RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS,
COLLIER COUNTY, FLORIDA, AUTHORIZING WAIVER OF LffiRARY
SYSTEM IMPACT FEES, PARKS AND RECREATIONAL FACILITIES
IMPACT FEES, ROAD IMPACT FEES, EMERGENCY MEDICAL
SERVICES IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC., ON LOT 14,
BULLARD SUBDMSION, IMMOKALEE.
WHEREAS, Collier CoWlty has recognized and attempted to IddreA the lack of IdoquIto and
affordable housing for moderate, low, and very.low income households in the CoWlty and the need for
creative and innovative programs to aasist in the provision of such housing by including IeVCDI proviJiODl
in tho Collier CoWlty Growth Management Plan, including: objective 1.4, policy 1.4.1; objective 1.5, policy
1.5.2, policy 1.5.3, policy 1.5.4, policy 1.5.5, policy 1.5.6; objective 1.6, policy 1.6.3; objective 2.1, policy
2.1.1, policy 2.1.2, policy 2.1.3, policy 2.1.5, and policy 2.1.6 of the Housing Element; and
WHEREAS, Collier CoWlty has received funding pursuant to the State Housing Initiatives
Partnenhip Prognun set forth in Section 420.907 ~., Florida Statutes II1d Chapter 91-37, Florida
Adminiatrative Code; and
WHEREAS, in accordance with Collier COWlty Ordinance No. 93-19, the CoWlty iI authorized to
use funding from the State Housing Initiativea Partnership [SHIP] Prognun for waiven of Collier CoWlty
impIct fees; and

WHEREAS, Immokalee Habitat for Humanity, Inc. is seeking a waiver of impact fees; and
WHEREAS, Immokalee Habitat for Humanity, Inc. will construct one (I) thrcc-bedroom unit (the
"Dwelling Unit") on Lot 14, Bullard Subdivision, Immokalee which is propOaed to sell for Forty.Six
Thousand Five HWldred Dollars ($46,500.00); II1d
WHEREAS, the Dwelling Unit will be purchased by a very low income household which is
required to invest a minimum of five hWldred (500) houra of "Sweat Equity" before it obtains title to the
house; and
WHEREAS, Mr. Charlea C. Smith, Vice President of Immokalee Habitat for Humanity, Inc.,
submitted to the Office of Housing and Urban Improvement an Affordable Housing Application dated
December 2, 19% for a waiver of impact fees for the construction of a house on Lot 14, Bullard
Subdivision, Immokalee, a copy of said application is on file in the Housing II1d Urbll1 Improvement
Department; and
WHEREAS, in accordance with Section 3.04 of the Libraty S}'Ilem Impact Fee Qrdin.....'\
Ordinance No. 88-97, as amended; Section 4.05 of the Psrlcs and Recreational Facilities Impact Fcc
Ordinance, Ordinance No. 88-96, as amended; Section 3.04 of the Road Impact Fee Ordinance, Ordinance
No. 92-22, as amended; Section 3.05 of the Emergency Medical Services S)'Ilem lmpact Fcc 0r<I~
Ordinance No. 91-71, as amended; and Section 3.05 of the Educational Facilitiea System Impact Fee

0rdinIDcc, Ordinance No. 92-33, as amended; an applicant may obtain a waiver of impact foes by
qna1ifying for a waiver; and
WHEREAS, Immokalee Habitat for Humanity, Inc. has qualified for an impact fee waiver baaed
upoII1he following repreaentatiODl made by Immokalee Habitat for Humanity,Inc.:
A. The Dwelling Unit shall be sold to a lint-time home buyer.
B. The Dwelling Unit shall be sold to a household with a very low iDcomo level . that tam iI
defined in the Appendices to tho reapective Impact Fee OpHn.....- and 1he montb1y paymaIl
to purchase the unit must be within the affordable houaina r&.11- 0Ilab1ilbed In 1he
Appeodicea to the reapective Impact Fee Ordinances.
Tho Dwelling Unit shall be the Homestead of tho owner.
The Dwelling Unit shall remain affordable for fifteen (IS) years from the date the c:atlfieatIl
of occupmcy iI iIsued.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that:
1. The Board of CoWlty CommiIaionen hereby authorizea tho County M-scr to iIIue 11II
Authorization for waiver of impact foes to Immokalee Habitat for Humanity, Inc. for one (I)
house which Iha1l be constructed on Lot 14, BullanI Subdivilion, Immokalee, Collier
CoWlty, Florida.
Upon receipt by the Housing and Urban Improvement Director of an apcement for waiver
of impact foes signed by Immokalee Habitat for Humanity, Inc~ and/or the JIUfCba-. or

other documentation acceptable to the CoWlty Attorney,' the Board of County

Commissioners hereby aulhorizea tho payment by Collier County of the foUowina impact
fees from the Affordable Housing Trust FWld, FwxI (191), in the,following IIIIlOlII1tI for the
