In addition to DSAC, the impact fee studies were presented to the Collier County Productivity Committee and the Collier Building Industry Association (CBIA). All other input and comments received from stakeholders were thoroughly reviewed, and minor adjustments were made where appropriate to ensure that the data, methodology, and resulting fee calculations remain technically sound and legally defensible. In accordance with the notice period requirements of Section 163.31801(4)(d) Florida Statute (The Florida Impact Fee Act), the effective date for all rate schedule decreases shall be February 1, 2026, for phase one, and the effective date for all rate schedule increases, new and/or replacement land use category rates shall be delayed to May 1, 2026, for phase two; May 1, 2027, for phase three; May 1, 2028, for phase four; and May 1, 2029, for phase five. Staff also developed a structured update schedule to ensure consistent adjustments to impact fees rather than infrequent and potentially substantial increases or decreases. This schedule would allow for any decreases in fees to be implemented promptly, ensuring that the financial burden on new developments is adjusted as soon as possible to reflect any cost reductions. WHEREAS, Collier County uses impact fees to supplement the funding of necessary capital improvements required to provide public facilities to serve new population and related development that is necessitated by growth in Collier County; and WHEREAS, Collier County has used impact fees as a funding source for growth-related capital improvements for various facilities since 1978; and WHEREAS,on March 13, 2001, the Board of County Commissioners adopted Ordinance No. 2001-13, the Collier County Consolidated Impact Fee Ordinance, repealing and superseding Underlined text is added; through text is deleted Page 1 of 100 9E all of the County's then existing impact fee regulations,and consolidating all of the County's impact fee regulations into that one Ordinance, codified in Chapter 74 of the Collier County Code of Laws and Ordinances (Code); and WHEREAS, on December 10, 2019, the Board of County Commissioners adopted Ordinance No. 2019-48 for the adoption of the Road Impact Fee Update Study thereby updating the current Road Impact Fee rates; and WHEREAS, on November 10, 2015, the Board of County Commissioners adopted Ordinance No. 2015-59 for the adoption of the Collier County Parks and Recreation Impact Fee Update Study thereby updating the current Collier County Community and Regional Parks Impact Fee rates; and WHEREAS, on February 10, 2015 and corrected on December 10, 2015, the Board of County Commissioners Ordinance No. 2015-17 for the adoption of the Collier County Correctional Facilities Impact Fee Update Study thereby updating the current Collier County Correctional Facilities Impact Fee rates; and WHEREAS, on November 10, 2015, the Board of County Commissioners adopted Ordinance No. 2015-60 for the adoption of the Collier County School Impact Fee Update Study thereby updating the current Collier County School Impact Fee rates; and WHEREAS, on April 25, 2017, the Board of County Commissioners adopted Ordinance No. 2017-13 for the adoption of the Collier County Emergency Medical Services Impact Fee Update thereby updating the current Collier County Emergency Medical Services Impact Fee rates; This chapter and the impact fee studies should be reviewed in accordance with F.S 163.31801.at least every three years.All reviews shall consider new estimates of population and other socioeconomic data; changes in construction, land acquisition and related costs and adjustments to the assumptions, conclusions or findings set forth in the studies adopted by section 74-106. The purpose of this review is to evaluate and revise, if assure that they do not exceed the reasonably anticipated costs associated with the improvements and additions necessary to offset the demand on the public facilities generated by development. Article II, Impact Fee, Section 74-201 Imposition of impact fees,of the Collier County Code of Laws and Ordinances is hereby amended to read as follows: *** (h)Impact Fee Installment Payment Pilot Program. *** (9) For purposes of this subsection the following conditions shall apply: a. A feepayer must be the legal owner of the property,or designated agent of the owner, and shall provide written and notarized proof of authorization from the owner when requesting to pay impact fees under this subsection; and b. The feepayer and/or owner must be current on property taxes on the subject property and any other real property owned in Collier County by feepayer and/or owner; and c. The feepayer and/or owner cannot be in bankruptcy nor can the property be an asset in any bankruptcy proceeding; and d. The subject property cannot be in foreclosure and cannot have any federal income tax lien,judgment lien or similar liens encumbering the property. e. This program shall be available only to entities that exclusively provide services to citizens of the United States or to lawful permanent residents thereof. Eligibility under this provision shall be demonstrated to the satisfaction of the County, and sufficient proof thereof shall be provided as a condition of participation in the program. SECTION FIVE. Appendix A,of Chapter 74 of the Collier County Code of Laws and Ordinances is hereby amended as set forth in the attachment to this Ordinance. In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions. SECTION SEVEN. INCLUSION IN THE CODE OF LAWS AND ORDINANCES. The provisions of this Ordinance shall be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-lettered and internal cross-references amended throughout to accomplish such, and the word "ordinance" may be changed to "section," "article,"or any other appropriate word. SECTION EIGHT. EFFECTIVE DATE. This Ordinance shall be considered adopted upon the date written below and subject to filing with the Florida Department of State; however, for administrative purposes the effective date for all rate schedule decreases shall be February 1, 2026 and the effective date for all rate schedule increases, new and/or replacement land use category rates shall be delayed to May 1, 2026, for phase one; May 1, 2027, for phase two; May 1, 2028, for phase three; and May 1, 2029, for phase four in accordance with the notice requirements set forth in Section 163.31801(4)(d), Florida Statutes. In addition to DSAC, the impact fee studies were presented to the Collier County Productivity Committee and the Collier Building Industry Association (CBIA). All other input and comments received from stakeholders were thoroughly reviewed, and minor adjustments were made where appropriate to ensure that the data, methodology, and resulting fee calculations remain technically sound and legally defensible. In accordance with the notice period requirements of Section 163.31801(4)(d) Florida Statute (The Florida Impact Fee Act), the effective date for all rate schedule decreases shall be February 1, 2026, for phase one, and the effective date for all rate schedule increases, new and/or replacement land use category rates shall be delayed to May 1, 2026, for phase two; May 1, 2027, for phase three; May 1, 2028, for phase four; and May 1, 2029, for phase five. Staff also developed a structured update schedule to ensure consistent adjustments to impact fees rather than infrequent and potentially substantial increases or decreases. This schedule would allow for any decreases in fees to be implemented promptly, ensuring that the financial burden on new developments is adjusted as soon as possible to reflect any cost reductions.
