RESOLUTION NO. 89- 202
AUGUST 8. 1989
RELATING TO PETITION FDPO-89-5 FOR A FLOOD
VARIANCE FROM THE MINIMUM BASE FLOOD ELEVATION
REQUIRED BY THE FLOOD DAMAGE PREVENTION
ORDINANCE (ORD. 87-80)
WHEREAS, the petitioner Jack R. Bowers, of Ronta
Developments Marco, representing Royal Marco Developments
desires to build a pool cabana in Phsoe 3 of Marco Point
Condominium, being part ot Government Lot 4 ot SectIon 5, and
part of Government Lots J and 4 ot Section 6, Township S2
South, Range 26 East, at an elevation ot 6.5 teet (NGVD) and
has requested a variance from the Minimum Base Flood Elevation
required by Ord. No. 87-80; and
WHEREAS, the Board ot Zoning Appeals has held a public
hearing as required by law; has reviewed Petition FDPO-S9-S in
accordance with Section 18(5), (6) and (7), and has made a
finding that the granting of this petition complies with the
intent and purpose ot Ordinance 87-80 as tollows:
(5) The 5.5 toot reduction tx2m the Flood Insurance Rate
Map (FIRM) 12.0 feet National Geodetic Vertical Datum
(NGVO) requirement t2 6.5 feet NGVO is the minimum
variance necessary, considering the flood hazard, to
afford reliet.
(6) The variance is issued upon:
(a) A Showing ot good and autticient caua. ba.ed on
review ot considerations contained in (7),
following.
(b) A determination that failure to grant the
variance would result in exceptional hardship to
the applicant.
(c) A determination that the granting of a variance
will not result in increased flood height.,
additional threats to public safsty,
extraordinary public expense, create nuisances,
cause fraud on or victimization ot the pUblic,

employee thereof for any flood damaqes that result from
reliance on this variance or any administrative decision
lawfully made thereunder.
In accepting this variance, the petitioner assumes all
responsibility tor any property damage resulting trom its
application.
BE IT RESOLVED that thie resolution relating to Petition
Number FDPO-89-5 be recorded in'the minutes ot this Board.
