Executive Summary
Recommendation to approve the after-the-fact submittal of Amendment No. 2 to Agreement No. 23CO3 with the Florida
Department of Environmental Protection Bureau of Beaches and Coastal Systems Beach Management Funding
Assistance Program that extends the grant agreement to December 31, 2026, to continue eligible restoration activities for
damage caused by Hurricanes Ian and Nicole and make a finding that this item promotes tourism.
OBJECTIVE: To approve an additional time extension to continue eligible restoration activities along Collier County’s
shoreline due to damages from Hurricanes Ian and Nicole.
CONSIDERATIONS: On September 28, 2022, Hurricane Ian passed just offshore from the Collier County coast, with
waves and storm surge causing major damage to the County’s beaches and dunes. On November 10, 2022, Hurricane
Nicole passed to the north of Collier County, but strong winds associated with the storm produced waves which caused
additional damage to the already heavily impacted beaches. The Florida Legislature appropriated funds by Senate Bill
(2022-272-SB4-A) to the Florida Department of Environmental Protection (FDEP) for the 2022 Hurricane Ian and
Nicole Emergency Recovery Project which may be used to support local governments in restoring beaches damaged by
these storms.
FDEP Agreement No. 23CO3 for $2,436,457.00 was approved by the Board of County Commissioners (Board) on July
11, 2023 (Item 16B8).
Amendment No. 1 to this Agreement approved by the Board on December 12, 2023 (Item 16.B.11) increased the
amount of funding available for reimbursement by $2,586,466.40 for a total of $5,022,923.40.
The purpose of this amendment is to extend the agreement for a twelve (12) month period to begin January 1, 2026, and
remain in effect until December 31, 2026.
The amendment was received on December 15, 2025 and must be submitted by December 31, 2025. Due to the short
turnaround, Collier County CMA #5330 authorizes the County Manager to approve the submittal of the amendment
with subsequent action at the next regularly scheduled Board meeting to ratify the approval of an after-the-fact
amendment. The County Manager approved the amendment on December 19, 2025.
This item is consistent with the Quality of Place Objectives of the County’s Strategic Plan.
FISCAL IMPACT: There is no new fiscal impact associated with this item. Funding for Tourist Development Tax
eligible beach renourishment is available in Tourist Development Council (TDC) Beach Renourishment Fund (1105)
Project 50280. The Source of funding is Tourist Development Tax. There is no local match required for this grant
program.
GROWTH MANAGEMENT IMPACT: This item is consistent with the Conservation and Coastal Management
Element of the County’s Growth Management Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. –

This Amendment to Agleement No. 23CO3, as previously amended, (Agreement) is made by and between the
Department ofEnvironmental Protection (Department), an agency ofthe State ofFlorida, and Collier County, 2685 South
Horseshoe Drive, Naples, Florida 34104 (Grantee), on the date last signed below.
WHEREAS, the Department entered into the Agreement with the Grantee for the Collier County - 2022
Hunicane lan and Nicole Recovery Project effective July 13,2A23i and
WHEREAS, the Grantee has requested an extension to the Agreement and the Department has agreed; and
WHEREAS, the parties wish to amcnd the Agteement as set forth herein-
NOW THEREFORE, the parties agree 8s follows:
l) The Agreement is extended for a twelve (12) month period to begin January l, 2026, and r€main in effect until
December 31, 2026. The Department and the Grantee shall continue to perform their respective duties during this
extension period pursuant to the same terms and conditiom provided in the Agreement.
2) Attachment l-A, Revised Standard Terms and Conditions, is hereby deleted in its entirety and r€placed with
Attachment 1-B, Second Revised Standard Terms and Conditions, as aftached to this Amendment and hereby
incorporated in the Agreement. All references in the Agreement to Attachment l-A shall hereinafter refer to
Attschment 1-B, Second Revised Standard Terms and Conditions.
3) Attachment 2, Special Terms and Conditions, is hereby deleted in its entirety and rcplaced with Attachment 2-A,
Revised Special Terms and Conditions, as attached to this Amendment and hereby incorporated in the Agreement. All
references in the Agreement to Aftachment 2 shall hereinafter refer to Attachment 2-A, Revised Special Terms and
Conditions.
4) Attachment 3-A, Revised Grant Work Plan, is hereby deletad in its entir€ty and replaced with Attachment 3-8,
Second Revised Grant Vy'ork Plan, as attached to this Amendment and hercby incorporated into the Agreement. All
references in the Agreement to Attachment 3-A shall hereinafter refer to Attachment 3-8, Second Revised Grant
Work Plan.
5) Attachment 4, Public Records Requirements, is hereby deleted in its entirety and replaced with Attachment 4-A,
Revised Public Records RequiremenB, as attached to this Amendment and hereby incorporated into the Agreement.
All references in the Agreement to Attachment 4 shall hereinafter refer to Attachment 4-A, Revised Public Records
Requirements.
6) Attachment 5, Revised Special Audit Requirements, is hereby deleted in its entirety and rcplaced with Attachment 5-
A, Second Revised Special Audit Requirements, as attached to this Amendment and hercby incorporated into the
Agreement. All references in the Agreement to Attschment 5 shall hereinafter refer to Attachment 5-A, Second
Revised Special Audit Requirements.
7) All other terms and conditions of the Agrcement remain in effect. If and to the extent that any inconsistencies may
appear between the Agrcement and this Amendment, the provisions ofthis Amendment shall control.

County Manager review and approval to execute Amendment No. 2 to the Florida Department of
Environmental Protection Grant Agreement 23C03 for a zero dollar funding adjustment between
categories and an extension to December 31, 2026. (ATF 26-003).
The initial FDEP Grant Agreement (23CO3) was approved by the Board of County Commissioners (Board) on
September 28, 2022, to implement the Hurricane lan and Nicole Recovery Project. Funding assistance is primarily
provided for beach and dune restoration to address impacts of Hurricanes lan and Nicole. The agreement currently
expires on December 31, 2025.
The amendment was received on December 15, 2025, extending the agreement by one year to complete the beach
and dune restoration consistent with the recovery plan which addresses the impacts of Hurricanes lan and Nicole.
With the Board meeting only once during December, il became necessary to utilize Collier County CMA 5330 policy
which authorizes the County Manager to execute grant amendments with a subsequent Board action at the next
available meeting of January 13,2026. This will allow the amendment to be executed prior the current expiration
date.
