Executive Summary
Recommendation to approve the release of a code enforcement lien with an accrued value of $1,367,905.69 for a reduced
payment of $30,770.50 in the code enforcement action titled Board of County Commissioners vs. Ronald Abel, in
Special Magistrate Case No. CEPM20180004112, relating to the property located at 2172 41st Ter SW, Collier County,
Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with an
accrued value of $1,367,905.69 for a reduced payment of $30,770.50 in Special Magistrate Case No.
CEPM20180004112.
CONSIDERATIONS: The violation consisted of an unsecured, unmaintained swimming pool with stagnant water (Part
C), missing protective pool barrier in the rear yard of an improved occupied residential property (Part D), and obtaining
all required Collier County Building Permit(s), Inspection(s), and Certificate of Completion for the placement of an
approved permanent pool barrier (Part E).
The lien was recorded in the Official Records on October 24, 2019, at O.R. Book 5688, Pages 529–531 in the amount of
$57,111.85. Fines continued to accrue and the lien amount of $1,367,905.69, is based on 1,918 days of accrued fines
($250 per day from July 13, 2019, through October 11, 2024), totaling $479,500 (Part C), $479,500 for (Part D), plus
1,894 days of accrued fines ($250 per day from August 6, 2019, through October 11, 2024), totaling $473,500 for (Part
E). The property was brought into compliance on October 11, 2024.
The property was acquired through a Collier County Foreclosure Sale by Home Discounters, LLC, with Surplus funds in
the amount of $64,591.31 applied to the recorded lien, leaving a balance of $1,367,905.69.
A subsequent sale of the property to the current owners, Marvin Yovani Miguel Perez and Maria Guadalupe Figeroa
Martinez, was recorded on November 4, 2024, in O.R. Book 6411, Pages 1903–1904.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose severe financial hardship on the owner. The property is actively maintained, and the new owners are
willing to pay $30,770.50 to release the lien.
The recommended payment of $30,770.50 is ten percent of the Collier County Property Appraiser’s Assessed Value of
$307,705 and meets the criteria outlined in Resolution 2023-90. There are currently no known violations on the
property.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of a payment of $30,770.50 to settle the lien will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution
2023-90. RTT
RECOMMENDATION(S): To approve the recommended reduction of fines in the amount of $1,337,135.19, accept
payment in the amount of $30,770.50, release the lien, and authorize the Chairman to sign the attached release and
satisfaction of lien for recording in the Official Public Records.

provide the product specs for the pool cover
used to ensure it was ASTM F1346 certified.
He was unable to do so.
Today I met with the property manager at the
GMD building. He has now installed an ASTM
F1346 pool safety cover. I conducted a site
inspection to confirm compliance, reviewed
the product's online listing as well as the
manufacturers website.
Violation abated as of this date. Photos taken
- email attached to the case with product
