RESOLUTION NO. 97-~
RELATING TO PETITION NUMBER V-96-7, FOR A
VARIANCE ON PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Leqialature ot the state ot Florida in Chapter 125,
Plorida Statutea, haa conterred on all Countiea in Florida the power to
eetabliah, coordinate and entorce zoninq and auch bueineaa requlatione
aa are neceasary tor the protection ot the public; and
WHEREAS, the county purauant thereto haa adopted a Land
Developeent Code (Ordinance No. 91-102) which eatabliahea regulationa
tor the zoninq ot particular geographic diviaions ot the County, aaonq
which ia the grantinq ot variances; and
WHEREAS, the Board ot Zoning Appeals, beinq the duly elected
conatituted Board ot the area hereby attected, haa held a public
hearing atter notice aa in said regulationa made and provided, and baa
conaidered the advisability ot a 9 toot variance to the required 40

toot tront yard setback to 31 teet tor Lot 28 and a 3 year deterral to
hook up to a public water supply tor Lot 28, aa provided tor in the
Golden Gate Parkway Professional ottice Commercial District standarda
ot the Golden Gate Haster Plan Element ot the Collier County Growth
Hanagement Plan and as shown on the attached plot plan, Exhibit "A", in
a "RKF-12" zone for the property hereinatter described, and haa tound
as a matter ot fact that satistactory provision and arrangement have
been made concerning all applicable matters required by said
regulations and in accordance with Section 2.7.5 ot the Zoning
Regulations of said Land Development Code for the unincorporated area
ot Collier County; and
WHEREAS, all interested parties have been given opportunity to be
heard by this Board in public meeting assembled, and the Board having
conaidered all matters presented;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS ot
Collier County, Florida, that:
