Executive Summary
Recommendation to approve the release of a code enforcement lien with an accrued value of $122,850 for a reduced
payment of $4,736.60 in the code enforcement action titled Board of County Commissioners vs. Theodore Canales, in
Code Enforcement Board Case No. CESD20150024661, relating to property located at 1402 Orange St., Folio
#30681960005, Immokalee, Florida.
OBJECTIVE: For the Board to accept an offer to release a code enforcement lien with an accrued value of
$122,850 for a reduced payment of $4,736.60 in relation to Code Enforcement Board Case No. CESD20150024661.
CONSIDERATIONS: In Case No. CESD20150024661, the Code Enforcement Board ordered the imposition of a lien
against property located at 1402 Orange St., Immokalee, Florida, Folio #30681960005 and owned by Theodore Canales.
The violation consisted of renovating the interior and exterior of a single-family residence prior to issuance of a building
permit (Part B) or Certificate of Completion (Part C).
The lien was recorded in the Official Records on December 7, 2017, at O.R. Book 5456, Page 509-511, in the amount of
$53,759.63. Fines continued to accrue, therefore the lien amount of $122,850, is based on 30 days of accrued fines
($150 per day from September 26, 2016, through October 25, 2016), totaling $4,500 (Part B), and 789 days of accrued
fines ($150 per day from December 25, 2016, through February 21, 2019), plus operational costs of $59.63, totaling
$118,350 (Part C); Fines continued to accrue totaling $122,850. The owner brought the property into compliance by
obtaining Permit #PRBD20160832415 (Part B), and a Certificate of Completion (Part C) was issued on February 21,
2019.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose severe financial hardship on the owner. Adam Canales inherited the property from his father, Theodore
Canales, who was deceased when the County initiated the code enforcement proceeding. Mr. Canales obtained a
Certificate of Completion to bring his father’s property into compliance. Adam Canales’ widow, Reyna Canales, became
aware of the fines after she inherited the property via Personal Representative’s Deed recorded on July 21, 2025, in O.R.
Book 6490, Page 1373-1374. The property is being actively maintained, and the owner offers to pay $4,736.60 to settle
$122,850 in accrued fines. The payment of $4,736.60 is ten percent of the Collier County Property Appraiser’s Assessed
Value of $47,366 and meets the criteria outlined in Resolution 2023-90. There are currently no known violations on the
property.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of a payment of $4,736.60 to settle the lien will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution
2023-90. RTT
RECOMMENDATION(S): To approve the recommended reduction of fines in the amount of $118,113.40, accept
payment in the amount of $4,736.60, release the lien, and authorize the Chairman to sign the attached release and
satisfaction of lien for recording in the Official Public Records.
