COLLIER COUNTY SPECIAL MAGISTRATE
Naples, Florida, January 9, 2026
LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted
business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative
Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the
following persons present:

The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those
testifying at the proceeding did so under oath.

Prior to conducting the Hearing, Respondents were given an opportunity to speak with their
Investigating Officers for a Resolution by Stipulation. The County’s goal is to obtain compliance
without being punitive.

including, but not limited to the following: interior renovations, deletion of

Officer Marinos represented the County.
Officer Pitura represented the County testifying the violation has not been abated amassing fines
and costs in the amount of $9,912.30.
Mr. Johnson testified:
• There is only one minor item remaining to finish abating the violation involving installation
of an electrical component which is anticipated to be delivered Monday and installed over
the following days.
• County and Florida Power and Light inspections will occur to finalize the permits.
• All other issues have been addressed, and the Respondent has acted diligently in abating the
violation.
• Other violations on the property were abated in a timely manner including those issued on:
• 3/11/24 – Compliance 6/7/24
• 2/26/24 – Dismissed
• 3/25/24 – abated via stipulation
• 3/5/25 - Dismissed
• The Respondent has incurred cost in excess of $250,000 abating the violation.
• There is a case scheduled for a Motion for Imposition of Fines and Liens later in the
Agenda for the violation and he requested this item be heard and the case closed out today.

Manager Letourneau objected to the case being closed out before a Certificate of
Occupancy/Completion is issued by the County. The requirement is in the Order for the case and

there’s been instances where the County closed out a case with a minor item remaining to be
abated and the Respondent did not complete the work necessary to finalize the permit. He did not
object to a Continuance in the case.
Special Magistrate Neale CONTINUED the case to the March 2026 Special Magistrate hearing
date with fines ceasing to accrue. Operational Costs of $112.05 to be paid within 30 days of this
hearing.

Henry Johnson, Attorney and Kristen Jasinski represented the Respondent.
Mr. Johnson testified:
• He has provided a 3-ring binder of detailed information on all the efforts taken by the
Respondent to abate the violation and requested no fines be imposed in the case.
• The Respondent worked diligently to abate the violation, which was a large effort including
engaging consultants, obtaining permits, constructing a new structure and demolishing the
old one related to the well equipment.
• On 7/28/25 she sent an email to the County expressing concerns about their delays related
to reviewing the permit application.
• Another email was sent to County Staff Member Myra Jacobs on 10/7/25 questioning the
status of inspections requested with no response for 10 days.
• In hindsight, the timeframe allotted to abate the violation should have been longer given the
parameters of the case.
• The gravity of the violation was not significant, and prompt action was taken by the
Respondent, but the activities were dependent on the performance of other parties.
• He reiterated the request for no fines being imposed in the case.

Officer Marinos testified a new pump house was constructed and the existing one could have been
removed sooner, but the Respondent chose to wait until the new one was completed.
Director Iandamarino noted the Respondent is a General Contractor and should have known the
time frame involved to abate the violations.
Ms. Jasinski testified the existing pump house originally conformed to the setback requirements in
the zoning district however the property was subdivided, which created a setback issue when the
new property line was created. The existing structure needed to remain until the electrical
equipment could be relocated as it could not be exposed to the elements.
Special Magistrate Neale, after hearing the testimony and considering the factors in the case,
took the case UNDER ADVISEMENT given the substantial amount of material submitted as
evidence in the case.

Special Magistrate Neale, after hearing the testimony and reviewing the evidence, found the
Respondent GUILTY of the alleged violation and was ordered to:
1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case
within 30 days of this hearing.
2. Obtain all required Collier County Site Plans, Building Permit(s) or Demolition Permit
Inspections and Certificate of Completion/Occupancy for the placement of the inert waste as
fill or remove the inert waste/fill from the property within 60 days of this hearing or a fine of
$200.00 per day will be imposed each day the violation remains.
3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct
a final inspection to confirm abatement. If the Respondent fails to abate the violation the
County may abate the violation and may use the assistance of the Collier County Sheriff’s
Office to enforce the provisions of this agreement and all costs of abatement shall be assessed
to the property owner.

vegetation removed from lot and fill brought into lot without issuance of
appropriate Collier County permits or other approvals.

Officer Packard and Assistant County Attorney Ronald Tomasko represented the County.
Officer Packard reported the Respondent is seeking a Continuance in the case.
Ana Gitli, Attorney represented the Respondent and testified:
• The existing activity on the land is being reviewed by the Florida Department of
Agriculture and Consumer Services to determine if the operation on the property constitutes
a bona fide agricultural use.
• If it is determined the property qualifies for agricultural use, there may be no County
violations occurring onsite.
• An imposition of fines by the Special Magistrate may be premature as if it is determined no
violation exists on the property, a decision today would need to be vacated.
• The Department has until February to issue a determination without delay as they have
already requested additional information on the matter from the South Florida Water
Management District and others and conducted a site visit.
• She requested a continuance in the case until the March Special Magistrate hearing date.
Officer Packard testified even with a bona fide agricultural use determination, the County
should be provided notice of clearing activity. A notice has not been filed with the County.
Assistant Attorney Tomasko testified the Notice of Violation was issued by the County on
January 13, 2023 and the Respondent entered into a Stipulation with the County on June 7, 2024
admitting to a violation. A notice of clearing is still required with agricultural use.
Ms. Gitli testified a determination by the State may protect certain activities under the Right to
Farm Act and the case should be delayed until a decision is rendered. If it is determined no
violations of County standards occurred, the Stipulation may not be valid.
Special Magistrate Neale, after hearing the testimony CONTINUED the case to the March 2026
Special Magistrate hearing date with fines continuing to accrue. Prior to the hearing date the
parties shall submit a brief on their position on the requirements for obtaining County permits
for the activity on the property and/or providing notice to the County of land clearing on the
parcel whether or not the Florida Department of Agriculture and Consumer Services determines
the operation is a bona fide agricultural use. Operational Costs of $112.40 to be paid within 30
days of this hearing.
Special Magistrate Neale reported this will be the final continuance granted in the case.

attached. A wood porch attached to one of the mobile homes. A shed/storage

these structures/improvements.

vehicles, tow campers/trailers, open style landscape trailers, auto trailers, boats,
and boat trailers.

Officer Joseph represented the County and reported permits need to be issued for the first case.
Mr. Markel testified they want to abate the violation, but it is taking longer than anticipated.
Discussion occurred on the status of the case with the Manager Letourneau noting there was a
permit application filed and a “correction letter” issued on July 14, 2025 with no response. He
recommended the Respondents obtain a copy of the letter from Growth Management Division staff
so they may begin addressing the items so the permit may be issued.
Officer Joseph noted the Respondent still has until March 7th to obtain compliance in the cases.
Director Iandamarino noted there is another case involving the Respondent and recommended
the Extension for the cases be consolidated for logistics purposes.
Special Magistrate Neale Granted and Extension of Compliance Deadline for the following
cases to the April 2026 Special Magistrate hearing date: CEV20250005226, CESD20250005262
and CENA2025000294. Operational Costs of $223.55 to be paid within 30 days of this hearing.

Officer Phillips testified:
• The Vanderbilt Beach Parking Garage is available for public parking but restricted to beach
goers either paying a fee or displaying a County parking sticker.
• There are 2 signs at the entrance of the garage notifying users the facility is for beach
parking only.
• He observed the vehicle in question parked in the garage and the driver dressed in work
clothes, exiting the facility and entering a construction site.
• Two warnings were issued to the Respondent and a pamphlet was provided on the standards
for utilizing the garage for parking.
• As the activity continued and a total of 4 Citations were issued for violation of the County
Ordinance.

Marchelson Pasterin testified:
• He is a Collier County resident and has a beach parking sticker displayed on his vehicle
which gives him the right to utilize the facility.
• He acknowledges he did not utilize the beach during the times he parked in the facility and
expressed concern over selective enforcement as other employees of local restaurants
utilize the facility in the same manner without being issued a Citation.
Special Magistrate Neale noted the only matter for his consideration is the case being presented
today.

Manager Perez noted the fines for the Citations are as follows; 1st Offense - $100.00; 2nd Offense -
$200.00; 3rd Offense - $300.00; 4th Offense - $400.00. There is also Operational Costs of $50.00
and $7.00 Administrative fee associated with each case.
Special Magistrate Neale after hearing the testimony and reviewing the evidence, UPHELD
issuance of the Citations and ordered the Respondent to pay $1,000.00 in fines, $200.00 in
Operational Costs and a $28.00 Administrative fee for a total amount due of $1,228.00. Said
amount to be paid within 30 days of this hearing.

Officer Musse represented the County and testified:
• The Notice of Violation was issued on April 22, 2025 following a site inspection earlier in
the month where the damage fence was observed.
• The owner indicated they would be addressing the issue and on 8/18/25 a permit application
was filed with the County.
• The permit was denied and the owner obtained a new survey and resubmitted an application
on 12/10/25 which is in rejected status.
• There is a vinyl fence pool barrier in place which is not compliant with County codes

• On 9/3/25 Mr. Fagnano notified him the contractor engaged for the work did not have the
proper licenses and it was determined a marine contractor was required to perform the
work.
• The violation has not been abated.

Jacob Fagnano represented the Respondent and testified he is working with consultants on the
options for the docks which include repairing or replacing them.
Discussion occurred noting access to the docks in disrepair is an attractive nuisance and could
result in serious injury to individuals. It was determined access to the area should be restricted
until the violation is abated.
Special Magistrate Neale, after hearing the testimony and reviewing the evidence, found the
Respondent GUILTY of the alleged violation and was ordered to:
1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case
within 30 days of this hearing.
2. Install all necessary barriers to restrict entrance to the property and any fencing necessary
to restrict access to the seawall area of the parcel within 14 days of this hearing or a fine of

• The mobile home improvements passed the necessary inspections, but when the inspector
visited the site, he noted the replacement of the carport roof occurred a few days prior and
was incorporated into the existing permit so it could not be closed out.
• Efforts are underway to separate the mobile home permit from the carport so a Certificate
of Occupancy/Completion may be issued as the inspections have been completed.
• A “correction letter” has been issued for the carport work

Margarita Granados was present and Cindy Granados acted as interpreter and confirmed the
mobile home improvements passed all the inspections and the carport roof was falling in and

business. He is in the process of obtaining a site plan amendment.
