RESOLUTION FOR PETITION AV 96-034 TO VACATE,
RENOUNCE AND DISCLAIM THE RIGHTS OF THE COUNTY
AND THE PUBLIC TO A PORTION OF THE ROAD RIGHT-
OF-WAY INTERESTS IN A PORTION OF AN EIGHTY
FOOT (80') ROAD RIGHT-OF-WAY PLATTED AS TRAIL
BOULEVARD ON THE PLAT OF TilE PINE RIDGE SECOND
EXTENSION, AS RECORDED IN PLAT BOOK 10, PAGE
86, OF THE PUBLIC RECORDS OF COLLIER COUNTY,
FLORIDA

WHEREAS, pursuant to Sections 177.101, 336.09 and J36.10,
Florida Statutes, George L. Varnadoe as agent for owner(s) and
Petitioner, Barron Collier Partnership, requesting that the Board
vacate, renounce and disclaim the fee simple or easement rights of
the county and the public in a portion of an eighty foot (80') road
right-of-way platted as Trail Boulevard, as recorded in Plat BOOK
10, Page 86, in the Public Records of Collier County, Florida; and
WHEREAS, the Board has this day held a public hearing to
consider such action regarding the road right-ot-way interests in
a portion of an eighty foot (80') road right-of-way known as Trail
Boulevard being more fully described below, and notice of sald
public hearing to vacate, renounce and disclaim the County's fee
simple or easement interests in the road right-of-way was given as
required by law; and
WHEREAS, the Board finds that the portion of Trail Boulevard
being vacated is no longer needed for the public use and benefit;
and
WHEREAS, the granting of the petition will not adversely
affect the ownership or right of convenient access of other
property owners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's fee
simple or easement interests in a portion of the eighty foot (80')
right-Of-way of Trail Boulevard, as more particularly described in
Exhibit A and depicted in Exhibit B attached hereto and
incorporated herein, are hereby vacated.
BE IT FURTHER RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, that Collier County reaerves unto itself
a non-exclusive drainage and utility easement under and across the
Westerly twenty (20) feet of the vacated portion of Trail

Boulevard,
said drainage and utility easement being more
particularly described in Exhibit C and depicted in Exhibit D
attached hereto and incorporated herein.
BE IT FURTHER RESOLVED, that Collier County reserves unto
itself the right-ot-way and drainage easements more particularly
described in Exhibit E and depicted in Exhibit F attached hereto
and incorporated herein.
BE IT FURTHER RESOLVED! that Collier County reserves unto
itself the exclusive drainage easement more particularly described
in Exhibit G and depicted in Exhibit H attached hereto and
incorporated herein.
BE IT FURTHER RESOLVED, that the Petitioner, as a condition of
this vacation, grants Collier County a temporary pedestrian
sidewalk/bike path easement over the paved portion of the property
depicted in Exhibit A until such time as other access for
pedestrian and bicycle traffic is granted by Petitioner, its
successors or assigns, to Collier County.
Said temporary
pedestrian sidewalk/bike path easement shall be terminable by
Petitioner upon other access being provided for pedestrian and
bicycle traffic.
BE IT FURTHER RESOLVED, that thie vacation, is part of the
settlement at the eminent domain case for the four-laning of
Vanderbilt Beach Road Extension (Case No. 95-5071-CA-01-TB)
BE IT FURTHER RESOLVED, that the front yard setbacks,
landscape buffers and landscaping requirements for Lots 6 through
14, inclusive, pine Ridge Extension Replat, shall be as depicted on
Exhibit I and that Collier County agrees to approve site
Development Plans that are consistent with the standards for
setbacKs, landscape buffers and landscaping depicted on Exhibit I
attached hereto and consistent with the Collier County Land
Development Code.
BE IT FURTHER RESOLVED, that the Clerk is hereby directed to
advertise the adoption of this Resolution once in a paper of
general circulation in the County within 3D days following its
adoption.

record a certified copy of this Resolution, the proof of
publication of the notice of public hearing, and the proof of
