Agenda 01/13/2026 Item #16F 3 (Drainage Easements from the Contessa Condominium Association, Inc. and Bay Colony Community Association, Inc.)1/13/2026 Item # 16.F.3 ID# 2025-5065 Executive Summary Recommendation to approve Drainage Easements from the Contessa Condominium Association, Inc., (“Contessa”), and Bay Colony Community Association, Inc., (“BCCA”), for access and drainage maintenance of the Master Pelican Bay stormwater system. OBJECTIVE: To authorize Pelican Bay Services Division (“PBSD”) to assume additional drainage maintenance responsibilities within Bay Colony. CONSIDERATIONS: The Pelican Bay Services Division Municipal Services Taxing & Benefit Unit was formed for the purposes of providing street lighting, water management, beach renourishment, ambient noise management, extraordinary law enforcement service and beautification, including but not limited to beautification of recreation facilities, sidewalk, street and median areas, identification markers, the maintenance of conservation or preserve areas including the restoration of the mangrove forest preserve and to finance the landscaping beautification of only that portion of U.S. 41 from Pine Ridge Road to Vanderbilt Beach Road. The Unit is also solely responsible for advising the County on dredging and maintaining Clam Pass. In 2019, the County prepared an inventory of Pelican Bay roadway and public drainage facilities, as well as easements, and identified 86,055 linear feet of pipes and culverts throughout the Pelican Bay community. Of this piping, approximately 51,630 linear feet is owned and maintained by the County, and 34,425 linear feet is owned by Pelican Bay. PBSD and other County staff identified 7,696 linear feet of pipe that exists outside the right of way that will be assumed by PBSD maintenance to avoid conflicts with community property. The portion of the drainage system transferred to PBSD was in fair condition and will be rehabilitated systematically over the coming years. This transfer of drainage responsibilities provided Pelican Bay the certainty they desire in achieving the level of service the community expects, and also allows PBSD to handle encroachments in the drainage easements between homes with a higher level of discretion than the County allows. The transfer of assets was memorialized in current and future budget documents by reference to Resolution 2019-140. PBSD is the permit holder for the SFWMD Pelican Bay master surface water management system, which includes the Bay Colony Beach Dune Swale, which is an approximately 5.5 acre drainage swale that is the only conveyance and treatment for stormwater runoff from six high-rise buildings within Bay Colony to the outfall into Clam Bay. The swale is an open drainage area between the residential high rises and the beach dune. Residential parking lots and parking garages have flooded in past wet seasons due to restricted water conveyance through the swale. In 2020, a major project was undertaken to correct deficiencies with the swale flow that affected upstream properties. Swale improvements included widening and bank stabilization, and removal of vegetation to prevent obstructions. Since these improvements were made, bi-annual maintenance is necessary to maintain flow. The Contessa Condominium Association, Inc., and Bay Colony Community Association, Inc. (BCCA) properties are adjacent to the existing swale. These drainage easements will effectively extend the existing easement further south across the Contessa property to the southern property line shared with BCCA and will allow both entities to obtain permit approval for the construction of initial drainage improvements that, once completed, are intended to be maintained by PBSD. Prepare for the impacts of natural disasters on our critical infrastructure and natural resources. FISCAL IMPACT: Annual funding will be provided by Pelican Bay residents, through the Pelican Bay Services Division Municipal Service Taxing & Benefit Unit non-ad valorem assessment. GROWTH MANAGEMENT IMPACT: This item complies with the Collier County Growth Management Plan.
