Items 9A& 9B to be heard at 1:00 PM: Growth Management Plan Amendment and Rezoning for the 341 Sabal Palm Road Residential Development. 1i13,2O 61:4"Pit 1/13/2026 Item # 16.A.13 ID# 2025-4627 Executive Summary Recommendation to approve and authorize the Chair to sign a Resolution adopting the inventory list of County-owned real property declared appropriate for use as affordable housing and approve the publication of the inventory list to the County’s website in compliance with Section 125.379, Florida Statutes. OBJECTIVE: To provide housing that is affordable in Collier County and to further the goals set forth in the Housing Element of the Growth Management Plan. CONSIDERATIONS: In 2006, the Florida Legislature enacted Section 125.379, Florida Statutes, wherein each County is tasked to triennially prepare an inventory list of all real property within its jurisdiction to which the County holds fee simple title that may be declared appropriate for use or sale for the benefit of affordable housing. The Board of County Commissioners (Board) must review the inventory list at a public hearing and revise it as it chooses. Following the public hearing, the governing body must adopt a Resolution that includes an inventory list of such properties. The Statute provides possible options for the appropriate usage of this property to benefit affordable housing. The property may be offered for sale, and the proceeds, above any amounts reimbursed to County funds, are available for eligible uses. The land, or the proceeds from the sale, may be used for one of the following activities: 1. Affordable housing through a long-term land lease requiring the development and maintenance of affordable housing. 2. Offered for sale and the proceeds used to purchase land for the development of affordable housing or to increase the local government fund earmarked for affordable housing. 3. Sold with a restriction that requires the development of the property as permanent affordable housing. 4. Donated to a nonprofit housing organization for the construction of permanent affordable housing. 5. Make the property available for use for the production and preservation of permanent affordable housing. Staff has identified the properties included in the inventory list as suitable for affordable housing, which is attached hereto. Senate Bill 102, also known as the “Live Local Act,” amended Section 125.379, Florida Statutes, to further require that the County’s affordable housing inventory list be published on the County website once adopted by the Board. The Affordable Housing Advisory Committee (AHAC) discussed this list at the November 18th meeting, and once adopted by the Board, it may be posted on the website and made publicly available in accordance with the Statute. This item is consistent with the Collier County strategic plan objective to support comprehensive affordable housing opportunities. FISCAL IMPACT: There is no direct fiscal impact at this time. Approval of the resolution fulfills the statutory requirement to review and affirm the County’s surplus property inventory for affordable housing. Any future sale or disposition of these parcels will reimburse applicable County funds, with remaining proceeds directed to affordable housing initiatives in accordance with Section 125.379, Florida Statutes. GROWTH MANAGEMENT IMPACT: Designation of County-owned parcels for the development of housing that is affordable furthers the Goals, Objectives, and Policies of the Growth Management Plan and specifically the Housing Element. LEGAL CONSIDERATIONS: The attached Resolution, which is required by Section 125.379, Florida Statutes, is approved for form and legality and requires a majority vote for Board action. - CLD RECOMMENDATION(S): To approve and authorize the Chair to sign a Resolution adopting the inventory list of County-owned real property declared appropriate for use as affordable housing and approve the publication of the inventory list to the County’s website in compliance with Section 125.379, Florida Statutes.
