3/24/2026 Item # 11.A ID# 2026-602 Executive Summary Recommendation that the Board of County Commissioners, as the ex officio Governing Board of the Collier County Water-Sewer District, award Request for Professional Services No. 25-8374 to Mitchell & Stark Construction Company, Inc./Johnson Engineering for Design-Build Services for the Northeast Service Area Utility Expansion Project for the Guaranteed Maximum Price of $50,499,000.00, with an Owner’s Allowance of $2,524,950.00 (for a total Contract Amount of $53,023,950.00), approve the necessary Budget Amendments and authorize the Chair to sign the attached Agreement. (Project 70194) (This item is a companion to Item 11B) OBJECTIVE: The public purpose is to continue providing reliable, sustainable utility services for the Collier County Water-Sewer District (the "CCWSD"). This action is to award a contract to design and build water, wastewater and fiber optic expansion from the Town of Big Cypress to Horse Trials and other developments along Oil Well Road in the Northeast area. CONSIDERATIONS: This project expands utility and fiber infrastructure from east of the Town of Big Cypress to west of State Road 29. The selected firm will be responsible for providing services required to expand the utility and fiber infrastructure to future developments in this area. The scope of work includes the installation of approximately 110,000 feet of water, wastewater, and fiber optic infrastructure along Oil Well Road, the construction of pump stations at the Camp Keais utility site, and a water quality monitoring panel at the Horse Trials utility site. On July 8, 2025 (Agenda Item 11.G), the Board approved the Northeast Interim Facilities Program and associated resourcing strategy, providing the capacity to execute the Program. On September 9, 2025 (Agenda Item 16.C.3), the Board approved an agreement between Collier Land Holdings, LTD and CDC Investment Properties, LLC, and the CCWSD, to provide potable water and wastewater services within the Horse Trials Stewardship Receiving Area and make the connections available to the Developer by December 31, 2028. On December 9, 2025 (Agenda Item 9.B), the Board approved a Resolution establishing the Horse Trials Village Stewardship Receiving Area to allow development of 3,205 dwelling units. On February 10, 2026 (Agenda Item 16.C.1), the Board approved the selection committee’s ranking and authorized staff to begin negotiations with the top-ranked firm, Mitchell & Stark Construction Company, Inc./Johnson Engineering (“M&S”). On March 31, 2025, the Procurement Services Division issued Request for Professional Services No. 25-8374 Design Build Services for the Northeast Service Area Utility Expansion – Step 1. The County received three proposals by the May 1, 2025, submission deadline. The base Guaranteed Maximum Price (the "GMP") as bid was $50,499,000.00; the bid Contract amount also includes an Owner’s Allowance of $2,524,950.00, for a total Contract Amount of $53,023,950.00. On February 12, 2026, Staff began contract negotiations with M&S. During negotiations, Staff and M&S discussed the Design Criteria Package, Technical Proposal, and 30% plans, and concluded that no changes or modifications are needed; accordingly, the current GMP is accepted and will serve as the basis for the Contract award. Utilization of the Owner’s Allowance is subject to the County’s approval. Reimbursement to the contractor is only eligible when memorialized in a written Change Order by the parties. Staff recommends that the Board approve the attached Agreement with Mitchell & Stark Construction Company, Inc./Johnson Engineering in the total Contract Amount of $53,023,950.00, which includes the Owner’s Allowance, to provide services required to complete the project. County staff originally estimated the budget for this project to be $55,000,000. M&S’s GMP is approximately 4% less than the County’s estimated budget for the work. M&S included a project schedule within its proposal. This schedule confirms that it will begin the project no later than May 2026 and complete all construction activities by the contractual completion date outlined in the agreement between Collier Land Holdings, LTD and CDC Investment Properties, LLC, and the CCWSD to provide water and wastewater Page 270 of 6641 3/24/2026 Item # 11.A ID# 2026-602 services within the Horse Trials Stewardship Receiving Area and make the connections available to the Developer by December 31, 2028. The Board's approval of this item will also be an acknowledgment of the cost reasonableness of the contract amount based upon staff's competitive negotiation as required by the Consultants Competitive Negotiations Act, Florida Statute §287.055. This item is consistent with the Collier County strategic plan objective to plan and build public infrastructure and facilities to effectively, efficiently, and sustainably meet the needs of our community. It further is in support of the Infrastructure and Asset Management Strategic Focus Area’s objectives to optimize the useful life of all public infrastructure resources through proper planning and preventative maintenance. This item is aligned with the Annual Update and Inventory Report and other planning tools that establish and implement plans for availability and adequacy of public facilities and remain in compliance with all regulatory requirements. FISCAL IMPACT: Funding in the amount of $53,023,950 is required to award the Design-Build Services for the Northeast Service Area Utility Expansion Project (70194), which includes the $50,499,000 bid amount and $2,524,950 owner's allowance. The sources of funding include bond proceeds, commercial paper, and/or impact fees. Available funding within County Water-Sewer Bond #2 Proceed (Fund 4019) totals $2,400,214.29. A budget amendment of $50,623,735.71 is required to fully fund the project as outlined below. This amendment will close the remaining funding gap. Project costs supported by commercial paper are anticipated to be refinanced through a future long-term, fixed interest rate bond issuance.
