(Opioid Grant Fund 1850). OBJECTIVE: To ensure the continued use of Florida Opioid Settlement Funds in addressing the opioid epidemic and advancing Collier County's strategic objective of enhancing access to health, wellness, and human services. CONSIDERATIONS: The National Opiate Litigation filed by the State of Florida and various local governments against pharmaceutical companies has resulted in numerous settlements, to be distributed to the State of Florida over multiple years (“Settlement Funds”). At the June 22, 2021 (Agenda Item #16.K.8) meeting, the Board of County Commissioners (Board) approved Resolution No. 2021-136 supporting the terms and conditions of the Memorandum of Understanding (MOU) provided by the Office of Attorney General, which set forth a framework of a unified plan for the proposed allocation and allowable uses of Settlement Funds to mitigate the harmful effects of the opioid epidemic (the “Florida Plan”). Resolution No. 2021-136 further authorized the County to execute formal agreements to implement the Florida Plan. On August 12, 2025 (Agenda Item #16.D.4.), the County and New Season entered into an agreement to provide medication assisted treatment (MAT) to Collier County residents. This proposed Amendment #1 is retroactive to September 1, 2025. It will update the language in the payment deliverables table to clarify the required documentation, extend the period of performance from September 30, 2026, to December 31, 2026, and update the Grant Coordinator's contact information. This action advances Collier County's strategic objective of enhancing access to health, wellness, and human services. FISCAL IMPACT: The recommended actions described in this Executive Summary have no new fiscal impact. Funds are available in the Opioid Grant Fund 1850, project 44059. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. The attached proposed agreement between Collier County and Metro Treatment Florida d/b/a New Season Treatment Center 9 allocates $148,670.00 to increase access to and distribution of Medication-Assisted Treatment (MAT) for individuals with opioid use disorder, with a focus on reaching those persons recently released from the Collier County jail, non-Medicaid eligible, underinsured, or uninsured populations. The proposed services are allowable under the Approved Uses (Core Strategies and Approved Uses). The agreement period of performance is May 1, 2025, through September 30, 2026. The parties acknowledge that the Funds originate from the State of Florida, Attorney General and DCF provided OPIOID grant funds and must be implemented in full compliance with all Attorney General and DCF rules and regulations and any agreement between COUNTY and Attorney General governing OPIOID Funds pertaining to this Agreement. In the event of curtailment or non-production of said State Funds, the financial sources necessary to continue to pay New Season Treatment Center 9 all or any portion of the Funds will not be available. In that event, the COUNTY may terminate this Agreement, which shall be effective as of the date it is determined by the County Manager or designee, in his or her sole discretion and judgment, that the Funds are no longer available. In the event of such termination, New Season Treatment Center 9 agrees that it will not look to, nor seek to hold the COUNTY, nor any individual member of the County Commissioners and/or County Administration, personally liable for the performance of this agreement, and the COUNTY shall be released from any further liability to the New Season Treatment Center 9 under the terms of this agreement. Promotes access to health, wellness, and human services to benefit Collier County residents. FISCAL IMPACT: The funding for the agreement associated with this item is budgeted in the Opioid Abatement Grant Fund (1850), Project 44059- Qualified/Regional.
