RESOLUTION OF TIlE BOARD OF COUNTY COMMISSIONERS, COLLIER
COUNTY, FLORIDA, AUTIIORIZlNG WAIVER OF REGIONAL WATER
SYSTEM IMPACf FEES, REGIONAL SEWER SYSTEM IMPACf FEES,
LIBRARY SYSTEM IMPACf FEES, PARKS AND RECREA nONAL
FACILITIES IMPACf FEES, ROAD IMPACf FEES, EMERGENCY MEDICAL
SERVICES IMPACf FEES AND EDUCA nONAL FACILITIES SYSTEM
IMPACf FEES FOR ONE HOUSE TO BE CONSTRUCfED BY IMMOKALEE
HABITAT FOR HUMANITY, INC., ON LOT 29, BLOCK 13, NAPLES MANOR
LAKES, NAPLES, FLORIDA.
WHEREAS, Collier COlD1ty hu recognized and attempted to address the lack of adequate and affordable
houslna for moderate, low, and very-low income households in the COlD1ty and the need for creative and irmovative
propama 10 aaaist in the provision of such housing by including several provisions in the Collier ColD1ty Growth
Manasement Plan, including: objective 1.4, policy 1.4.\; objective 1.5, policy 1.5.2, policy 1.5.3, policy 1.5.4,
policy 1.5.5, policy 1.5.6; objective 1.6, policy 1.6.3; objective 2.1, policy 2.1.1, policy 2.1.2, policy 2.1.3, policy
2.1.5, and policy 2.1.6 of the Housing Element; and
WHEREAS, Collier ColD1ty hu received fimdina pursuant to the Stale Housing Initiatives Par1nenhip
Proaram set forth in Section 420.907 ~., Florida Statutes and Chapter 91-37, Florida Administrative Code; and
WHEREAS, in accordance with Collier ColD1ty Ordinance No. 93-19, the COlD1ty is authorized 10 use
fundina from the State Housing Initiatives Par1nerahip [SHIP] Program for waivers of Collier COlD1ty impact fees;
and
WHEREAS, Immokalee Habitat for Humanity, Inc. is seeking a waiver of imp;ct fees; and
WHEREAS, Immokalee Habitat for Humanity, Inc. will construct one (I) three-bcdluO.n lD1it (the
"Dw1:lIina Unit") on Lot 29, Block 13, Naples Manor Lakes which is proposed 10 sell for Forty-Six Thouaand Five
Hundred Dollar. ($46,500.00); and
WIlHI ?.AS, the Dwelling Unit win be purchased by a very low income household which is requimllo
invest a minimum of five hlD1dred (500) hours of "Swest Equity" before it obtains title to the house; and
WHEREAS, Mr. Charles C. Smith, Vice President of Immokalee Habitat for Humanity, Inc., submitted to
the Office of Housing and Urllan Improvement an Affordable Housing Application dated Oclober 25, 1996 for a
waiver of impact fees for the consllUction of a house on Lot 29, Block 13, Naples Manor Lakes, a copy of said
application is on file in the Housing and Urban Improvement Department; and
WHEREAS, in accordance with Section 3.04 of the Regional Water System Impact Fee Ordinance,
Ordinance No. 90-86, as amended; Section 3.04 of the Regional Sewer System Impact Fee Ordinance, Ordinance
No. 90-87, as amended; Section 3.04 of the Library System Impact Fee Ordinance, Ordinance No. 88-97, as
omended; Section 4.05 of the Parka and Recreational Facilities Impact Fee Ordinance, Ordinance No. 88-96, as
an"" r'" ~; Section 3.04 of the Road Impact Fee Ordinance, Ordinance No. 92-22, as amended; Section 3.05 of the
Eme.._y Medical Servicea System Impact Fee Ordinance, Ordinance No. 91-71, as amended; and Section 3.05 of
the Educational Facilities Syatcm Impact Fee Ordinance, Ordinance No. 92-33, as amended; an applicant may obtain
a waiver of Impact fees by qualifying for a waiver; and

WHEREAS, Immokalee Habitat for Humanity, Inc. has qualified for an impact fee waiver based upon the
following repracntations made by Immokalee Habitat for Humanity, Inc.:
A. The Dwelling Unit shall be sold to a first-time home buyer.
B. The Dwelling Unit shall be sold 10 a household with a very low income level as that term is defined
in the Appendicea to the respective Impact Fee Ordinances and the monthly payment to purchase the
unit must be within the affordable housing guidelines established in the Appendicea 10 the
respective Impact Fee Ordinances.
C. The Dwelling Unit shall be the Homestead of the owner.
D. The Dwelling Unit shall remain affordable for fifteen (15) years from the date the certificate of
oceupancy is issued.
NOW TIlEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, thaI:
I. The Board of County Commissioners hereby authorizes the. County Manager to issue an
Authorization for waiver of impact fees to Immokalee Habitat for Humanity, Inc. for one (I) house
which shall be constructed on Lot 29, Block 13, Naples Manor Lakes, Collier County, Florida.
2. Upon receipt by the Housing and Urban Improvement Director of an agreement for waiver of
impact fees signed by Immokalee Habitat for Humanity, Inc., and/or the purchaser, or other
documentation acceptable to the County Attorney, the Board of County Commissioners hereby
authorizes the payment by Collier County of the following impact fees from the Affordable Housing
Trust FlD1d, Fund (191), in the following amolD1ts for the one (I) houae to be built on Lot 29, Block
13, Naples Manor Lakes by Immokalee Habitat for Humanity, Inc.:
