Agenda 01/13/2026 Item #16D 8 (4 Releases of Lien pursuant to the Agreement for Deferral of 100% of Collier County Impact Fees for owner-occupied Affordable Housing Dwellings)1/13/2026 Item # 16.D.8 ID# 2025-4950 Executive Summary Recommendation to approve and authorize the Chair to sign four (4) Releases of Lien for full payment in the amount of $59,807.71, pursuant to the Agreement for Deferral of 100% of Collier County Impact Fees for owner-occupied Affordable Housing Dwellings. OBJECTIVE: To support the County’s affordable housing community development strategic objective utilizing the Impact Fee Deferral program. CONSIDERATIONS: Pursuant to Article IV of Chapter 74 of the Collier County Code of Ordinances, the County may defer the payment of the impact fees for any new owner-occupied unit that qualifies as affordable housing. Section 74- 401(a)(3) of the Code of Laws authorizes the County Manager to enter into an impact fee deferral agreement with the developer, homeowner, or applicant. The deferred impact fees shall be a lien on the property, and the agreement shall be accepted by the County in lieu of prompt payment of the impact fee that would otherwise be due and payable. The impact fees became due upon the death of the homeowners, foreclosure, or sale of the properties. The following table details the associated deferral agreements that have been repaid in full. As such, satisfactions of lien are required. A total of $59,807.71 was paid to Collier County into the appropriate impact fee trust funds. Under this program, no interest is charged unless the agreement is breached by the non-county party. This item is consistent with the Collier County strategic plan objective to support comprehensive affordable housing opportunities. FISCAL IMPACT: A total of $59,847.71 was paid to Collier County, of which $59,807.71 was deposited in the Growth Management Impact Fee Accounts. Four recording fees of $10 per Release of Lien were paid by the Title Company or Developer on behalf of the homeowners and deposited into Fund (0001) Cost Center (155930).
