WHEREAS, in accotdance with Collier County Ordinance No. 93-19, tho County ia IIllhorized 10

impact foca; and
WHEREAS, ImmokaJee Habitat for Hwnanity, Inc. i. seeking a waiver of impact feea; and
WHEREAS, 1mm0kaJee Habitat for Hwnanity, Inc. will construct one (I) tI1rcc-bcxhoom unit (tho
"Dwelling Unit") on Lot 2, Bullsrd Subdivi.ion, 1mm0kaJee which is proposed 10 seU for Forty-Six
Thouaand Five Hundred Dollars ($46,500.00); and
WHEREAS, tho Dwelling Unit will be purchased by a very low income houaehold which is
required 10 invest a minimwn of five hundred (500) hours of "Sweat Equity" before it obtaina title 10 tho
houae; and
WHEREAS, Mr. Charlea C. Smith, Vice Preaident of Immokalee Habitat for Hwnanity, Ioc.,
submitted 10 the Office of Houaing and Urban Improvement an Affordable Houaing Application dated
December 2, 1996 for a waiver of impact foca for the construction of. house on Lot 2, Bullard Subdivision,
ImmokaJee, . copy of said application is on file in the Housing and Urban Improvement Department; IIld
WHEREAS, in accordance with Section 3.04 of the Library System Impact Fee Qrdi...........

Ordinance, Ordinance No. 92-33, as amended; an applicant may obtain a waiver of impact feea by
qualifying for a waiver; and
WHEREAS, Inllnokalcc Habitat for Humanity, Inc. baa qualified for an impact fee waiver buc:d
upon the following representations made by Immokalee Habitat for Humanity, Inc.:
A. The Dwelling Unit shall be sold to a first-time home buyer.
B. The Dwellin8 Unit shall be sold to a household with a very low income level u that term i.
defined in the Appendicealo the respective Impact Fee OrdinaDCCland tho monthly payment
to purchase the unit must be within the affordable houaina guidelines establiahcd in the
Appeodicealo the reapective Impact Fcc Ordinances.
C. Tho Dwelling Unit shall be the Homestead of tho owner.
D. The Dwelling Unit shall r=ain affordable for fifteen (15) yean from the dlIlc the certificate
of occupancy is iuued.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUN1Y COMMISSIONERS
OF COLLIER COUN1Y, FLORIDA, that:
1. The Board of County Commissioners hereby authorizes the County Manager 10 iuue an
Authorization' for waiver of impact focalo ImmokaJee Habitat for Hwnanity, Inc. for one (I)
house which shall be constructed on Lot 2, Bullard Subdivision, 1mm0kaJee, Collier County,
Florida.
2. Upon receipt by the Housing and Urban Improvement Director of an agreement for waiver
of impact foca signed by ImmokaJee Habitat for Humanity, Inc., and/or the ~, or
other docwnentation acceptable 10 the County Anomcy, the Board of County
Commissioners hereby authorizes the payment by Collier County of the following impact
feea from the Affordable Housing Trust Fund, Fund (191), in tho following amounts for the
one (I) house to be built on Lot 2, Bullard Subdivision, 1mm0kaJee by 1mm0kaJcc Habitat
for Humanity, Inc.:
