Executive Summary
Recommendation to approve and authorize the Chair to execute two (2) Releases of Declarations of Restriction for
Immokalee Friendship House, Inc., (St. Matthew’s House) related to activities funded under the U.S. Department of
Housing and Urban Development Emergency Solutions Grant (ESG) program in the total amount of $194,473, and to
approve the corresponding Budget Amendments recognizing non-grant revenue of $181,232.96 and ESG program
income of $13,240.04. (Housing Grant Match Fund 1836 & Housing Support Fund 1806)
OBJECTIVE: To remove two (2) Declarations of Restrictions for Immokalee Friendship House Inc.
CONSIDERATIONS: In consideration of the County’s Emergency Solutions Grant (ESG) grant award to Immokalee
Friendship House Inc., in the amount of $96,461.00, dated February 15, 2007, the County is the owner and holder of an
unrecorded Declaration of Restriction. In consideration of an additional ESG grant award in the amount of $98,012.00,
dated November 14, 2007, the County is the owner and holder of a Declaration of Restriction, recorded in Official
Record Book 4302 and Page 0880 of the Public Records of Collier County, Florida. Both Declarations of Restriction
had a twenty (20) year period of continued use. On August 29, 2016, St. Matthew's House acquired the property from
Immokalee Friendship through a Quit Claim deed.
St. Matthew's House has since sold the property and repaid the County the ESG funds in the total amount of
$194,473.00. The following table provides details on the associated Declarations of Restriction that have been paid off;
therefore, satisfactions of the restrictions are required.

Out of the amounts identified in the (2) Declaration of Restriction, a prorated portion is attributable to the U.S.
Department of Housing and Urban Development (HUD) ESG grant program, with the balance classified as non-grant
proceeds. The Immokalee Friendship House (St. Matthew's House) satisfied its intended ESG use for 92% of the
required 20-year compliance period, and the remaining 8% will be remitted to the ESG program as program income.
Approval of this item will authorize the Chair to sign the two Restriction satisfactions, and the executed document shall
be recorded in the Public Records of Collier County, Florida.
The subject property has a legal description of:
Lots 19-22 inclusive, Block 5, Miller’s Park Subdivision, according to the map or plat thereof, recorded in Plat Book 2,
Page 80, and Public Records of Collier County, Florida. Less and except the South 20 feet for road right-of-way as
recorded in O.R. Book 1329, Page 2256, Public Records of Collier County, Florida. (Property Id Number
60182920006).
This item is consistent with the Collier County strategic plan objective to safeguard taxpayer money by promoting fiscal

stewardship and sound budget oversight.
FISCAL IMPACT: A Budget Amendment is required to recognize $13,240.04 in ESG program income as an eligible
funding source within the Housing Grants Match Fund (Fund 1836), Project 33949. In accordance with HUD ESG
Uniform Guidance, this program income will be applied toward the County’s ESG matching requirements. As a result, a
corresponding budget amendment will reduce the General Fund contribution by $13,240.04, returning those funds to
reserves for future match needs within the Housing Grants Match Fund.
Additional budget amendments are required to recognize non-grant-related proceeds totaling $181,232.96 within the
Housing Support Grant Fund (Fund 1806), including $88,744.12 for ESG PY04 (Project 34800) and $92,488.84 for
ESG PY07 (Project 34806). These funds will support activities that advance the County’s Emergency Solutions Grant
program, including case management, homelessness prevention, and rapid rehousing services.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board
approval. – CLD

DECLARATION OF RESTRICTIONS
Immokalee Friendship House, Inc. a private, limited partnership, having its principle office at 602 W. Main
Street, Immokalee FL, 34142, hereinafter referred to as "Declarant," for the property described below, in
consideration of ESG funding in the amount of Ninety Six Thousand Four Hundred Sixty One Dollars
96,461.00) to be received from Collier County does hereby grant to the County the following restrictions
against the subject property described as:
Lots 19 -22 inclusive, Block 5, Miller's Park Subdivision, according to the map or plat thereof,
recorded in Plat Book 2, Page 80, and Public Records of Collier County, Florida. Less and
except the South 20 fee for road right -of -way as recorded in O.R. Book 1329, Page 2256,
Public Records of Collier County, Florida.
1. This Declaration of Restrictions shall be deemed as covenants running with the land and are binding upon
the undersigned, their heirs, executors, successors, and assigns. These restrictions can only be terminated if
released by Collier County, acting through and by its Board of County Commissioners, and only when
executed with the same formalities as this document, effective when recorded in the Public Records of Collier
County, Florida. Collier County is specifically granted the right to enforce this Declaration using all means
lawfully available, and is entitled to such costs and fees as may be required to enforce this Declaration.
2. In consideration of the County's grant in the amount of $96,461.00 (in ESG funds) as provided through a
grant Agreement with the County dated H , 210-QS the Declarant hereby covenants and
agrees to only use the subject property as described m the Declarant's funding application to the County, and
as described in said grant Agreement, and as set forth below, for a period of twenty (20) years commencing
with the expiration date of said grant Agreement (as the term of such Agreement may be amended from time
to time).
3. The Declarant agrees, with regard to the use of the facility /property whose acquisition or improvements
were funded through the grant Agreement that for a period of twenty (20) years after the closing date of said
project (as the term of such Agreement may be amended from time to time):
a. The Declarant may not change the use or planned use, or discontinue use, of the
facility /property (including the beneficiaries of such use) from that for which the acquisition or
improvements were made, unless the Declarant provides affected citizens with reasonable
notice of, and opportunity to comment on, any such proposed change and either:
i) The new use of the facility /property, in the opinion of the County, qualifies as meeting
one of the national objectives defined in the regulations governing the ESG program,
and is not a building for the general conduct of government; or
ii) The requirements of paragraph 3(b)of this section are met.
b. If the Declarant determines after consultation with affected citizens, that it is appropriate to change the
use of the facility /property to a use which does not qualify under Paragraph 3(a)(1) of this section or
discontinue use of the facility /property, it may retain or dispose of the facility for such use if the
County is reimbursed in the amount of the current fair market value of the facility /property less any
portion thereof attributable to expenditures of non -ESG funds for acquisition of, or improvements to
the facility /property. The final determination of the amount of any such reimbursement to the County
under this paragraph shall be made by the County.

c. Following the reimbursement of ESG funds by the Declarant to the County pursuant to Paragraph 3(b)
above, the facility /property will then no longer be subject to these restrictions once the County has
recorded a release of these restrictions as described above.
In the event of any proposed sale, conveyance or transfer of the subject property, the Declarant must
obtain approval of the County, through its Housing & Grants Section. Any approved sale or
conveyance of the subject property by the Declarant will be contingent upon the receipt of the payment
by the County in accordance with the provisions of Paragraph 3(b) above, or the receipt of a
commitment, executed by a subsequent owner acceptable to the County, acknowledging its
acquiescence to this Declaration.
4. The Declarant agrees to notify the County in writing through the Housing & Grants Section of any
liens, judgments or pending foreclosure on the subject property within five (5) working days of the
receipt of said notice by the Declarant.
5. Declarant shall submit to the County once each year a report detailing the Declarant's compliance with
the terms of the grant Agreement and this Declaration of Restrictions.
6. Declarant relinquishes all rights to alter, amend, modify, or release the covenants set forth in this
Declaration prior to the completion of the twenty -year period described above.
