until such time as a qualifying agent is employed. (2) Contracting to do any work outside of the scope of his/her competency as listed on his/her competency card and as defined in this Ordinance or as restricted by the Contractors' Licensing Board. (3) Abandoning a construction project in which he/she is engaged or under contract as a contractor. A project may be presumed abandoned if the contractor terminates the project without just cause, or fails to notify the owner in writing of termination of the contract and basis for same, or fails to perform work for ninety (90) consecutive days without just cause and no said notice to the owner. (4) Diverting funds or property received for the execution of a specific contract project or operation or diverting funds earmarked for a specified purpose to any other use whatsoever. (5) Departing from or disregarding in any material respect the plans or specifications of a construction job without the consent of the owner or his duly authorized representative. (6) Page 382 of 385 Sec. 22-162. -Definitions and contractor qualifications. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Business organization means any partnership, corporation, business trust, joint venture, or other legal entity which engages or offers to engage in the business of contracting or acts as a contractor as defined in this section. Contracting means, except as exempted in this part, engaging in business as a contractor and includes, but is not limited to, performance of any of the acts as set forth in subsection (3) which define types of contractors. The attempted sale of contracting services and the negotiation or bid for a contract on these services also constitutes contracting. If the services offered require Ii censure or agent qualification, the offering, negotiation for a bid, or attempted sale of these services requires the corresponding Ii censure. However, the term "contracting" shall not extend to an individual, partnership, corporation, trust, or other legal entity that offers to sell or sells completed residences on property on which the individual or business entity has any legal or equitable interest, if the services of a qualified contractor certified or registered pursuant to the requirements of this chapter have been or will be retained for the purpose of constructing such residences. Contractor means the person who is qualified for and responsible for the entire project contracted for and, except for those herein exempted, the person who, for compensation, undertakes to, or submits a bid to, or does himself or by others, any or all of the following: construct, repair, alter, remodel, add to, demolish, subtract from, or improve any building or structure, including related improvements to real estate, for others, or for resale to others, as hereinafter defined in this section. (1) General contractor requires 48 months experience with a passing grade on an approved test and a business and law test and means a contractor whose services are unlimited as to the type of work which he/she may do, except as provided in this article or in the Florida Statutes. (2) Building contractor requires 48 months experience with a passing grade on an approved test and a business and law test and means a contractor whose services are limited to construction of commercial buildings and single-dwelling or multiple-dwelling residential buildings, which commercial or residential buildings do not exceed three stories in height, and accessory use structures in connection therewith or a contractor whose services are limited to remodeling, repair, or improvement of any size building if the services do not affect the structural members of the building.
