Florida Administrative Code; and , WHEREAS, in sccotdance with Collier County Ordinance No. 93-19. tho County i.1IUtborized to 1110 flmding ftorn the State Housing Initiatives Partnenhip [SHIP] Program for waivm of Colli<< County impact fees; and WHEREAS, Imrnokalee Habitat for Humanity, Irn:. is seeking. waiv<< of impact fees; and WHEREAS, ImmokaJee Habitat for Humanity, Inc. will COllIlIUct one (I) threc-bedroom unit (the "Dwelling Unit") on Lot 7. Bullard Subdivision. Immokalee which is proposed to sell for Forty-Six Thousand Five Hundred Dollars ($46,500.00); sr.d WHEREAS, the Dwelling Unit will be purchased by a very low income bolllCbold which is required to invest. minimum of five hundred (500) hours of "Sweat Equity" before it obtains title to the house; and WHEREAS, Mr. Cbarles C. Smith, Vice President of Immokalee Habitat for Humanity. Inc.. submitted to the Office of Housing and Urban Improvement an Affordable Housing Application dated Dccembc:r2, 1996 for a waiver of impact fees for the COllIlIUction ofa bouse on Lot 7, Bullard Subdivision. Jmmoka1ee, a copy of said application is on file in the Housing and Urban Improvement Department; and WHEREAS. in accordance with Section 3.04 of the Ubrary System Impact Fee ~. Ordinance No. 88-97. II amended; Section 4.05 of the Parka and Recreational FlICillties Impact Pee Ordinance, Ordinance No. 88-96, II amended; Section 3.04 of the Road Impact Pee Ordinance, 0nIinIDce No. 92-22, II amended; Section 3.05 of the Emergency Medical S<<vices System Impact Fee ()rrI~ Ordinance No. 91-71, II amended; and Section 3.05 of the Educational Facilities System 1mpIlct Pee JAM 1 , 1991 Ordinance, Ordinance No. 92-33, as amended; an applicanl may obtain a waiver of impact fees by qualifying for a waiver; and WHEREAS, Immokalee Habitat for Humanity, Inc. has qualified for an impact fee waiv<< hued upon the following representations made by Immokalee Habital for Humanity, Inc.: A. The Dwelling Unit shall be sold 10 a firat-time home buyer. B. The Dwelling Unit shall be sold to a household with a very low income level II that term is defined in the Appendices to the respective Impacl Fee Ordinances and tho monthly payment to purchase the Wlil must be within the affordable housing guidelines established in the Appendices to the reapcctive Impact Fee Ordinances. C. The Dwelling Unil aha11 be the Homestead of the owner. D. The Dwelling Unit shall remain affordable for fifteen (15) years from the date the C<<tificalo of occupancy is iaaued. NOW TIlEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OP COLLIER COUNTY, FLORIDA, that: 1. The Board of County Commiaaionera hereby authoriZell the County Manager to iaauo an Authorizalion' for waiver of impact fees 10 Immokalee Habital for Humanity, Inc. for one (I) house which shall be constructed on Lot 7, Bullard Subdivision, Immokalee, Colli<< County, Florida. 2. Upon receipt by the Housing and Urban Improvement Director of an agreement for wai_ of impact fees signed by Immokalee Habitat for Humanity, Inc.. and/or the purchaa<<. or other documentation acceptable 10 Ihe County Attomcy, the Board of County Commissioners hereby authoriZell the payment by Collier County of the following ImpllCt fees from the Affordable Housing Trust FWld, Fund (191), in the following amounta for tho one (I) house to be buill on LoI 7, Bullard Subdivision, Immokalee by Immokalee Habitat for Humanity,lnc.: A.
