RELATING TO PETITION NO. CU-95-20 FOR
EXTENSION OF CONDITIONAL USB OF PROPERTY
HEREINAFTER DESCRIBED IN COLLIER COUNTY,
FLORIDA
WHEREAS, the Legi.lature of the state of Florida in Chapter 125,
Florida Statute., has conferred on all Counties in Florida the power to
utablbh, coordinate and enforce zoning and such bu.iness regulations
.. are nece..ary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land
Developaent Cod. (Ordinance No. 91-102) which establishes comprehen.ive
loninq regulation. for the zoning of particular divisions of the
County, ..onq which i. the qranting and extendinq the time period of
COnditional u...; and
WHEREAS, on J~nuary 9, 1996, the Board of Zoning Appeal. enacted
Re.olution No. 96-i6, which granted a conditional use pursuant to
ordinance No. 91-102, for a drivinq ranqe, on the below described
property; and
WHEREAS, Sub.ection 2.7.4.5 of the Land Development Code provide.
that the Board of Zoning Appeals may extend the one (1) year time
period for a conditional use which has not been commenced;
NOW, THERBFORE BE IT RESOLVED, by the Board of Zoninq Appeals of
Colliar County, Florida that:
The written reque.t of Robert L. Duane of Hole, Montes ,
Associate., Inc., repre.enting Boyne USA South, Inc. for the fir.t of
thr.. (3) peraitted on. (1) year extensiona, in intere.t of the
following de.cribed property:
Tract A, Royal Palm Golf Estate., unit One, a. recorded in
Plat Book 12, Page 14, of the Public Record. of Collier
County, Florida.
i. hereby approved pur.uant to SUbsection 2.7.4.5 of the Land
Development Code (Ordinance No. 91-102), and the expiration date for
Re.olution No. 96-16, attached hereto and incorporated herein a.
lXhibit RAR, and all condition. applicable thereto, i. extended hereby
for one year until January 9, 1998.
