RESOLUTION OF TIiE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, AurnORlZING TIiE ACQUISITION OF ROAD R1GlIT .QF.W A Y, SlDEW ALK,
UTll.ITY, DRAINAGE, MAINTENANCE AND TEMPORARY CONSTRUCTION
EASEMENTS ANDIOR FEE SIMPLE TITLE BY GIFT OR PURCHASE WInCH
ACQUISITIONS ARE REQUIRED FOR TIiE SIX-l.ANJNG IMPROVEMENTS FOR
AIRPORT-PULLING ROAD (C.R. 3 J) BETWEEN PINE RIDGE ROAD (C.R. 896) AND
VANDERBILT BEACH ROAD (C.R. 862), CIE NO. 055; AND REPEALING RESOLUTION
NO. 96-130.
WHEREAS, lhe Board of County Commissioners (Board). on September 27, 1994 adopted
Ordil1lllCe No. 94-541herein establishing the 1994 (Sixth Annual) Capital Improvement Element of the
Growth Mana8ement Plan in order 10 establish priorities for the design, acquisilion and construction oflhe
variou. capital improvement projects which comprise Ihe Transportation Element of the County'.
Comprehensive Plan; and
WHEREAS.lhe six-laning roadway improvements 10 Airport.PuDing Road (C.R. 31) between
Pine Rid8e Road (C.R. 896) and V.nderbilr Beach Road (C.R. 862) sre componenl p.rts orlhe
Transportarion Element or tbe County's Comprehensive Plan; and
WHEREAS, a1tematelocations, environmental factors, long range planning, cost variables,
concurrence, safely and welfare consid....tions have been reviewed u they relllelo lhe implementation or
aajd transportation L,IYlu..'CmetIts; and
WHEREAS. it has been recommended by County SlaII'lhal it i. necessary and in lhe best interest
of CoDier County. Florida, 10 maintain some flexibility over lhe acquisition or certain property rights and
interests that are required for the construction or the six-Ianing roadway improvement. for Airport-PuDing
Road (C.R.31) between Pine Ridge Road (C.R. 896) and Vanderbilt Beach Road (C.R. 862), hereinafter
rererred 10 u "Project' u identified on Exhibit' A' attached hereto and inc:ot porsred herein by rererence;
and
WHEREAS, the daign and construction of said transportation inlp.o......nl. and rell1ed facilities
have been determined by the Board 10 be necessary and in the best interest ofCoDier County; and
WHEREAS, the construclion ofthe lransportalion improvement. and relaled faCllilies contem-
plaled by the Project are necessary in order to protect Ihe health, safely and welfare of lhe citizens or
CoDier County, and will wiJt CoDier County in meeting certain concurrency requirements of the Growth
Management Plan for CoDier County.

NOW, TIiEREFORE, BE IT RESOLVED BY TIiE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, thll;
I. The Board has considered lhe environmental factors, safely factors and economic consid.....ions
and factors relating to the location or the lransportation improvement. and relaled facililies.
2. The road right-of-way, sidewalk, utility, drainage, mainlenance and temporary construction
easement. and/or the fee aimpletirle acquisilions of certain property inlerest. are necessary for the
construction orthe Project. The acquisition or said easement. and/or ree simplelitle may all'ect certain
parceIa located immecrlllely adjacent 10 Airport.PuDing Road (C.R. 31) Project No. 62031 u .hown on
Exhibit ' A' IlIached hereto and made a part hereof.
3. The most fea.iblelocations, both necessary and consistent with the project requirements, in order to
permit the construction and maintenance orthe transportation improvements and rell1ed facilities for the
Airport.Putting Road (C.R. 31) between Pine Ridge Road (C.R. 896) and Vanderb"l Beach Road (C.R.
862), em No. 055, are imrned'lIIe1y adjacent 10 Ihe existing right-of'MY of Airport-PuDing Road (C.R.
31).
4. The Board has detmnined that the construction and maintenance of the six-laning Iransportation
in,~,umnents and rell1ed faa1ilies are necessary for a public purpose and i. in the best interest ofCoDier
County.
S. The construction and maintenance of the lransportation improvement. and rellled faCIlities are
compatible with lhe long range planning goal. and objectives or the Growth Management Plan for CoDier
County.
6. It is necessary and in the best interest ofCoOier County for the Board 10 acquire certain road right.
of-MY, sidewalk, UIlTrty, drainage, maintenance and temporary construction easement. and/or the fee
.imple title 10 certain properties and/or property interests localed immedillely adjacent 10 the existing
right-of-MY of Airport.PuIIing Road (C.R. 31).
7. County Sl4Ifis hereby authorized and directed to acquire by gift or purchase the petpetuaI,
IlOtHXClusive, road right-of.way, sidewaJk, utility, drainage, maintenance and lemporsry construction
-"maJU and/or fee simple titJe to certain properties located immedillely adjacent 10 lhe exilling right-of.
way of Airport.PuDing Rood (C.R. 31) forth< six.laning of Airport-Putting Road (C.R. 31). Said
acquisitions are necessary to constnJct the six-Ianing improvements to the Project. The acquisition of said
easements and/or fee simplelirle for lhi. Project shan be immediately adjacent 10 the existing right-of.way

and shall not exceed lhe required area u deemed appropriate on the Engineering Construction Plans for
the construction oflhi. Project. The existing right-of-way of Airport-PuDing Road (C.R.3 I) i. shown on
ExIu'bit ' A' IlIached hereto and incorporated herein.
S. The Chairman orthe Board i. hereby authorized ro execute Appraisal Agreement. with lhe
IJlIlnlsal lInn(.) selected tTom the list offirms pre-qualified by the Board of County Commi.sioners. The
Boerd fbrther direct.llall'lo UJC appraisal reports or internal compensslion estimates u SlaII'determines ia
DCCaIIIy 10 best serve the need. orthe Project in a timely and cost-effective manner.
9. The Board, in accordance with the provision. of Chapter 125.355, Florida Statutes, hereby formally
waives lhe requirement for a formal, independent apprsisal report for the purchue of a property where the
purd1ue pri.. or the pan:d (the c:ompensation due 10 the property owner) i.l... than One Hundred
Thouaand and 001100 DoOars (S I 00,000.00). In lieu of the independent apprsisal report, SlaII'ia hereby
authorized 10 malee purd1ue offl"tJ for lhe properties, lhe donar amounts of which shall be predicated 011
'lIaII'c:ompensatiOll estimates" based upon independent IJlIlnlsal. (and lhe data therefiom) obtained on
simIlar properties and upon consideration and application or appropriate marlcet value and cost data
pertinent 10 the subject ~
10. Upon the approval by the County AlIomey'. Offi.. of an documents necessary for the suq...
property acquisition, Real Property Management Department SlaII'is hereby directed 10 offer immediate
defwery 10 the respective property owners of the fun compensstion (u established by the appraisal or IIaII'
compensation estimates in accordance with the provisions of Chapter 125.355, Florida StatuIes). in return
for the inunediate and proper execution orthe reapeclive euementa, and such other JesaI documenu
and/or affidavits u lhe County AlIarney's Offi.. deems appropriale in order to protect lhe interests of the
County; and lhe Boerd hereby authorizes its present Chairman and any subsequent Chairman, ror the life of
the Project, 10 execute any instruments which have been approved by lhe Offi.. ofthe County Attorney, 10
remove the lien or any encumbnnce and for any such olher purpose u may be required for the acquired
road right-of.way, sidewalk. utility, drainsge, maintenance and lemporary COIlIIruction easement. and/or
fee aimplelirle for this Project.
II. In those instances where negotiated seltlementl may be obtained via the "Purchase AilC<>.....l" or
"Easement Agreement" mechanism. the Director of the Offi.. of Capital Projects Managemen~ or his
designee, ia charged with the fC5pol1ll'bl1ity for completion ofvariou. capital improvement projects, and ia
hereby delegated the authority to approve lhe purchase of land inlerests above the SlaII' compensation

estimale or appraised value and pay normally related COSI. when it i. in the best interest of the Project,
within the pro-rata share of the land right. acquisition budget for the parcel being acquired, only when the
ditl'eRnCe between the purchase price and compensation estimate or appraised value i.l_than Fift....

12. That lhe selIlement approval authority i. delegated by the Board to the extent that such approval.

13. The Chairman orthe Board i. hereby authorized 10 execute Euement Agreements and Purchue
Agt.......,ts where the land owner has agreed to sell the required land rights to lhe County II its appraised
value or II that amount considered lhe 'Administrstive SelIlement Amount' u such lerm i. internally used
by the adminillrllive aaencies or Cow.... County.
14. Where the property owner agrees, by agreement ('Purchase A&> ~.~It' or "Easement
Agt ecftle.Jf'), 10 convey a neceaa. t interest in real property 10 the County, and upon the proper execution
by the properly owner of those easement. or fee simple title, and such other legal documents u the Office
of the County AlIarney rnr/ require, the Board hereby authorizes the Finance Department 10 iuue
warrants, payable to the property owner(.) or record, in those amounts u shaJJ be specified on a closing
SlIIement and which shaJJ be hued upon the appraisal or stall' compensation estimlle in accordance with
thia RaoIulion and the proviaions ofSeclion 125.355, Florida SlIIutes.
I S. An lirIe 10 properties or interests in properties which have been obtained in the manner "..cribed
above shaJJ be deemed 'accepled' by the Board of County Commiasioners, u the governing body or
Comer County, Florida, a pofllieal subdivision of the Slate of Florida, and u ouch, lIItI'is hereby
authorized to record in lhe 0fficiaJ Rocords of Cottier County, Florida, said easements or fee simplelirle
and such other inatrumentJ u may be required to remove the lien of any encumbrsnce !Tom the acquired
properties.
16. This Rcaolution repeals and supenedes Resolution No. 96-130 in it. entirety.
