Luigi Bruno Caruso Design & Build LLC. Review of Experience. Staff recommendation: Based on the documentation provided, it is staff's opinion that Mr. Caruso does not meet the minimum experience and time requirements as set forth in Collier County Code of Laws and Ordinances Section 22183A.1 and 22183B.1 as related to the experience requirements under Section 22162, Registered General Contractor. Accordingly, pursuant to Section 22184B, the application is being referred to the Contractor's Licensing Board for review and determination. Mr. Luigi Bruno Caruso was sworn in and stated his name for the record. Staff representative Michael Bogert presented the application for licensure as a registered general contractor requiring 48 months of qualifying experience. Verifications included from Giovanni Garcia (Garpe INV Corp., June 2021- present, project manager), Marlee Hagerstrom (Sterling Build LLC, August 2022- January 2025, project manager superintendent), and Nicholas Rodriguez (RCI Enterprise Group, Inc., August 2022-present, project manager). Five reference letters recommended Mr. Caruso. Staff opinion he does not meet requirements. Mr. Caruso discussed his experience, noting full-time roles with Sterling Build and bouncing between GARP and RCI, parting ways with Sterling Build, primarily residential new builds and remodels, some commercial remodels. He agreed with the county's assessment for general contractor but felt suited for residential. He withdrew his application for general contractor to pursue residential instead. No vote needed. Extended details include questions on full- time jobs, types of work (three residential new builds in Lee County), background in interior design since 2008 working on hospitals and clubhouses under designers, not contractors. Accordingly, pursuant to section 22184B, the application is being referred to the contractor's licensing board for review and determination. Mr. Rafael Diaz-Gonzalez was sworn in and stated his name. Mr. Bogert presented the application for glass and glazing contractor requiring 24 months experience. Page 5 of 73 December 17, 2025 Page 4 Verification from Gregory Villanueva (Villas Windows and Doors Services LLC, April 2015-December 2017, installer/crew leader). Staff opined he does not meet requirements. Mr. Gonzalez explained working at Villas for over two years as installer then manager, installations and helping manage projects, new construction and 40% restoration, familiar with brands like Anderson, Lohen, PGT, ES. Board read scope requiring glass cutting, installation of shutters, etc. Mr. Gonzalez discussed his company Seaside Restoration and Coatings, technical representative for manufacturers, minimal deglazing, no hurricane shutters or shower glass. Motion to deny by Richard Joslin; second by Stephen Jaron. Motion carried unanimously 7-0. Mr. Jesus Garcia was sworn in and stated his name. Mr. Bogert presented the application for registered residential contractor requiring 48 months experience. Verification from Ray Lane (Acadian Inc., 2019-2025, superintendent). One reference letter. Staff opined he does not meet requirements. Mr. Garcia discussed six years at Acadian Builders, 10-15 new homes and remodels, monolithic slabs, footers, rebar, trenches, block installation, trusses, sheathing (three-quarters CDX plywood), involved from start to finish, hands-on with subs (digging trenches, running steel), left in February, real estate license, working with family painting company and Design West. Motion to approve by Kyle Lantz; second by Matthew Nolton. Motion carried 6-1. Reinstate Permit Privileges. Staff recommendation: Due to progress and conversations with county staff, recommend extending the suspension for another 30 days with appearance before the board. Peter Kelly (Kallin Construction) was sworn in. Mr. Bogart summarized the September 17, 2025, stipulated settlement for complaint 2025-09, requiring new/ revised permit PRMFH2023-0416452 within 60 days or suspension. Mr. Kelly missed the deadline but showed progress. His attorney explained delays due to client's back surgery, old construction requiring new protocols, fire permit submission error causing weeks delay, work completed but permits not closed, viewed as remodel initially. Motion to extend suspension 30 days or to next meeting (January 21, 2026), with return if not completed by Matthew Nolton;. Motion carried unanimously 7-0. Mr. Bogert summarized March 19, 2025, revocation for willful code violation, September 17, 2025, request for reinstatement, but no formal rehearing possible. Lori discussed owner taking permit as owner-builder, final electric passed except barrier (fence failed self- latching/closing), canceled screen enclosure. Owner Ledion Leka sworn in, disputed access denial, noted communication proofs, fraud case involvement, paid 95% for enclosure not completed, took over permit, fence inspection failed latching, pool used without CO. Chris clarified contract issues, pool filled without enclosure contract, access limited to Sundays/Mondays due to rentals, willing to install fence or refund. Eric Borges (father, owner) sworn in, defended as 35-year plumber, emergency sewer backup, replaced Y seven feet under slab, like-for-like, delays in finding engineer, portal issues, not willful. Doug Sposito sworn in, explained initial permit issued without tunneling, inspector found tunneling, required plans, engineer must supervise, current submission rejects supervision. CONCLUSIONS OF LAW '1. The facts as alleged and set forth in the Adminiskative Complaint as to Count I were supported by competent and substantial evidence and this evidence provided clear and convincing proof that the Respondent committed the 1 violation as set forth in the Administrative Complaint. 2. The Respondent violated Code of Laws and Ordinances of Collier County, Florida, Sec 22- 201 in the performance of Respondent's contracting business in Collier County by acting in violation of the sections set out with particularity in the Administrative Compliant. 3. That Respondent is licensed as a state certified SWIMMING POOLiSPA TMAINTENANCE AND REPAIR Contractor, License Number LCC20230002495 and the qualifier of record for SUNSHINE POOLS OF NAPLES, LLC 2. Thal the Board of County Commissioners of Collier County, Florida, is the complainant in this matter. 3. Thatthe Board has jurisdiction overthe Respondent, the Respondentwas present at the public hearing, and Respondent was not represented by counsel. 4. The Respondent had the aforementioned Order entered by the Board on March 19,2025. 5. Based upon the testimony presented by the Respondent, Respondent's husband and business partner, and the owner of the property, Ladios Leka, the Board determined that the Respondent's request was a timely request for rehearing on this matter. CONCLUSIONS OF LAW 1. The Order entered on March 19,2025 is valid and in full force and effect. 2. The Respondent has presented adequate evidence and testimony to permit the Board to find a rehearing is appropriate and justified in this matter. 3. The Petitioner presented testimony and evidence, including a statement from the County's Building Official that the actions of the Respondent constituted a willful code violation. 8. The allegations of fact as set forth in the Administrative Complaint are true and therefore such facts are hereby found to be supported by competent, substantial evidence presented at the hearing. CONCLUSIONS OF LAW 1. The facts as alleged and set forth in the Administrative Complaint as to Count I were supported by competent and substantial evidence and this evidence provided clear and convincing proof that the Respondent committed the one violations as set forth in the Administrative Complaint. 2. The Respondent violated Code of Laws and Ordinances of Collier County, Florida, Sec 22- 201 in the performance of Respondent's contracting business in Collier County by acting in violation of the sections set out with particularity in the Administrative Compliant. 3. Colller County has jurisdiction over this matter and the Respondent. Page 3 of 8 4275291 1114t2016 ORDER OF THE BOARD Page 68 of 73 Based on the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 489, Florida Statutes, and the Code of Laws and Ordinances of Collier County, Florida, by a vote of 9 in favor and 0 opposed, a unanimous vote of the Board members present and voting, the Board finds Respondent guilty of misconduct by a holder of a Collier County Certificate of Competency to wit as to Count l, Collier County Code of Laws and Ordinances Section 22-201 .1 (2), which states, in pertinent part, that it is misconduct by a holder of a State of Florida license to willfully violate the applicable building codes or laws of the state, city, or Collier County. Upon motion made and seconded and consideration of the following factors; 1. Gravity of the violation, 2. lmpact of the violation, 3. Any actions taken by the violator to correct the violation, 4. Any previous violations committed by the violator, 5. Any other evidence presented at the hearing by the parties relevant as to the sanction that is appropriate for the case given the nature of the offense, by a vote of 8 in favor and 1 opposed, a majority vote of the Board members present and voting, the Board hereby imposes the following disciplinary sanction(s) upon the Respondent: '1 . As to Count '1 , the Respondent is ordered to reinstate the Right of Way permit and complete the subject project within 60 days or his permit pulling privileges will be suspended and Respondent will be called to appear before the Board.
