As your Chairman of the CCPC, I am forwarding this email to briefly explain the issue related to the
attached request. And for the record, I also serve as the Chairman of the Fiddler’s Creek CDD1
Board of Supervisors.
The attached letter is requesting that the proposed rezoning of the Greenway-Fritchey GMPA and
MPUD be removed from the Summary Agenda to address the issue of a proportional fair-share
contribution towards the final payment for the design, permitting, and installation of a traffic signal
at the intersection of US41 and Greenway Road-Sandpiper Drive (entrance to Fiddler’s Creek). As
noted in your agenda packet, the item was heard by the CCPC on October 16th and received
unanimous approval. The Greenway-Fritchey GMPA/MPUD is a great project and a superb example
of a tremendous partnership between Greenway Fritchey Land, LLC, the developer, and Habitat for
Humanity to provide needed affordable housing in Collier County. The CCPC noted as such during
the public hearing; however, during the hearing, the issue of the developer providing a fair-share
contribution towards the final payment for the traffic signal at the US 41-Greenway/Sandpiper
interchange was discussed, similar to the assessed contributions for the two neighboring
developments at the intersection. Though the issue of a fair-share contribution was discussed, it
was not codified in the final approval, primarily due to the fact that the traffic signal was deemed
essentially complete and would be fully operational at the time of the first development order for
the Greenway-Fritchey development.
Subsequently, on October 22nd, Fiddler’s Creek CDD1 and CDD2 Board of Supervisors held their
monthly meetings and having learned of the vote by the CCPC, both CDDs directed their attorney,
Tony Pires, to petition the BCC to have the items removed from the Summary Agenda to have the
BCC consider the inclusion of language in the MPUD as well as the associated Developers
Contribution Agreement (DCA) to codify a requirement to provide a proportional fair-share
contribution towards the final payment for the traffic signal citing that the residents of both CDDs
are actually paying for over 75% of the cost of the traffic signal through assessment in their O&M
CDD taxes. As noted in the attached letter, the traffic signal was initially warranted and
subsequently designed, permitted, and constructed under the management of Fiddler’s Creek
CDD2. Both CDD Boards believed that it is fair to assess the developers of the Greenway-Fritcchy
development for a fair-share contribution, as this development will certainly benefit significantly
from the installation of the traffic signal.
Your approval of the request to modify the MPUD ordinance will not be considered in any way to be
an overturn of the CCPC’s unanimous approval. It will simply be deemed as a reinforcement of the
final approval.

Hi Commissioner Saunders,
I hope you had a good Thanksgiving. I want to follow up with you about a meeting on the
county's general policies on incentivizing affordable housing in the RFMUD, and the specific
consequences to the TDR Sending Lands, which we are all trying to protect for conservation
purposes. The particular hearing coming up on January 13 is regarding the 341 Sabal Palm
Road Residential Subdistrict GMPA adoption hearing. As part of this discussion and issue the
BCC is wrestling with, Audubon Western Everglades has drafted a possible GMP Amendment
to clarify some problematic interpretations being used in recent RFMUD projects like 341
Sabal Palm and the Greenway-Fritchey project (see attached). We got significant input from
Habitat for Humanity on this, although they haven't taken a position on it, yet.
Also, I want to raise a question about the impact of the Kingston project on Collier County and
Corkscrew Swamp Sanctuary.
Is there a time in the coming days and weeks that we might meet on these issues?

Dear Commissioner Hall,
Please do not approve the rezone request for the Mercato West condo project on
U.S. 41 between 92nd and 93rd Avenues in Naples Park.
My biggest concern is that approval will set a precedent for zoning changes along
U.S. 41 in Naples Park. If you approve this rezone, how will you deny future rezone
requests for other
C-3 zoned property in Naples Park? Mercato West is proposed at 50 ft. in height.
What is there to stop another developer from using the full 75 ft. that RMF-16
allows?
I understand that if the rezone is denied, the developer is considering a Live Local
Project. I think that a Live Local project is just as undesirable as the Mercato West
project is at this location, but at least the Live Local project will include some
affordable housing, so if they must build residential, not commercial, I think Live Local
is the better option.
I would prefer to see a commercial project at this location.

I hope you had a good Thanksgiving. I want to follow up with you about a meeting on the
county's general policies on incentivizing affordable housing in the RFMUD, and the
specific consequences to the TDR Sending Lands, which we are all trying to protect for
conservation purposes. The particular hearing coming up on January 13 is regarding the
341 Sabal Palm Road Residential Subdistrict GMPA adoption hearing. As part of this
discussion and issue the BCC is wrestling with, Audubon Western Everglades has drafted
a possible GMP Amendment to clarify some problematic interpretations being used in
recent RFMUD projects like 341 Sabal Palm and the Greenway-Fritchey project (see
attached). We got significant input from Habitat for Humanity on this, although they
haven't taken a position on it, yet.
Also, I want to raise a question about the impact of the Kingston project on Collier
County and Corkscrew Swamp Sanctuary.
Is there a time in the coming days and weeks that we might meet on these issues?

#2, (CDD#2), collectively the “Districts”, concerning the above referenced items presently

I am writing to express my strong opposition to the proposed rezoning of the parcel west of
Mercato — from C-3 (Commercial Intermediate) to RMF-16 (Residential Multi-Family, 16
units/acre) — directly adjacent to Naples Park in District 2. This proposal is outlined in the
official Collier County Planning application:

While I understand the desire to introduce residential use along U.S. 41, I believe this proposal
is incompatible with the character, infrastructure, and long-term vision of our community. I
urge you to consider the following:
Why RMF-6 Is More Appropriate Than RMF-16 — Even Along U.S. 41
1. Proximity to U.S. 41 Doesn’t Justify High-Density Zoning
Although the site borders a major corridor, that alone does not warrant urban-scale density.
U.S. 41 is already congested, and RMF-16 — which allows up to 16 units per acre and 50-foot
buildings — would significantly increase traffic and strain local infrastructure.
2. C-3 to RMF-16 Is a Sharp Shift in Land Use
C-3 zoning currently allows for commercial and mixed-use development that complements
Naples Park with walkable amenities. Rezoning to RMF-16 removes this potential and
replaces it with dense residential blocks, fundamentally altering the corridor’s role in the
community.
3. RMF-6 Offers a Balanced Transition Zone
Naples Park is already zoned RMF-6, which allows for single-family homes, duplexes, and
small-scale multi-family buildings at a density of 6 units per acre. This zoning has guided the
neighborhood’s development for decades and reflects its established character.
If residential use is the goal for the parcel west of Mercato, RMF-6 provides a more
appropriate transition from commercial frontage to the low-density residential core of Naples
Park. It supports incremental growth without introducing mid-rise towers or doubling the
density, and it maintains consistency with the surrounding zoning framework.
4. Community Character and Scale Matter
Naples Park is a neighborhood of modest homes, very narrow streets, and limited parking.
Many of our roads are grandfathered at just 18 feet wide, with no sidewalks running east-
west, making it especially difficult for delivery trucks, service vehicles, emergency
responders, and pedestrians to navigate safely. Residents often walk in the roadway, which
poses safety risks — especially during peak season or construction activity. The inclusion of
only 4 spaces for visitor/delivery for a high density 28-unit project only exacerbates this.
5. Infrastructure Is Already Under Strain
Naples Park is currently undergoing extensive PUR (Potable Water, Utilities, and
Reuse) infrastructure upgrades, which have disrupted roads and services for months. These
projects are necessary to address aging systems — not to accommodate a sudden influx of
high-density development.
Additionally, while new development is subject to impact fees, these fees often do not cover
the full cost of infrastructure improvements — especially in older neighborhoods like Naples
Park where retrofitting is more complex and expensive. The financial burden of closing that
gap frequently falls on existing residents and taxpayers.
6. Setback Implications and Visual Impact
RMF-16 zoning allows taller buildings with deeper setbacks — but even with increased
minimums, 50-foot structures positioned just 30 feet from the property line still pose
significant impacts. A 5-story building at that distance does not preserve the scale or character
of adjacent single-story homes. The sheer size and height would overwhelm the surrounding
homes, casts long shadows, and erodes privacy for neighboring residents. Simply meeting a
30-foot minimum setback does not mitigate the disproportionate scale or the visual and
spatial intrusion such height introduces.
By contrast, RMF-6 which limits height to 35 feet is more compatible with existing lot sizes and
street widths in Naples Park, preserving sunlight access, open space, and the character of a
low-rise residential neighborhood.
7. Precedent and Planning Principles
Approving RMF-16 here sets a precedent for high-density zoning along other stretches of U.S.
41 adjacent to residential neighborhoods setting the stage to introduce other 5-story buildings
and hundreds of new units — out of scale with the existing fabric and incompatible with the
infrastructure. That undermines long-term planning goals of preserving community character
while managing growth responsibly.
Conclusion
Naples Park is not opposed to growth — but we believe it must be thoughtful, measured, and
consistent with the neighborhood’s character. RMF-6 zoning offers a responsible path
forward, allowing residential development while preserving the scale, livability, and
infrastructure integrity of our community.
I respectfully request that you deny the RMF-16 rezoning and consider RMF-6 or a mixed-use
C-3 alternative similar to Mercato across the street that better aligns with the needs and
values of Naples Park residents.

on behalf of both Fiddler’s Creek Community Development District #1 (CDD#1) and
Fiddler’s Creek Community Development District #2, (CDD#2), collectively the
“Districts”, concerning the 12.9.25 Agenda Item 17.E, PL20220002061, GREENWAY
FRITCHEY RPUD (Rezoning, “RZ”); and, Agenda Item 17.F, GMPA-PL20220002063
(“GMPA”).
After re-reading the Agenda, I noted that the proposed “companion” Developer
Agreement is on the Consent Agenda as Agenda Item 16.B.9.

On behalf of the Districts it is respectfully requested that all three (3) of these agenda
items be removed from the Consent Agenda and Summary Agenda and moved to the
Regular Agenda to address the concerns and objections of the Districts.
By this correspondence, in addition to the objection in my prior letter, the Districts
object to the proposed Developer Agreement as currently drafted, as the Developer
Agreement fails to include any “proportionate fair share” requirements for the subject
Traffic Signal as outlined in my prior letter and email of Thursday, December 4, 2025.
If you have any questions in advance of the Board meeting and hearings, please do
