Agenda 12/09/2025 Item #16D 7 (The Chair to sign (a) Home Investment Partnerships Program Developer Agreement #HM24-01)12/9/2025 Item # 16.D.7 ID# 2025-4816 Executive Summary Recommendation to approve and authorize the Chair to sign (a) Home Investment Partnerships Program Developer Agreement #HM24-01 in the amount of $1,250,000 (b) Multifamily HOME-Assisted Project Letter of Commitment and (c) Local Government Voluntary Contribution Agreement in the amount of $37,500 between Collier County and Casa San Juan Diego, Ltd., to support the cost of construction associated with the development of five (5) HOME assisted units. Housing Grant Fund (1835), Miscellaneous Grants Fund. (1077) OBJECTIVE: To provide funding to support the construction of new rental housing units to serve low-income households in Immokalee and further the County’s strategic plan focus area to provide comprehensive affordable housing opportunities. CONSIDERATIONS: In accordance with 24 CFR 91, Collier County is required to submit to the U.S. Department of Housing and Urban Development (HUD) a Consolidated Plan every five years outlining the goals and activities to be undertaken with HUD entitlement funds over the five-year period for the Community Development Block Grant (CDBG), Home Investment Partnerships Program (HOME), and the Emergency Solutions Grants (ESG). The Board of County Commissioners (Board) approved the Collier County 2021-2025 Consolidated Plan on June 22, 2021 (Agenda Item #16.D.7). The Consolidated Plan is implemented through the Annual Action Plan, which provides a summary of the activities and the specific federal and non-federal resources to be used each year. On July 23, 2024 (Agenda Item #16.D.4), the Board approved the Collier County One-Year Action Plan and associated Budget Amendment for Federal Fiscal Year 2024-2025, including rental activities for the HOME Investment Partnership Program. Annually, the Community and Human Services (CHS) staff advertise an application cycle to secure organizations to implement housing strategies. In FY24, the grant application cycle opened from January 9, 2024, through January 19, 2024. CHS received a total of ten applications for eligible projects. On March 27, 2024, the Review and Ranking committee met to review all the applications and recommended the award of $1,250,000 to Casa San Juan Diego, Ltd. for the new construction of affordable rental housing. On April 8, 2025 (Agenda Item # 16.D.5), the Board approved the Substantial Amendment to allow for the reallocation of 2020, 2021, and 2022 HOME funds to be provided for this project. Agreement #HM24-01 The proposed agreement with Casa San Juan Diego, Ltd., in the amount of $1,250,000 will contribute to creating additional affordable housing units for low-income households of Collier County and requires a 25% match contribution from nonfederal sources in the amount of $312,500, which will be provided by the Developer. The project includes the development of 80 multifamily rental apartment units in Immokalee, FL. HOME funds will contribute to pre- development and construction costs associated with five (5) HOME units including, but not limited to, permitting and survey fees, developer fees, bond and insurance fees, professional services, site work, infrastructure, labor and materials, on-site work, site improvements, project management, appliances, labor and materials, connection fees; and any other associated construction costs for the development of affordable housing. Letter of Commitment Pursuant to the requirements of 24 CFR 92.2, the County is required to issue a Letter of Commitment, which is a formal, binding commitment that documents the commitment of HOME funds to the project. The agreement outlines the essential terms and conditions under which funding will be provided, including project scope, timelines, required match, affordability obligations, and key federal compliance requirements. Local Government Voluntary Contribution The Florida Housing Finance Corporation (FHFC) requires developers to provide verification of a local government’s financial commitment to their project. The Local Government Verification (LGVC) form serves as the County’s official Page 5320 of 9661 12/9/2025 Item # 16.D.7 ID# 2025-4816 contribution and provides the developer with the necessary points in the FHFC application process. On October 22, 2019 (Agenda Item 11.J), the Board authorized the County Manager to sign commitment documents for Housing Trust Fund resources. These resources will serve as Collier County’s contribution to the project. These funds are not typically needed until the project has been awarded FHFC funding and has closed. FHFC requires the use of its standard LGVC form, which was previously signed by the former County Manager on September 9, 2020. The award amount of $37,500 will be contributed in accordance with Collier County Board of County Commissioners Resolution No. 2018-82, approved October 22, 2019 (Agenda Item 11.J), establishing the Local Housing Trust Fund (LHTF) Program. Additional documents pertaining to this agreement, as required, include the HOME Subordinate Mortgage, the HOME Promissory Note, and the Land Use Restriction Agreement, all of which are attached for reference. The developer shall be responsible for a twenty (20) year commitment. This activity supports the Strategic Plan by supporting comprehensive affordable housing opportunities. FISCAL IMPACT: This proposed action has the following fiscal impact. The funding sources for the $1,250,000 portion of the award are budgeted in Housing Grant Fund (1835) Projects 33688, 33762, and 33810. The HUD HOME program requires a 25% match obligation, and this will be met by the Developer. The funding source for the Local Government Voluntary Contribution in the amount of $37,500, is budgeted in the Affordable Housing Trust Fund (1077) Project 50137. GROWTH MANAGEMENT IMPACT: This agreement has no impact on the Housing Element of the Growth Management Plan for Collier County.
